AN ORDINANCE relating to changes in utility services practices, amending Sections
4 16 140, 7 50 040, 7 50 0900, 7 60 020, 7 60 025, 7 60 100, 7 60 105,
7 68. 250 and 7 62.282 of the City of Yakima Municipal Code; and
establishing an effective date.
WHEREAS, the City of Yakima (City) is in the process of developing a new Utility
Management System (UMS) to better serve both our internal and external customers,
WHEREAS, the UMS is being developed in a fashion that will allow more accurate billing
of utility accounts, including billing on a daily basis;
WHEREAS, current rate ordinances do not address daily rates;
WHEREAS, the City Council finds and determines that the rates and charges for utility
service set forth in this ordinance are fair, just and reasonable,
WHEREAS, the City Council finds and determines that such circumstances and
procedures should be amended as set forth in the Ordinance;
NOW THEREFORE, BE IT ORDAINED BY THE CITY OF YAKIMA.
Section 1 Section 4 16 140 of the City of Yakima Municipal Code is hereby
amended to read as follows:
4.16.140 Classification of premises — Charges.
A. For the purpose of regulating the collection of garbage and refuse in the city of Yakima,
there are established two classifications: one to be known as the "residential classification," and
the other as the "business classification." The residential classification shall include all premises
occupied as a single - family housekeeping unit, either in dwelling houses, apartments, or other
multiple residences. "Residential unit," as used herein, is defined as a unit in which all persons
reside together as a single family, whether in single or multiple dwellings. The business
classification shall include all other premises.
Provided, property owned by the city may be served by city equipment and crews
independently of the classifications and rates established by this chapter; provided further, the
rules and regulations established by this chapter pertaining to receptacles and to the
preparation, storage, and collection of garbage, refuse and debris shall be applicable to all
property within the city, including that owned by the city
B. The collection of all refuse in the business classification shall be made only by licensed
collectors, hereinafter provided for, at rates to be set by the Washington Utilities and
Transportation Commission.
C. The collection of all refuse in the residential classification shall be conducted by the city
of Yakima equipment and personnel and financed by garbage and refuse collection fees
hereinafter set forth. The city of Yakima shall not collect refuse from apartments or multiple units
in excess of four units except upon the request of the owner or operator thereof The following
collection fees and practices shall apply for all garbage collection services conducted by the city
of Yakima.
1 There are hereby imposed for refuse collection in the residential classification the
following charges for each single - family dwelling and for each residential unit in any multiple
dwelling:

An overfill fee of two dollars and fifteen cents shall be imposed each time an automated cart
is filled past its visible full limit or the cart lid will not close due to overfilling

requests refuse collection service at a time other than the regularly scheduled time.

An overfill fee of eleven dollars and twenty -three cents shall be imposed each time a bin is
filled past its visible full limit or the bin lid will not close due to overfilling.

If a Refuse account is open for less than one month, it shall be billed at the weekly rate
multiplied by the number of weeks the account is open, rounding up. A minimum charge of one
week will be charged to all Refuse accounts, even if they are not open for an entire week. The
weekly rate is calculated by dividing the corresponding monthly rate by 4 33.
2. In addition to the charges imposed by subsection (C)(1) of this section, a separate
charge, to be known as the "yard service charge," is imposed on each residential unit that elects
to receive yard material collection service from the city during the nine -month period of each
year commencing March 1st and ending November 30th. Such service shall utilize one or more
ninety- six - gallon carts owned and provided by the city The yard service charge shall be eleven
dollars and seventy -five cents per month for one ninety- six - gallon cart, plus five dollars and
eighty -seven cents per month for each additional ninety- six - gallon cart, and shall be billed to
each residential unit that elects to receive this service at the time and as a part of the billings
rendered for other city services applicable for that nine -month period. A call -back charge of
eleven dollars and five cents shall be imposed each time a customer requests yard material
collection service at a time other than the regularly scheduled time If a yard service account is

3. All of the charges for garbage and refuse collection provided in subsections (C)(1) and
(C)(2) of this section shall be billed for and paid at the same time and for the same period as
billings and payments are made for other city utility services; or, in the event a customer is
served by the refuse division but is not served with another city utility, garbage and refuse
collection charges shall be billed and paid for according to the schedule which would be
applicable to such customer were he so served with another city utility service. Accounts shall
become delinquent if not paid within the time specified by YMC 7.50.080 for payment of water
service charges
4 Garbage and refuse collection charges will be suspended for any customer upon
advance notice to the office of the division of utility accounts that a particular premises served
will be unoccupied and such charges will be resumed on notice to such office to resume service
No such suspension of charges for garbage and refuse collection service will be made for any
premises served with any other city utility unless all city utility service to such premises is
likewise suspended.
Application for resumption of service to a new customer shall be made to the office of the
division of utility accounts on forms provided for that purpose which shall contain the name of
the customer and the street address and number of units of the premises to be served.
5 Collection service may be suspended for nonpayment of accounts, but such suspension
shall not relieve the person owing such account from the duty of complying with the provisions
of this chapter or other ordinances pertaining to garbage, refuse, or sanitation. Such suspension
of service shall render the premises where such collection service is suspended subject to
condemnation for lack of sanitary requirements, and the owner or person in charge or in
possession of said premises shall be subject to prosecution for maintaining a nuisance thereon,
as well as enforcement of all other applicable laws.
6 Upon failure to pay such charges and upon delinquency, the amount thereof shall
become a lien against the property from which the garbage collection service shall have been
rendered. Such lien shall be made effective by filing a notice thereof specifying the charges, the
period covered by the charges and giving a legal description of the premises at which the
service was rendered. Such lien shall be filed with the same official and within the time and shall
be foreclosed within the time and manner prescribed by law for filing and foreclosing liens for
labor and material, and shall be superior to encumbrances filed subsequent to the filing of such
lien, but shall be subject to all general taxes and local improvement assessments, whether
levied prior or subsequent thereto.
D The yard material collection service, for which the yard service charge is imposed by
subsection (C)(2) of this section, shall include the weekly collection of yard material from
automated /semi- automated plastic ninety- six - gallon carts fumished by the city department of
public works during the nine -month period for which the yard service charge is billed to any
particular premises. For collection purposes, the total weight of each cart including yard material
deposited therein may not exceed two hundred pounds. Yard material larger than four inches in
diameter or too long to fit within a ninety - six - gallon cart when covered by its lid shall not be
placed in a ninety-six-gallon cart for collection, but may, upon proper request, be collected as
special haul material.
E. In addition to the regulations adopted and charges imposed by subsections C and D of
this section, further charges are imposed in the following types of service.
1 A charge of two dollars and fifteen cents, in addition to the surcharge for collecting refuse
and yard material, shall be made for each extra container, bag, box or bundle of tree or shrub
trimmings collected from any particular residential premises.
2. For a special garbage pickup, actual cost shall be charged to the customer Actual cost
shall include the city's actual cost for labor, equipment rental, and landfill fees. The minimum

Section 2. The title of Section 7 50 of the City of Yakima Municipal Code is hereby
amended to read as follows -

UTILITY ACCOUNTING, BILLING AND ADMINISTRATION
Section 3. Section 7.50 040 of the City of Yakima Municipal Code is hereby
amended to read as follows.
7.50.040 Utility services fees.
For purposes of this section, business hours are considered to be eight a.m. to six p.m.
Monday through Friday, excluding holidays. The following fees and charges shall apply when
the listed actions are taken /provided by the utility services division. The fees set forth in the
following table shall be considered the base for calculations of future fee increases. Once every
two years beginning in March, 2008 (or as soon thereafter as reasonably possible based upon
availability of the indices set forth herein), an adjustment shall be added to the base figures that
is either eighty percent of the December change in the United States Consumer Price Index for
Wage Earners and Clerical Workers (CPI -W) for the Seattle, Tacoma, Bremerton region or
eighty percent of the December Implicit Price Deflator for Personal Consumer Expenditures,
whichever is lower and rounded to the nearest whole dollar, to reflect the changes in inflation for
these two indices over the previous two calendar years. (For purposes of determining the
change in the CPI, the standard reference base period of 1984 equals one hundred will be
used.)

Section 4 Section 7 50 090 of the City of Yakima Municipal Code is hereby
amended to read as follows
7.50.090 Irrigation accounts.
A. All accounts of property receiving irrigation charges shall be identified in the records of
the utility services division by the house and/or street number and under the account number
assigned thereto, as well as by the name and address of the owner or of the customer All bills
and notices related to irrigation that are sent out by the utility services division shall be sent to
the house and street number of the owner of said property Any changes in ownership and/or
errors in the billing /mailing address shall be promptly reported to the utility services division by
the property owner and /or their agent.
B. Effective January 1, 1998, a bill for each customer shall be generated every two months
for irrigation system rates and charges incurred during the preceding two-month period. For
purposes of this bimonthly billing, the annual rates and charges set forth in YMC 7.24.100 shall
be divided into six equal amounts. If an account is open for less than an entire billing cycle, it
shall be billed at the daily rate. The daily rate is calculated by dividing the annual rates and
charges set forth in YMC 7.24100 by 365. The bill shall be rendered as part of the bill for other
utility services rendered by the city, including domestic water, wastewater, and refuse collection
All payments for irrigation system rates and charges shall be due and payable to the office of
the treasurer on or before the fourteenth day after the bill therefor is rendered.
C All domestic water service and/or irrigation water service may be suspended to any
premises for which the irrigation water service charge remains unpaid for a period of twenty-one
days after the due date stated on the billing statement; provided, that no domestic water service
or irrigation water service shall be suspended until a written notice has been served upon or
mailed to the customer, at least seven days prior to suspending service. Such notice shall state
the date on which domestic water service and /or irrigation water service is to be suspended, the
amount of delinquent charges, and that a customer may request, in writing, a hearing before the
utility services manager, or his /her designee, to contest the suspension, provided, that such
request is received by the customer service manager or his or her designee before the
suspension date stated in the notice of suspension.
D Upon timely receipt of a request for a hearing as provided in subsection C of this section,
the utility services manager or his or her designee shall conduct a hearing, and the customer
requesting the hearing shall be notified in writing by the utility services manager, or his /her
designee, of the date, time and place of such hearing. Pending the outcome of such hearing, no
domestic water service or irrigation water service to the customer's premises shall be
suspended.
E. In the event of a delinquency in the payment of charges for irrigation water service to any
premises or property, the city may exercise its remedies as described in YMC 7.50.080(E),
pursuant to RCW 35.21.290 and 35.21 300, against such premises by discontinuing domestic
water service and /or irrigation water service thereto If domestic water service and /or irrigation
water service is suspended as a result of a delinquent utility service account in accord with
subsection C of this section, such service shall not be reinstated until all delinquencies and
unpaid charges against such premises for irrigation water service have been paid. (Ord. 2006-

Section 5 A new section 7 50 150 is added to the City of Yakima Municipal Code as
follows:
7 50 150 Budget Billing
City of Yakima may offer residential utility customers the option of a budget payment plan. The
budget payment plan shall be set forth in a program policy and guidelines document, as
adopted or amended from time to time, of the Utility Services Manager, subject to approval by
the Finance Director
Section 6 Section 760 020 of the City of Yakima Municipal Code is hereby
amended to read as follows:
7.60.020 Owner (inside city) retail wastewater service charge.
A. Wastewater Service Charge. There shall be charged to and collected from all premises
within the city served by the city wastewater system a wastewater service charge composed of
a ready- to-serve charge and a volume charge based on either the quantity of water supplied to
the premises or, if metered, the quantity of wastewater discharged into the wastewater sewer
system; provided, that in no event shall the total wastewater service charge be less than the
minimum charge indicated below

Section 8 Section 7 60 100 of the City of Yakima Municipal Code is hereby
amended to read as follows:
7 60.100 Additional collection method —Water service suspension — Notice and hearing
procedure.
A. As an additional and concurrent method of collection of any such delinquent wastewater
rate or charge, the Utility Services manager may suspend the water service or
supply from the premises to which such charge for wastewater has attached until such rates
and charges are paid.
B No water service shall be suspended until a written notice has been served upon or
mailed to the customer at least seven days prior to suspending service. Such notice shall state
the date on which service is to be suspended, the amount of delinquent wastewater charges,
and that a customer may request in writing a hearing before the customer service manager or
his designee to contest the suspension, provided such request is received by the customer
service manager or his designee before the date service is to be suspended.
C Upon timely receipt of a request for hearing, the customer service manager or his
designee shall conduct a hearing, and the customer requesting the hearing shall be notified in
writing by the customer service manager or his designee of the time, date and place of such
hearing. Pending the outcome of a hearing, no service shall be suspended.
D When water service has been suspended for nonpayment of a wastewater charge, water
service shall not be resumed until all delinquent service charges have been paid, together with
an additional fifteen - dollar reconnection charge
E. In the event the occupant of a premises is someone other than the customer, the
occupant or, in the case of a multiple dwelling, the manager or person in charge shall be notified
in writing of the date of the suspension of service and the amount of delinquency at the same

Section 9 Section 7 60 105 of the City of Yakima Municipal Code is hereby
amended to read as follows:
7.60.105 Rates, charges and fees for pretreatment program.
A. It is the purpose of this section to provide for the payment of rates, charges and fees for
certain discharges to the wastewater system, to compensate the city for the cost of
administration of the pretreatment program established in Chapter 765 Connection charges for
dischargers subject to Chapter 7 65 are as set forth in Chapter 7 68 of this code.
B. Rates, Charges and Fees to Be Published. The wastewater manager shall maintain a
schedule of current rates, charges and fees, shall post such schedule conspicuously, and shall
make copies available to interested persons. Upon request, the wastewater manager shall
prepare an estimate of annual fees for a significant industrial user
C Significant Industrial Users (SIUs) Commencing on the effective date of the ordinance
codified in this section, SIU permit fees amounts shall be set at ninety percent of that amount
identified in the Industrial Facility Categories of WAC 173 - 224 -040 The permit fee shall cover
the costs of administering the SIU wastewater discharge permit program including inspections,
technical assistance, education, and compliance administration. Costs associated with any
sampling and testing shall be in addition to the permit fee. This annual fee is based on the
state's fiscal year (July 1st —June 30th).
D Base Fee for Minor Industrial Users (MIUs) Commencing on the effective date of the
ordinance codified in this section and until amended pursuant to subsection F of this section,
minor industrial users (as defined in Chapter 7 65) shall pay a b ase fee for pretreatment service.

7 68.250 Water services charges.
A. For calendar years 2009 and beyond, the charge for domestic water supplied within the City
of Yakima shall consist of a ready -to -serve charge and a charge for water consumed, as
follows.

utility charges under this subsection, the residential customer must present to the director of
finance and budget or their designee written documentation annually from a recognized kidney
dialysis center certifying that the person requires dialysis and the quantity of water needed for
that person's dialysis "

AN ORDINANCE relating to changes in utility services practices; amending Sections
4 16 140; 7 50 040; 7 50 090; 7 60.020; 7 60.025, 7 60100; 760 105,
7 68.250 and 7 62.282 of the City of Yakima Municipal Code; and
establishing an effective date
WHEREAS, the City of Yakima (City) is in the process of developing a new Utility
Customer Service System (UCSS) to better serve both our intemal and external customers; and
WHEREAS, the UCSS is being developed in a fashion that will allow the City to enhance
customer service and improve the accuracy of our processes in ways not currently addressed in
the Yakima Municipal Code, and
WHEREAS, current rate ordinances do not address daily rates; and
WHEREAS, the City Council finds and determines that the rates and charges for utility
service set forth in this ordinance are fair, just and reasonable, and
WHEREAS, the City Council finds and determines that such circumstances and
procedures should be amended as set forth in the Ordinance, and
NOW THEREFORE, BE IT ORDAINED BY THE CITY OF YAKIMA.
Section 1 Section 4 16 140 of the City of Yakima Municipal Code is hereby
amended to read as follows'
4.16.140 Classification of premises—Charges.
A. For the purpose of regulating the collection of garbage and refuse in the city of
Yakima, there are established two classifications: one to be known as the "residential
classification," and the other as the "business classification." The residential
classification shall include all premises occupied as a single- family housekeeping unit,
either in dwelling houses, apartments, or other multiple residences. "Residential unit,"
as used herein, is defined as a unit in which all persons reside together as a single
family, whether in single or multiple dwellings. The business classification shall include
all other premises
Provided, property owned by the city may be served by city equipment and crews
independently of the classifications and rates established by this chapter; provided
further, the rules and regulations established by this chapter pertaining to receptacles
and to the preparation, storage, and collection of garbage, refuse and debris shall be
applicable to all property within the city, including that owned by the city
B The collection of all refuse in the business classification shall be made only by
licensed collectors, hereinafter provided for, at rates to be set by the Washington
Utilities and Transportation Commission.
C The collection of all refuse in the residential classification shall be conducted by
the city of Yakima equipment and personnel and financed by garbage and refuse
collection fees hereinafter set forth. The city of Yakima shall not collect refuse from

apartments or multiple units in excess of four units except upon the request of the
owner or operator thereof The following collection fees and practices shall apply for all
garbage collection services conducted by the city of Yakima.
1 There are hereby imposed for refuse collection in the residential classification the

If a Refuse account is open for less than one month, it shall be billed at the weekly
rate multiplied by the number of weeks the account is open, rounding up. A minimum
charge of one week will be charged to all Refuse accounts, even if they are not open for
an entire week. The weekly rate is calculated by dividing the corresponding monthly rate
by 4.33.

2. In addition to the charges imposed by subsection (C)(1) of this section, a
separate charge, to be known as the "yard service charge," is imposed on each
residential unit that elects to receive yard material collection service from the city during
the nine -month period of each year commencing March 1st and ending November 30th
Such service shall utilize one or more ninety - six - gallon carts owned and provided by the
city The yard service charge shall be eleven dollars and seventy -five cents per month
for one ninety - six - gallon cart, plus five dollars and eighty -seven cents per month for
each additional ninety - six - gallon cart, and shall be billed to each residential unit that
elects to receive this service at the time and as a part of the billings rendered for other
city services applicable for that nine -month period. A call -back charge of eleven dollars
and five cents shall be imposed each time a customer requests yard material collection
service at a time other than the regularly scheduled time If a yard service account is
open for less than one month, it shall be billed at the weekly rate multiplied by the
number of weeks the account is open, rounding up. A minimum charge of one week will
be charged to all Yard Waste accounts, even if they are not open for an entire week.
The weekly rate is calculated by dividing the corresponding monthly rate by 4.33.
3 All of the charges for garbage and refuse collection provided in subsections
(C)(1) and (C)(2) of this section shall be billed for and paid at the same time and for the
same period as billings and payments are made for other city utility services; or, in the
event a customer is served by the refuse division but is not served with another city
utility, garbage and refuse collection charges shall be billed and paid for according to
the schedule which would be applicable to such customer were he so served with
another city utility service Accounts shall become delinquent if not paid within the time
specified by YMC 7.50.080 for payment of water service charges
4 Garbage and refuse collection charges will be suspended for any customer upon
advance notice to the office of the division of utility accounts that a particular premises
served will be unoccupied and such charges will be resumed on notice to such office to
resume service No such suspension of charges for garbage and refuse collection
service will be made for any premises served with any other city utility unless all city
utility service to such premises is likewise suspended
Application for resumption of service to a new customer shall be made to the office of
the division of utility accounts on forms provided for that purpose which shall contain the
name of the customer and the street address and number of units of the premises to be
served.
5 Collection service may be suspended for nonpayment of accounts, but such
suspension shall not relieve the person owing such account from the duty of complying
with the provisions of this chapter or other ordinances pertaining to garbage, refuse, or
sanitation. Such suspension of service shall render the premises where such collection
service is suspended subject to condemnation for lack of sanitary requirements, and the
owner or person in charge or in possession of said premises shall be subject to
prosecution for maintaining a nuisance thereon, as well as enforcement of all other
applicable laws.
6 Upon failure to pay such charges and upon delinquency, the amount thereof shall
become a lien against the property from which the garbage collection service shall have
been rendered. Such lien shall be made effective by filing a notice thereof specifying the
charges, the penod covered by the charges and giving a legal description of the
premises at which the service was rendered. Such lien shall be filed with the same
official and within the time and shall be foreclosed within the time and manner
prescribed by law for filing and foreclosing liens for labor and material, and shall be
superior to encumbrances filed subsequent to the filing of such lien, but shall be subject
to all general taxes and local improvement assessments, whether levied prior or
subsequent thereto.
D The yard material collection service, for which the yard service charge is
imposed by subsection (C)(2) of this section, shall include the weekly collection of yard
material from automated/semi- automated plastic ninety - six - gallon carts furnished by the
city department of public works during the nine -month period for which the yard service
charge is billed to any particular premises. For collection purposes, the total weight of
each cart including yard material deposited therein may not exceed two hundred
pounds. Yard material larger than four inches in diameter or too long to fit within a
ninety - six - gallon cart when covered by its lid shall not be placed in a ninety- six - gallon
cart for collection, but may, upon proper request, be collected as special haul material
E. In addition to the regulations adopted and charges imposed by subsections C
and D of this section, further charges are imposed in the following types of service
1 A charge of two dollars and fifteen cents, in addition to the surcharge for
collecting refuse and yard material, shall be made for each extra container, bag, box or
bundle of tree or shrub trimmings collected from any particular residential premises.
2. For a special garbage pickup, actual cost shall be charged to the customer
Actual cost shall include the city's actual cost for labor, equipment rental, and landfill
fees. The minimum charge for this service shall be twenty -five dollars. (Ord. 2007 -63

amended to read as follows
7 50.040 Utility services fees.
For purposes of this section, business hours are considered to be eight a.m. to six
p m. Monday through Friday, excluding holidays The following fees and charges shall
apply when the listed actions are taken/provided by the utility services division. The fees
set forth in the following table shall be considered the base for calculations of future fee
increases. Once every two years beginning in March, 2008 (or as soon thereafter as
reasonably possible based upon availability of the indices set forth herein), an
adjustment shall be added to the base figures that is either eighty percent of the
December change in the United States Consumer Price Index for Wage Earners and
Clerical Workers (CPI W) for the Seattle, Tacoma, Bremerton region or eighty percent
of the December Implicit Pnce Deflator for Personal Consumer Expenditures, whichever
is lower and rounded to the nearest whole dollar, to reflect the changes in inflation for
these two indices over the previous two calendar years. (For purposes of determining
the change in the CPI, the standard reference base period of 1984 equals one hundred
will be used.)

Section 4 Section 7 50 090 of the City of Yakima Municipal Code is hereby
amended to read as follows -
7.50.090 Irrigation accounts.
A. All accounts of property receiving irrigation charges shall be identified in the
records of the utility services division by the house and /or street number and under the
account number assigned thereto, as well as by the name and address of the owner or
of the customer All bills and notices related to irrigation that are sent out by the utility
services division shall be sent to the house and street number of the owner of said
property Any changes in ownership and/or errors in the billing/mailing address shall be
promptly reported to the utility services division by the property owner and/or their
agent.
B Effective January 1, 1998, a bill for each customer shall be generated every two
months for irrigation system rates and charges incurred during the preceding two -month
period. For purposes of this bimonthly billing, the annual rates and charges set forth in
YMC 7.24.100 shall be divided into six equal amounts. If an account is open for less
than an entire billing cycle. it shall be billed at the daily rate. The daily rate is calculated
by dividing the annual rates and charges set forth in YMC 7.24.100 by 365. The bill shall
be rendered as part of the bill for other utility services rendered by the city, including
domestic water, wastewater, and refuse collection. All payments for irrigation system
rates and charges shall be due and payable to the office of the treasurer on or before
the fourteenth day after the bill therefore is rendered.
C All domestic water service and/or irrigation water service may be suspended to
any premises for which the irrigation water service charge remains unpaid for a period
of twenty -one days after the due date stated on the billing statement; provided, that no
domestic water service or irrigation water service shall be suspended until a written
notice has been served upon or mailed to the customer, at least seven days pnor to
suspending service. Such notice shall state the date on which domestic water service
and/or irrigation water service is to be suspended, the amount of delinquent charges,
and that a customer may request, in writing, a hearing before the utility services
manager, or his /her designee, to contest the suspension; provided, that such request is
received by the customer service manager or his or her designee before the suspension
date stated in the notice of suspension.
D Upon timely receipt of a request for a hearing as provided in subsection C of this
section, the utility services manager or his or her designee shall conduct a hearing, and
the customer requesting the hearing shall be notified in writing by the utility services
manager, or his/her designee, of the date, time and place of such hearing. Pending the
outcome of such heanng, no domestic water service or imgation water service to the
customer's premises shall be suspended.
E. In the event of a delinquency in the payment of charges for irrigation water
service to any premises or property, the city may exercise its remedies as described in
YMC 7.50.080(E), pursuant to RCW 35 21 290 and 35.21 300, against such premises
by discontinuing domestic water service and /or irrigation water service thereto If
domestic water service and /or irrigation water service is suspended as a result of a
delinquent utility service account in accord with subsection C of this section, such
service shall not be reinstated until all delinquencies and unpaid charges against such
premises for irrigation water service have been paid. (Ord. 2006 -07 § 17, 2006)
Section 5 A new section 7 50 150 is added to the City of Yakima Municipal
Code as follows
7.50.1 50 Budget Ming.
City of Yakima may offer residential utility customers the option of a budget payment
plan. The budget payment plan shall be set forth in a program policy and guidelines
document, as adopted or amended from time to time, of the Utility Services Manager,
subject to approval y the Finance Director.
Section 6 Section 7 60 020 of the City of Yakima Municipal Code is hereby
amended to read as follows -
7.60.020 Owner (inside city) retail wastewater service charge.
A. Wastewater Service Charge There shall be charged to and collected from all
premises within the city served by the city wastewater system a wastewater service
charge composed of a ready -to -serve charge and a volume charge based on either the
quantity of water supplied to the premises or, if metered, the quantity of wastewater
discharged into the wastewater sewer system; provided, that in no event shall the total

7.60.100 Additional collection method—Water service suspension— Notice and
hearing procedure.
A. As an additional and concurrent method of collection of any such delinquent
wastewater rate or charge, the Utilitv Services manager may suspend
the water service or supply from the premises to which such charge for wastewater has
attached until such rates and charges are paid.
B No water service shall be suspended until a written notice has been served upon
or mailed to the customer at least seven days prior to suspending service Such notice
shall state the date on which service is to be suspended, the amount of delinquent
wastewater charges, and that a customer may request in writing a hearing before the
customer service manager or his designee to contest the suspension, provided such
request is received by the customer service manager or his designee before the date
service is to be suspended.
C Upon timely receipt of a request for hearing, the customer service manager or
his designee shall conduct a hearing, and the customer requesting the hearing shall be
notified in writing by the customer service manager or his designee of the time, date and
place of such heanng. Pending the outcome of a hearing, no service shall be
suspended.
D When water service has been suspended for nonpayment of a wastewater
charge, water service shall not be resumed until all delinquent service charges have
been paid, together with an additional fifteen - dollar reconnection charge
E. In the event the occupant of a premises is someone other than the customer, the
occupant or, in the case of a multiple dwelling, the manager or person in charge shall be
notified in writing of the date of the suspension of service and the amount of
delinquency at the same time such customer is so notified (Ord. 2007 -65 § 13, 2007
Ord. 2003 -75 § 13, 2003)
Section 9 Section 7 60 105 of the City of Yakima Municipal Code is hereby
amended to read as follows:
7.60.105 Rates, charges and fees for pretreatment program.
A. It is the purpose of this section to provide for the payment of rates, charges and
fees for certain discharges to the wastewater system, to compensate the city for the
cost of administration of the pretreatment program established in Chapter 7 65
Connection charges for dischargers subject to Chapter 7 65 are as set forth in Chapter
7 68 of this code
B Rates, Charges and Fees to Be Published. The wastewater manager shall
maintain a schedule of current rates, charges and fees, shall post such schedule
conspicuously, and shall make copies available to interested persons. Upon request,
the wastewater manager shall prepare an estimate of annual fees for a significant
industrial user
C Significant Industrial Users (Sills) Commencing on the effective date of the
ordinance codified in this section, SIU permit fees amounts shall be set at ninety
percent of that amount identified in the Industrial Facility Categories of WAC 173-224-
040 The permit fee shall cover the costs of administering the SIU wastewater discharge
permit program including inspections, technical assistance, education, and compliance
administration. Costs associated with any sampling and testing shall be in addition to
the permit fee This annual fee is based on the state's fiscal year (July 1st —June 30th)
D Base Fee for Minor Industrial Users (MIUs). Commencing on the effective date of
the ordinance codified in this section and until amended pursuant to subsection F of this
section, minor industrial users (as defined in Chapter 7 65) shall pay a base fee for
pretreatment service

water for all meter sizes shall be the daily Ready -to -Serve charge multiplied by the
number of days the service was connected plus the charge for three (3) UOC at the rate
above.
When water service is connected for more than 30 days - The minimum charge for
domestic water for all meter sizes shall be the daily Ready -to -Serve charge multiplied
by the number of days the service was connected plus the charge for six (6) UOC at the
rate above.
D. The daily Ready -to -Serve charge is calculated by dividing the Two -Month Period
Ready -to -Serve charge by 60 days.
E. All charges for water supplied outside the city shall be computed by multiplying the
applicable rates set forth in paragraphs A through D of this section by one and one -half
F Home Kidney Dialysis. A residential customer who undergoes kidney dialysis at his
or her home, or whose home is also the home of a different person who undergoes
home kidney dialysis, shall not be required to pay utility charges for domestic water
service or sewer service for the quantity of water that is necessary for the home dialysis.
In order to be excused from utility charges under this subsection, the residential
customer must present to the director of finance and budget or their designee written
documentation annually from a recognized kidney dialysis center certifying that the
person requires dialysis and the quantity of water needed for that person's dialysis."
Section 11 Section 7 68.282 of the City of Yakima Municipal Code is hereby
amended to read as follows:
7 68.282 Fire service charges.

D The inside diameter of the pipe leading to a fire hydrant shall determine the service

consumer's property is annexed to the city "
Section 12. The changes made to the Yakima Municipal Code through
Council's adoption of this Ordinance shall be in full force and effect when the Utility
Customer Service System currently under development goes into production

SUMMARY EXPLANATION In mid 2008, the City of Yakima contracted with Paladin Systems for the
purchase of their permitting and licensing systems and for the development of a new Utility Customer
Service System (UCSS) The permitting system was placed into operation in December, 2008, the licensing
module went live in April of this year, and a beta version of the Utility Management System was recently
delivered to the City for preliminary testing. The new Utility Customer Service System (UCSS) has a
number of new features that will allow the City to enhance customer service and improve the accuracy of
® our processes These features include prorated billing, budget payment option, notification to owners of
delinquent bills in a tenants name, and many others.
There are a number of features in the new Utility Customer Service System (UCSS) that are not available in
our current Utility systems, and, thus, have never been incorporated into the City's Municipal Code. The
proposed ordinance changes will update the policies and practices included in the YMC and thereby allow
the City to utilize the new features that have been designed into the new UCSS once it has been fully
implemented. Implementation of the new Utility System is targeted for late 2009 or early 2010, depending
on results of system tests currently in progress. Additionally, staff has taken this opportunity to make a
couple of housekeeping changes to the existing Ordinance For ease of comparison, a "redlined" version of
the Yakima Municipal Code, which identifies both the existing and proposed language, is attached.
