HomeMy WebLinkAbout1984-2826 AMENDING CITY ORDINANCE NO. 2819 2 2 3 ORDINANCE NO. 0 . , AN ORDINANCE amending City of Yakima Ordinance No. 2819, III enacted November 27, 1984, and entitled "An Ordinance providing for the vacation of a 4 111 public alley in the City of Yakima, Washington"; and declaring an emergency. WHEREAS, by Ordinance No. 2819, enacted November 27, 1984 and entitled "An Ordinance providing for the vacation of a . public alley in the City of Yakima, Washington", a portion of a public alley was vacated, and the owner of the property abutting both. sides of the vacated alley subsequently requested that the City Council declare an emergency so that the alley vacation would be immediately effective, and WHEREAS, the City Council does hereby find and declare 4111 an emergency to exist based on the construction and financial planning of the property owner, and based on a situation hazardous to the general public created by excavation activity in the area, for eventual construction purposes, but with the alleyway left open to travel by the general public, and WHEREAS, the City Council finds that Ordinance No. 2819 should be amended so that the alley vacation provided by that ordinance would be immediately effective, now, therefore, . . Section 1. Sections 1 and 2 of City of Yakima Ordinance No. 2819, enacted November 27,, 1984, and entitled "An Ordinance 410 providing for the vacation of a public alley in the City of Yakima, Washington" is hereby amended to read as follows: . • "Section 1. The following public alley in the of Yakima, Washington, to wit: • That certain strip of right-of-way lying within the MacCrimmon and Needham's Subdivision as recorded in . Volume "A" of Plats, Page 40, records of Yakima County, Washington, described as follows: That certain strip of right-of-way being 20 feet in width, lying between the north right-of-way line of Summitview Avenue and the south right-of-way line of the alley which runs in an east and west direction, and adjacent to lots 22 & '23, all within said subdivision. 41/ 11111P be, and the same is hereby, vacated. II, Section 2:. This ordinance is one to provide for the immediate preservation of the public peace, property, health, safety and welfare of the people of the City . of Yakima and an emergency is hereby declared to exist and this ordinance shall be in full force and effect immediately upon its passage, approval and publication • • as provided by law and by the City Charter; provided, this ordinance shall not become effective until compen- sation in the amount of $6,250.00 has been paid to the City." Section 2. This ordinance is one to provide for the 410 immediate preservation of the public peace, property, health, safety and welfare of the people of the City of Yakima and an emergency is hereby declared to exist and this ordinance shall be in full force and effect immediately upon its passage, approval and publication as provided by law and by the City Charter.
