HomeMy WebLinkAbout2009-028 Slaughtering, Dressing and Butchering of Animals and Fowl, Discharging Firearms; YMC Amendment ORDINANCE NO 2009 -28 AN ORDINANCE relating to public safety and morals, relating to slaughtering, dressing and butchering of animals and fowl, relating to discharging firearms, amending YMC 6 44 020(A), amending YMC 6.20 044, and adding YMC 6.20 045 BE IT ORDAINED BY THE CITY OF YAKIMA. Section 1 Section 6 44 020(A) of the City of Yakima Municipal Code is hereby amended to read as follows 6.44.020 Firearms — Discharging. A. Any person who, within the city of Yakima, willfully fires or discharges any air gun, b b gun or firearm of any kind without lawful authority is declared to be a disorderly person This section shall not apply to peace officers nor to persons shooting on any regularly established and authorized rifle range, gun club or shooting gallery, or when the conditions of YMC 6.20 045 are met. Section 2. Section 6.20.044 of the City of Yakima Municipal Code is hereby amended to read as follows 6.20.044 Slaughtering, dressing and butchering of animals and fowl. No person shall slaughter, dress or butcher any fowl or animal so as to unreasonably expose such act or acts to the view of any person on public or private property This section does not apply when the conditions of YMC 6.20 045 are met. Section 3. Section 6.20 045 of the City of Yakima Municipal Code is hereby added to read as follows. 6.20.045 Animal husbandry as nonconforming use. (1) When an animal husbandry operation is approved as a nonconforming use pursuant to title 15 of the Yakima Municipal Code, the slaughter of animals may continue when the following conditions are met: (A) The slaughter of the animal is performed by a licensed professional butcher; and (B) If the slaughtering of the animal involves the discharge of a firearm, notice shall be provided to the Yakima police department at least two hours prior to the discharge of the firearm. The notice shall be made by phone to the Yakima police department nonemergency number and shall include the location of the discharge, the approximate time of the discharge, and the name of the professional butcher who will be discharging the firearm. (2) This section is meant to be an exception to YMC 6.20 044, which prohibits the slaughtering of animals within public or private property view, and YMC 6 44 020, which prohibits the discharge of a firearm within the City of Yakima. Section 4.
