AN ORDINANCE relating to City administration, creating the position of Deputy Chief of
Police, designating the position of Deputy Chief of Police as being
exempt from Civil Service, making the Deputy Chief of Police directly
responsible to the Chief of Police, and amending Sections 1 18 030 and
1 48 020 and adding Section 1 54 050, all of the City of Yakima
Municipal Code
WHEREAS, the Specific Rules and Regulations of the Civil Service Commission for
Police Employees of the City of Yakima, adopted January 18, 1989, set forth the
classifications of employees in the Yakima Police Department; and
WHEREAS, said Specific Rules and Regulations of the Civil Service Commission for
Police Employees of the City of Yakima specifically allow classifications within the City of
Yakima's Police Department to be created and amended by Ordinance, and
WHEREAS, the City Council believes it to be in the best interest of the City of Yakima
and its citizens to create the position of Deputy Chief of Police in order to assist the City and
Chief of Police in the better and more effective administration of the Yakima Police
Department; and
WHEREAS, the City Council desires to exclude any Deputy Chief of Police from Civil
Service in order to make any appointee to the position of Deputy Chief of Police responsible
to the Chief of Police in order to achieve better and more effective administration and to
assure the accomplishment of the City's policies and goals,
BE IT ORDAINED BY THE CITY OF YAKIMA.
Section 1. Section 1 18 030 of the City of Yakima Municipal Code is hereby
amended to read as follows.
1 18.030 Police department.
A. Under the direction of the chief of police, or the deputy chief of police who shall
have the full authority to act as the chief of police in the absence or incapacity of
the chief of police or the chief of police's designation of such authority, this
department shall
1 Provide for the protection of persons and property and event crimes,
2 Detect and apprehend offenders and suspected persons,
3 Enforce all ordinances and statutes relating to law enforcement and traffic
control,
4 Preserve peace and order in the city;
5 Perform such other duties as may be required
B This department shall be organized into primary divisions, as determined by the
chief of police and supervised by police captains and lieutenants who report to
the chief of police and deputy chief of police when so delegated, as follows.

1 The patrol division shall be responsible for uniform field personnel and
operational patrol functions, traffic control and enforcement of the City's
traffic ordinances pertaining to nonmoving traffic violations, concurrently with
the police department. Parking checkers employed in this office are vested
with authority to enforce such ordinances by placing notices on illegally
parked vehicles, as prescribed by applicable ordinances, and by signing
formal complaints for the issuance of warrants by the court for violations of
such ordinances
2. The detective division shall be responsible for the investigative functions of
the police department, bureau of records, and the youth bureau
3 The administrative services division shall be responsible for administrative
services, communications and complaints, and training functions
4 Additional divisions may be established, or existing divisions consolidated, at
the discretion of the chief of police subject to budget authorization.
C Public Safety Communications Division Under the joint direction of the police
chief and the fire chief, and the supervision of the public safety communications
manager, this division shall:
1 Provide communication services to the police and fire departments and
other public agencies as directed by the city
2. Provide electronic maintenance and repair services to city departments and
other public agencies as directed by the city (Ord 2001 -29 § 1, 2001 Ord
96 -44 § 1, 1996 Ord. 2570 § 6, 1981 Ord. 1748 § 2, 1975 Ord. 1572 § 2,
1973 Ord. 1430 § 1, 1972: Ord. 7 § 3, 1959)
Section 2. Section 1 48 020 of the City of Yakima Municipal Code is hereby
amended to read as follow'
1.48.020 Police officer positions.
The following positions in the police department of the city are designated as police
officer positions for the purpose of application of the Washington Law Enforcement Officers'
and Fire Fighters' Retirement System
Police chief
Deputy chief of police
Police captain
Police lieutenant
Police sergeant
Police officer

Section 3. Section 1 54 050 is hereby enacted as a new section of the City of
Yakima Municipal Code to read as follows
1.54.050 Deputy Chief — appointment and removal.
Any deputy chief of police appointed shall be appointed by the chief of police upon
the basis of his /her qualification and experience for such office, and may be removed by the
chief of police at any time, for any reason, subject only to any applicable law, ordinance,
rule or regulations then in force and effect. Any deputy chief of police appointed is excluded

from the civil service Any and all civil service rules, including but not limited to rules
concerning examination, appointment, promotion, transfer, reinstatement, demotion
suspension, discipline, advancement, removal or discharge, shall not apply to the deputy
chief of police
Section 4. This Ordinance shall be in full force and effect 30 days after its
passage, approval, and publication as provided by law and by the City Charter
