ORDINANCE NO 2009 -35
AN ORDINANCE relating to Public Safety; adopting Section 9 50.280 of the City of Yakima
Municipal Code, entitled "Avoidance of Intersection, Penalty," which
describes the offense, describes an infraction penalty amount, and
provides for exceptions to such offense
BE IT ORDAINED BY THE CITY OF YAKIMA.
Section 1 Section 9.50.280 of the City of Yakima Municipal Code is hereby enacted
as a new section to read as follows:
SECTION 9.50.280
AVOIDANCE OF INTERSECTIONS, PENALTY
Section 9.50.280 - Avoidance of Intersections, Penalty
A. It is unlawful for any person operating a motor vehicle on the roads within the City of
Yakima to turn such vehicle either to the right or to the left upon approaching or leaving
intersections and to proceed across any private property for the purpose of avoiding the
intersection or any traffic control device controlling the intersection, unless so directed by
lawful authority
B. A violation of this section shall be a traffic infraction punishable by a monetary penalty of
one hundred twenty -four ($124)
Section 2. This ordinance shall be in full force and effect 30 days after its
passage, approval, and publication as provided by law and by the City Charter

SUMMARY EXPLANATION The proposed section prohibits the practice of driving through a
parking lot in order to avoid a controlled intersection. No such section or city code currently
prohibits such practice. Traffic Sergeant Gary Jones has received numerous complaints from
local businesses and property owners regarding this matter The proposed section makes it
unlawful for a person, upon approaching an intersection, to tum their vehicle into private property
for the purpose of avoiding a controlled intersection. The penalty for violating this section shall
beafineof$124

BOARD /COMMISSION RECOMMENDATION The Yakima City Council Public Safety
Committee is forwarding the attached ordinance to the full council for consideration. The
committee was unanimously in favor of the proposed ordinance.
