HomeMy WebLinkAbout2009-024 Fees and Building Valuation; YMC Amendment 11.04.030 ORDINANCE NO 2009 -24 AN ORDINANCE amending Yakima Municipal Code Sections 11 04 030 "Schedule of Fees and Building Valuation - Table 1 WHEREAS, Ordinance 2005 -06 was approved by City Council on February 15, 2005 providing for an annual adjustment of the Schedule of Fees and Building Valuation based on the Seattle CPI -W; and WHEREAS, the annual adjustment was approved for Table 1 "Schedule of Fees" and Table 3 "Building Valuation Table "; and WHEREAS, the affect of increasing both tables annually increases the total permit fee in excess of the intended increase of the Seattle CPI -W; now therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF YAKIMA. The City approves the recommendation from staff to delete the following language from Table 1 "Schedule of Fees ", "Beginning January 1, 2006, and on January 1 of each subsequent year, the fees in this table shall be adjusted automatically to account for any increase in the Consumer Price Index (CPI) for the Seattle area (Seattle CPI -W)" Section 3. WHEREAS, RCW Chapter 19.27 establishes the State Building Code Council and mandates that the State Building Code Council adopt and maintain certain codes including a building code, which, pursuant to RCW Chapter 19.27, are known as the State Building • Code, and WHEREAS, pursuant to RCW Chapter 19.27 and WAC 51 -50 -003, the State Building Code Council has, with certain additions, deletions, and exceptions, adopted by reference, as part of the State Building Code, the 2003 edition of the International Building Code as published by the International Code Council, Inc., and WHEREAS, pursuant to RCW 19.27 031, subject to certain additions, deletions and exceptions provided in WAC Chapter 51 -50, the 2003 edition of the International Building Code as published by the International Code Council shall be in effect as of July 1, 2004, in the City of Yakima and supercedes earlier provisions of Chapter 11 04 of the Yakima Municipal Code that were based upon the 1997 edition of the Uniform Building Code; and WHEREAS, pursuant to RCW 19.27 040, the City of Yakima is authorized to amend certain provisions of the State Building Code so long as the minimum performance standards of the State Building Code and the objectives of RCW 19.27.020 are not diminished, and • 1 WHEREAS, it is in the best interest of the City of Yakima to adopt the International Building Code as adopted and maintained by the State Building Code Council with certain additions, deletions and exceptions, now therefore, BE IT ORDAINED BY THE CITY OF YAKIMA, WASHINGTON Section 1. Sections 1104.104 -1, 11 04.104.2.8, 11.04.105.1, 11.04.105.2, 11 04.107.2, 11.04.107.2.1, 11 04.109.6, 11 04.109.7, 11.04.904.2.1, 11.04.1607 4.4, 11.04.1614, 11.04.1640, 11.04.1806.1, 11 04.3303 9, 11 04.3304, 11.04.3306.2, 11.04.3307, 11.04.3310.2, and 11 04.3310.3 of Chapter 11.04 of the Yakima Municipal Code are hereby repealed. Section 2. Section 11 04.010 of the City of Yakima Municipal Code is hereby amended to read as follows: "11.04.010 City of Yakima Building Code. Pursuant to chapter 19.27 RCW, the 1997 Edition of the Uniform therete except Appendices Chapter Three, Division III and IV, Chapters Nine, Tex, Eleven, Thirteen, Twenty one, Twenty three, and Thirty one, and building code council in Chapter 51 10 WAC (hereinafter "state building exceptions provided in this chapter, shall be tThe building code of the city of Yakima shall be comprised of the following as modified by the amendments, additions, deletions, and exceptions provided in this chapter: a. The 2003 edition of the International Building Code, including Sections 101 through 106 of Appendix E (Supplementary Accessibility Requirements), as published by the International Code Council, Inc., and as adopted and maintained by the State Building Code Council in Chapter 51 -50 WAC. b. Appendix F (Rodent Proofing), Appendix G (Flood- Resistant Construction), Appendix I (Patio Covers), and Appendix T (Grading) to the 2 2003 edition of the International Building Code and as published by the International Code Council, Inc. The above referenced texts that comprise the state building code Cede Standards, and Chapter 51 10 WAC, are incorporated in this chapter by reference, and the several sections or numbers of those texts shall constitute, and may be referred to as, the numbers of this chapter One or more copies of the texts that comprise building code of the city of Yakima shall be maintained on file in the office of the code administration and planning manager of the city of Yakima." Section 3 Section 11.04.020 is hereby enacted as a new section to Chapter 11.04 of the City of Yakima Municipal Code to read as follows: "11.04.020 Creation of Enforcement Agency and Identification of Building Official. • The division of code administration and planning in the department of community and economic development is hereby established as the code enforcement agency of the city of Yakima. The division of code administration and planning shall be under the administrative and operational control of the code administration and planning manager designated by the appointing authority Wherever the term 'building official' is used in this code, it shall be construed to mean the code administration and planning manager " Section 4. Section 11 04.030 is hereby enacted as a new section to Chapter 11 04 of the City of Yakima Municipal Code to read as follows: "11.04.030 Schedule of Fees and Building Valuation. The permit fees required under this chapter shall be in accordance with the following: Schedule of Fees —Table 1 and Schedule of Fees —Table 2 —Other Fees. III 7 Section 5 Section 11.04.040 is hereby enacted as a new section to Chapter 11.04 of the City of Yakima Municipal Code to read as follows: "11.04.040 Refund of Plan Review Fees upon Permit Application Withdrawal. In the event that a permit application is withdrawn by the applicant before any plan review is commenced by the building official or his /her designee, the applicant may submit a written refund application to the building official within thirty (30) calendar days thereof. The building official shall then authorize a refund of eighty percent (80 %) of the paid plan review fee." Section 6. Section 11.04.050 is hereby enacted as a new section to Chapter 11.04 of the City of Yakima Municipal Code to read as follows: "11.04.050 Design Professional to Prepare or Oversee Preparation of Construction Documents. A design professional, licensed under the provisions of RCW Chapter 18.08, RCW Chapter 18.43, and corresponding WAC regulations as now exist or are hereafter 411 amended, is required to prepare or oversee the preparation of construction documents for the construction, erection, enlargement, alteration, and /or repairs of any building or structure that contains or shall contain five (5) or more residential dwelling units or for any commercial building or structure that is or shall be over four thousand (4000) square feet in size." Section 7 Section 11 04.110.5 is hereby enacted as a new section to Chapter 11.04 of the Yakima Municipal Code to read as follows. "11.04.110.5 Addition to Section 110. Subsection 110.5 is added as a new subsection to Section 110 of the 2003 edition of the International Building Code as adopted and maintained by the State Building Code Council to read as follows: 110.5 Public nuisance. It is a public nuisance to use or occupy a building or structure, or any part thereof, without having been issued a valid certificate of occupancy for such building, structure or part thereof by the building official as provided herein. Such public • 8 • nuisance shall be subject to prevention or abatement by injunction or other appropriate legal remedy in the Superior Court of Washington in Yakima County " Section 8 Section 11.04.112 is hereby enacted as a new section to Chapter 11.04 of the Yakima Municipal Code to read as follows: "11.04.112 Amendment to Section 112. Section 112 of the 2003 edition of the International Building Code as adopted and maintained by the State Building Code Council is amended to read as follows. Section 112 Board of Appeals 112.1 General. In order to hear and decide appeals of orders, decisions or determinations made by the building official relative to the application and interpretation of this code, there shall be and is hereby created a board of appeals. The board of appeals shall be appointed by the ge-veming bod Yakima City Council and shall hold office at its pleasure for a term of three years. The board shall adopt rules of procedure for conducting its business, and shall render all decisions and findings in writing to the appellant with a duplicate copy to the building official. 112.2 Limitations on authority The board of appeals shall hear and decide appeals of orders, decisions or determinations made by the building: official relative to the application and interpretation of this code. An application for appeal shall be based on a claim that the true intent of this code or the rules legally adopted thereunder have been incorrectly interpreted, the provisions of this code do not apply or an equally good or- better form of construction is proposed. The board of appeals shall have no authority relative to interpretation of the administrative provisions of this code nor to waive requirements of this code. • 9 112.3 alifications. The board of a shall • ¢u appeals haII cons>ast of seven members who are qualified by experience and training to pass on matters pertaining to building construction and are not employees of the jurisdiction, and who shall be appointed from the following areas: one architect; one engineer; one building and construction contractor; one developer; one representative from the general public, one Washington state journeyman plumber; and one Washington state journeyman mechanical contractor. The building official and /or the Fire Chief or a designee shall be an ex officio member of and shall act as secretary to said board but shall have no vote on any matter before the board." Section 9 Section 11 04.202 is hereby enacted as a new section to Chapter 11.04 of the Yakima Municipal Code to read as follows. "11.04.202 Amendment to Section 202. The definition of owner provided in Section 202 of 2003 edition of the International Building Code as adopted and maintained by the State Building Code Council is amended to read as follows: OWNER. Any person, agent, firm, partnership, association or corporation having a legal or equitable interest in the property " Section 10. Section 11 04.903.2 is hereby enacted as a new section to Chapter 11.04 of the Yakima Municipal Code to read as follows: "11.04.903.2 Amendment to Section 903.2. An additional automatic sprinkler system exception is added to Section 903.2 of the international Building Code as adopted and maintained by the State Building Code Council and shall read as follows: Additional exception. Automatic sprinkler systems shall not be required for controlled atmosphere storage rooms in which refrigeration apparatus is installed to control the temperature in the storage rooms and gas -tight seals are incorporated in the construction of the rooms. In addition, gas tight seals must be used to facilitate the 110 10 maintenance of an atmosphere within the storage rooms that is lower in oxygen content and higher in nitrogen and carbon dioxide content than normal atmosphere." Section 11 Section 11.04.1605 6 is hereby enacted as a new section to Chapter 11.04 of the Yakima Municipal Code to read as follows: "Section 11.04.1605 6 Addition of Table 1605.6. Subsection 11.04.1605.6 is added as a new subsection. to Section. 1605 (Load Combinations) of the 2003 edition of the International Building Code as adopted and maintained by the. State Building Code Council to read as follows: 1605.6 Climatic and Geographic Design Criteria The climatic and geographic design criteria table provided in YMC 11.22.R301.2(1) are applicable to and incorporated into this chapter as Table 1605.6. In the event that these design criteria conflict with • design criteria provided elsewhere in YMC Chapter 11 04 or Chapter 16 of the 2003 edition of the International Building Code, these design criteria shall control unless the building official determines otherwise for a specific structure with special local conditions. Weathering may require a higher strength concrete or grade of masonry than necessary to satisfy the structural requirements of this code. The weathering column shall be filled in with the weathering index (i.e., negligible," "moderate or "severe ") for concrete as determined from the Weathering Probability Map [Figure R301.2(3)1. The grade of masonry units shall be determined from ASTM C 34, C 55, C 62, C 73, C 90, C 129, C 145, C 216 or C 652. b. The frost line depth may require deeper footings than indicated in Figure R403.1(1). The jurisdiction shall fill in the frost line depth column with the rnini*num depth of footing below finish grade. c. The jurisdiction shall fill in this part of the table with "very heavy," "moderate to heavy," "slight to moderate," or "none to slight" in accordance with Figure R301.2(6) depending on whether there has been a history of local damage. d. The jurisdiction shall fill in this part of the table with moderate to severe," "slight to moderate," or none to slight" in accordance with Figure R301.2(7) depending on whether there has been a history of local damage. e. The jurisdiction shall fill in this part of the table with the wind speed from the basic wind speed map [Figure R301.2(4)1. Wind exposure category shall be determined on a site - specific basis in accordance with Section R301.2.1.4. f. The outdoor design dry-bulb temperature shall be selected from the columns of 971/2-percent values for winter from Appendix D of the international Plumbing Code. Deviations from_ the Appendix D temperatures shall be permitted to reflect local climates or local weather experience as determined by the building official. g. The jurisdiction shall fill in this part of the table with the Seismic Design Category determined from Section R301.2.2.1. 11 h. The jurisdiction shall fill in this art of the table with (a) the date of the jurisdictions en into the National P () J try N nal Flood Insurance 4110 Program (date of adoption of the first code or ordinance for management of flood hazard areas), (b) the date(s) of the currently effective FIRM and FBFM, or other flood hazard map adopted by the community, as may be amended. i. In accordance with Sections R905.2.7.1, R905.4.3, R905.5.3, R905.6.3, R905.7.3 and R905.8.3, for areas where the average daily temperature in January is 25 F (-4° C) or less, or where there has been a history of local damage from the effects of ice damming, th jurisdiction shall fill in this part of the table with "YES." Otherwise, the jurisdiction shall fill in this part of the table with "NO." j. Section 12. The terrain category and roof exposure condition chosen shall be representative of the anticipated conditions during the life of the structure. An exposure factor shall be determined for each roof of a structure. b. Definitions of roof exposure are as follows: 1. Fully exposed shall mean roofs exposed on all sides with no shelter afforded by terrain, higher structures or trees. Roofs that contain several large pieces of mechanical equipment, parapets which extend above the height of the balanced snow load, hb, or other obstructions are not in this category 2. Partially exposed shall include all roofs except those designated as "fully exposed" or "sheltered." 3. Sheltered roofs shall mean those roofs located tight in among conifers that qualify as "obstructions." c. Obstructions within a distance of 10 hb provide "shelter," where hb is the height of the obstruction above the roof level. If the only obstructions are a few deciduous trees that are leafless in winter, the "fully exposed" category shall be used except for terrain category "A." Note that these are heights above the roof. Heights used to establish the terrain category in Section 1609 4 are heights above the ground. d. The building official may determine this coefficient for specific structures with special local conditions. Section 13. Section 11 04.1801.3 is hereby enacted as a new section to Chapter 11 04 of the Yakima Municipal Code to read as follows: 12 "11.04.1801.3 Addition to Section 1801. Subsection 11.04.1801.3 is added as a new subsection to Section 1801 of the 2003 edition of the International Building Code as adopted and maintained by the State Building Code Council to read as follows: 1801.3 Definitions. The following words and terms shall, for the purposes of this section, have the meanings shown herein. Undisturbed soil. Soil or soil profile, unaltered by removal or other man- induced changes, except for agricultural activities, that would adversely affect the in -situ or operation of on -lot systems. This soil material and the in -situ soil mass have not been disturbed. Soil. Any uncemented or weakly cemented accumulation of material particles formed by the weathering of rocks, the void space between particles containing•water and /or air • In -situ. Soil in the natural or original position. Soil compaction. The process of increasing the density of a soil by packing the particles doser together with a reduction in the volume of air The higher the degree of compaction, the higher will be the shear strength and lower will be the compressibility of the soil." Section 14. Section 11.04.3303.1 is hereby enacted as a new section to Chapter 11 04 of the Yakima Municipal Code to read as follows: "11.04.3303.1 Amendment to Section 3303.1. Section 3303.1 of the 2003 edition of the International Building Code as adopted and maintained by the State Building Code Council is amended to read as follows: 3303.1 Construction documents. Construction documents and a schedule for demolition must be submitted when required by the building official. Where such information is required, no work shall be done until such construction documents or schedule, or both, are • 13 approved. ppr ed. A site assessment checklist shall be completed and returned to the building inspector upon the final inspection." Section 15. Section 11 04.3303.4 is hereby enacted as a new section to Chapter 11 04 of the Yakima Municipal Code to read as follows: "11.04.3303 4 Amendment to Section 3303.4. Section 3303 4 of the 2003 edition of the International Building Code as adopted and maintained by the State Building Code Council is amended to read as follows: 3303.4 Vacant lot. Where a structure has been demolished or removed, the vacant lot shall be filled and maintained to the existing grade or in accordance with the ordinances of the jurisdiction having authority The vacant lot shall be cleaned of material, including without limitation petroleum tanks, septic tanks, septic drain fields, utilities, pipes, wires and conduit, unless in the right-of-way or easement, from the subterranean surface. Basement walls, footings, foundations may be required to be broken into pieces less than twenty -four (24) inches (610 mm) in size. Any excavation shall be filled with clean fill material, covered with vegetation to prevent erosion as approved by the building official within 90 days after completion unless extended by the building official for reasonable cause." Section 16. Section 11.04.3303 7 is hereby enacted as a new section to Chapter 11 04 of the Yakima Municipal Code to read as follows: "11.04.3303.7 Addition to Section 3303. Section 3303 7 is added as a new subsection to Section 3303 of the 2003 edition of the International Building Code as adopted and maintained by the State Building Code Council is amended to read as follows: 3303.7 Yakima Regional Clean Air Authority approval required. No work shall commence until the Yakima Regional Clean Air 14 • Authority has assessed the proposed demolition work and granted approval to commence." Section 17 Section 11. 04.I104.1 is hereby enacted as a new section to Chapter 11 04 of the Yakima Municipal Code to read as follows: "11.04.I104.1 Amendment to Subsection I104.1. Section I104.1 of Appendix I (Patio Covers) to the 2003 edition of the International Building Code as adopted and maintained by the State Building Code Council is amended to read as follows: I104.1 Design loads. Patio covers shall be designed and constructed to sustain, within the stress limits of this code, all dead loads plus a minimum vertical live load of 1815 pounds per square foot (0 48 kN /m except that snow loads shall be used where such snow loads exceed this minimum. Such patio covers shall be designed to resist the minimum wind and seismic loads • set forth in this code." Section 18. Section 11 04.J103.2 is hereby enacted as a new section to Chapter 11.04 of the Yakima Municipal Code to read as follows: "11.04.J103.2 Amendment to Section J103.2 Section J103.2 of Appendix J (Grading) to the 2003 edition of the International Building Code as adopted and maintained by the State Building Code Council is amended to read as follows: J103.2 Exemptions. A grading permit shall not be required for the following: 1 Grading in an isolated, self - contained area, provided there is no danger to the public, and that such grading will not adversely affect adjoining properties. 2. Excavation for construction of a structure permitted under this code. 3 Cemetery graves. 4. Refuse disposal sites controlled by other regulations. 110 5 Excavations for wP11s, or trenches for utilities. 15 6. This phrase was added to assure that the "exploratory excavation" is not to begin construction of a building prior to receiving a permit for the sole purpose of preparing a soils report. 8 An excavation that (1) is less than 3 feet (915 mm) in depth or (2) does not create a cut slope greater than 6 feet (1829 mm) in height and steeper than 1 unit vertical in 1 units horizontal (66.7% slope). 9. A fill less than 2 feet (610 mm) in depth and placed on natural terrain with a slope flatter than 1 unit vertical in 5 units horizontal (20% slope), or less than 4 feet (1219 mm) in depth, not intended to support structures, that does not exceed 100 cubic yards (76.6 m on any one lot and does not obstruct a drainage course. 10. Test holes done under the provisions of an on -site sewage disposal permit application. 11. Grading, including roads, bridges and municipal construction, which is designed to WSDOT, APWA or FHWA standards and specification where such grading is subject to review and approval of a local government agency or a state or federal agency. 12. Section 19 Section 11 04.J104 is hereby enacted as a new section to Chapter 11 04 of the Yakima Municipal Code to read as follows: "11.04.1104 Addition to Section J104. Subsections J104.5 and J104.6 are added as a new subsections to Section J104 of Appendix J (Grading) to the 2003 edition of the International Building Code as adopted and maintained by the State Building Code Council to read as follows: J104.5 Grading plan review fees. A grading plan review fee shall • be paid to the building official or his /her designee in accordance with Table J104.5 at the time the plan is submitted for review Separate plan review fees shall apply to retaining walls or major drainage structures as required elsewhere in the Yakima Municipal Code. Section 20 If any section, subsection, paragraph, sentence, clause or phrase of this ordinance, or any provision of the Yakima Municipal Code established by this ordinance, is declared invalid or unconstitutional for any reason, such decision shall not affect the validity of the remaining portions of this ordinance, or other provisions of the Yakima Municipal Code established by this ordinance. 18 Section 21.
