Central Avenue, Yakima, Washington from Two - Family Residential (R -2) to General Commercial (GC) as more fully described herein; and approving the recommendation of the Hearing Examiner regarding the same, Terry Morton being identified as the applicant herein WHEREAS, by application dated December 1, 2008, Terry Morton requested that the City of Yakima rezone Yakima County Assessor's Parcel No 191330 - 14460, located at 904 E. Central Avenue, Yakima, Washington (hereinafter "Subject Property "), from Two - Family Residential (R -2) to General Commercial (GC), and WHEREAS, on January 22, 2009, the Hearing Examiner for the City of Yakima conducted an open - record public hearing regarding the requested rezone, and WHEREAS, on February 5, 2009, the Hearing Examiner issued Hearing Examiner's Recommendation (the "Recommendation ") regarding RZ #7 -08 recommending that the Subject Property be rezoned from Two - Family Residential (R -2) to General Commercial (GC), and WHEREAS, at a closed - record public hearing held on April 7, 2009, the City Council considered the requested rezone, including the documents and other evidence which comprise the record developed before the Hearing Examiner, the Hearing Examiner's Recommendation, and the statements and comments of interested persons; and WHEREAS, the City Council finds that the considerations of the Hearing Examiner in response to the requirements and criteria of Yakima Municipal Code ( "YMC") § 15.23 030(E) and § 1515 040(5) are correct and appropriate, and that the same should be adopted by the City Council as its findings herein, and WHEREAS, the City Council finds that it is in the best interest of the City to enact the following to approve the requested rezone, Now Therefore Be It Ordained By The City Of Yakima, City Council Section 1 The property located at 904 E. Section 3. The Official Yakima Urban Area Zoning Map and all other zoning, land use, and other similar maps maintained by the City of Yakima shall be amended or modified to reflect this rezone. If any section, subsection, paragraph, sentence, clause, or phrase of this ordinance is declared invalid or unconstitutional for any reason, such decision shall not affect the validity of the remaining portions of this ordinance Section 5. A final Determination of Nonsigmficance was issued on January 7, 2009 No appeal was filed during the SEPA appeal period which expired on January 21, 2009 Subsequent project specific development proposals will be subject to any additional environmental review required by the provisions of the Yakima Municipal Code and the Washington State Environmental Policy Act. VII. Transportation Capacity Management Ordinance. This proposal is an exempt activity under the Transportation Capacity Management Ordinance A future business or redevelopment of the site may require concurrency review if deemed necessary by the City Traffic Engineer VIII[ Development Services Team. A Development Services Team meeting was conducted on December 18. 2008, to discuss the technical aspects of this rezone request The following comments were received. (1) Codes. PLANNING DIV (2) Engineering Frontage improvements consist of curb and gutter already established. Water is supplied by the City of Yakima. Wastewater is available in Central Avenue All drainage will be retained on -site for this development. (3) Traffic Engineering The subject parcel is approximately 6,400 square feet in size and has about 50 feet of frontage on Central Avenue Only one driveway may be allowed due to the limited width of the lot. Central Avenue is a Local Access Street. If this rezone is approved, all commercial traffic from this lot will be limited to using Central Avenue The properties on the north side of Central Avenue are residential. The owner of the subject lot also is listed as the owner of the Towing Company adjacent to the east. If this lot were merged with the Towing Company, vehicle access could be combined and reduce possible conflicts with additional traffic of a free - standing use No specific plans or projects have been identified by the property owner in this application. Therefore, traffic impacts cannot be projected. Any new use may be subject to subsequent SEPA review or review under the Transportation Concurrency Ordmance (YMC 12 08) (4) Wastewater. There are adequate public wastewater facilities adjacent to this parcel (5) Water There is an existing looped 6 -inch waterline (1,600 gpm) m Central Avenue There is an existing 3 /4 -inch water service and meter to the site The site is located m the Low Level Pressure Zone Static pressure is approxumately 88 to 99psi The site is within the City of Yakima's General 308 Irrigation District There is one existing service to the site The site plan needs to clearly indicate the size and location of existing and proposed utilities The City can adequately serve the site with water as long as what is constructed does not exceed the available flow of 1,600 gpm. The nearest existing fire hydrant is located adjacent to the site All new fire hydrants and their locations, as well as the need for new fire spnnkler services, will be determined by Codes and the Fire Department. IX. Cur rent Zoning a Land Uses. Rezone Review Criteria. Recommendations regarding rezone applications within the Yakima Urban Area must be based upon the following cntena specified m Subsection 15 23 030(E) of the Urban Area Zoning Ordinance (UAZO) (1) The testimony at the public hearing: Assistant Planner Kevin Futrell and the applicant's representative Bill Hordan testified in favor of the requested rezone There was no testimony offered at the hearing in opposition to the requested rezone The testimony at the hearing all supported a positive recommendation regarding this rezone and no written comments were submitted m opposition to the requested rezone (2) The suitability of the property for uses permitted under the proposed zoning: The property is suitable for General Commercial uses because such uses predominate m this area south of East Central Avenue A parcel immediately south of the subject parcel that has a narrow flag area immediately west of the subject parcel is zoned Two - Family Residential. Other than that parcel, the property to the south, east and west of the parcel is zoned General Commercial Most of it is utilized for General Commercial uses The subject parcel is well suited for the range of commercial uses permitted within the GC zoning district which already exist west of Fair Avenue between East Nob Hill Boulevard and East Central Avenue The parcel is served by a paved street constructed to urban standards and can be served with domestic water, sanitary sewer, natural gas, telephone, electricity and other utilities required for commercial development. The requested rezone will also correct the inconsistency of the parcel's present Two - Family Residential zoning with the parcel's present General Commercial Comprehensive Plan designation. (3) Recommendations from interested agencies and departments: The only recommendation from interested agencies and departments is the recommendation of the City of Yakima's Planning Division to approve the requested rezone Tern Morton 5 Rezone from R -2 to GC 904 East Central Avenue RZ #7 -08 EC #61 -08 FEB 0 5 2009 Oily OF 1'AKllvifro PLANNING DIV (4) The extent to which the proposed rezone is in compliance with and /or deviates from the goals and policies as adopted in the Yakima Urban Area Comprehensive Plan and the intent of the Zoning Ordinance: (a) The Comprehensive Plan. This rezone request is m compliance with the goals and policies adopted in the Comprehensive Plan and the current zoning of the subject parcel is not in compliance with the Comprehensive Plan The Future Land Use Map 11I -3 designation for the applicant's parcel was changed to provide for commercial uses in 2001 as part of the normal Comprehensive Plan update The Yakima Urban Area Comprehensive Plan 2025 Future Land Use Map designates this parcel as General Commercial General Commercial allows a wide variety of commercial retail and service uses that are heavily dependent on convenient vehicle access along major travel routes General Commercial land uses may include those uses identified in Neighborhood Commercial or Community Commercial, but do not serve the adjacent neighborhoods only General Commercial includes uses such as fast food restaurants, auto - oriented services and other commercial services The City has designated these areas with the intent that each will be intensively developed within designated boundaries and that undesirable strip commercial development is avoided. (b�) The Zoning Ordinance. Subsection 15 03 020(K) of the Urban Area Zoning Ordinan ce states that the purpose of the General Commercial (GC) zoning distract is to accommodate wholesale and retail activities with some high - density residential development. The distract is pnmanly located near and along the major arterials as designated m the Yakima Urban Area Comprehensive Plan. Like the CBD distract, a variety of land uses are permitted. However, the intensity of development is intended to be less than in the CBD distract. Most commercial uses are listed in Table 4 -1 of Chapter 15 04 of the UiAZO as Class (1) permitted uses m the GC zoning distract Any new development on the subject parcel will have to comply with the development standards in the GC zoning distract. Those include structure setback standards m Table 5 -1 of Chapter 15 05, parking standards in Table 6 -1 of Chapter 15 06, srtescreening standards in Chapter 15 07, signage standards rn Chapter 15 08 and other applicable development standards ui the Urban Area Zoning Ordinance and other ordinances (5) The adequacy of public facilities such as roads, sewer, water and other required public services: The subject parcel is currently served by all necessary public facilities such as City street, sewer, water, garbage, transit, fire and police facilities and services The parcel is also served by natural gas, electricity and telephone services Tern Morton 6 Rezone from R -2 to GC 904 East Central Avenue RZ #7 -08 EC #61 -08 FEB 0 5 2009 CITY OF YAKIMiik PLANNING DIV Stormwater is currently retained on site and the adjacent street retains stormwater within the street grid. The proposed rezone is an exempt activity under the Transportation Capacity Management Ordinance, but future development of the site may require concurrency review if deemed necessary by the City Traffic Engineer The adequacy of the available public facilities will be determined when a specific use of the parcel is proposed. (6) The compatibility of the proposed zone change and associated uses with neighboring land uses. Although no specific new use is proposed for the parcel, General Commercial (GC) uses which would be allowed on the subject parcel by the proposed rezon would be compatible with neighboring commercial uses west of Fair Avenue between East Nob Hill Boulevard and East Central Avenue Properties to the east contain a towing business, an espresso stand and the Central Washington State Fair Park. Property to the south and west contam the Broadway Fire Station and its outdoor training facility A six - foot -high view- obscuring fence was erected by the Fire Department around its outdoor training facility A six- foot -high view obscuring fence was also erected for the towing yard owned by this applicant to the east of the subject parcel. The subject parcel is located between General Commercial uses on the east, west and south As surrounding properties were rezoned and developed, this house has become mcompatible with neighboring land uses to the east, west and south The existing single - family residence on the parcel would become a legal nonconforming use m the GC zoning district that would remain compatible with existing residential uses north of East Central Avenue The application indicates that the residential use of the parcel will likely be changed to a commercial use Development standards such as setback, off - street parking, sitescreening and other requirements would promote compatibility of a ny new commercial development with neighboring land uses (7) The public need for the proposed change: The application indicates that there is a need for GC -zoned property in this area for several reasons. Three properties to the east that were rezoned to allow for commercial uses about three years ago are now developed and being used. Prior to that, the last available properties m the area were the car wash and 'espresso stand located south of the subject parcel on East Nob Hill Boulevard. As GC property is becoming available, it is quickly developed. In addition, the staff report correctly points out that the requested rezone would fulfill the public need for a parcel's zoning classification to be consistent with its Comprehensive Plan designation Tern} Morton 7 Rezone from R -2 to GC 904 East Central Avenue RZ #7 -08, EC #61.1 -08 RECEIVED FEB 0 5 2009 CITY OF YAKiMR PLANNING DR/ XI. Consistenc of the Rezone with Bevelo went Re. ulations and with the Comprehensive Plan under the Criteria Required by Section 16.06.020 of the Yakima Municipal Code is determined by consideration of the following factors (1) The types of land uses permitted at the site by the City's Two - Family Residential (R -2) zoning distract are not consistent with the Comprehensive Plan's General Commercial designation for the subject parcel, but the uses permitted by the proposed General Commercial (GC) zoning distract would be consistent with the Comprehensive Plan's current General Commercial designation for the subject parcel. (2) The density of residential development or the level of development such as units per acre or other measures of density are not a factor weighing against this rezone request. Any future proposed use on the subject parcel would have to comply with applicable GC zoning ordinance provisions relating to the density of development. (3) The availability and adequacy of infrastructure and public facilities are present and support the applicant's request for approval of the rezone with the final determmation as to the adequacy of such public facilities to be made when a specific use is proposed for the subject parcel m the future (4) The characteristics of the development on the subject parcel will be consistent with applicable development regulations Since this is a nonproject rezone request, any new development will have to be consistent with the GC zoning provisions and applicable development regulations CONCLUSIONS Based on the above Findings, the Examiner reaches the following Conclusions (1) The Hearing Examiner has junsdiction under Subsections 15 23 030(C) and (E) of the UAZO to make a recommendation to the Yakima City Council regarding this rezone application. (2) The public notice requirements of Chapters 15 and 16 of the Yakima Municipal Code have been satisfied. A parcel immediately south of I the subject parcel that has a narrow flag area immediately west of the subject parcel is zoned Two - Family Residential. Other than that parcel, the property to the south, east and I west of the parcel is zoned General Commercial. Most of it is utilized for General Commercial uses. The subject parcel is well suited for the range of commercial uses permitted within the GC zoning district which already exist west of Fair Avenue between l East Nob Hill Boulevard and East Central Avenue. The parcel is served by a paved street constructed to urban standards and can be served with domestic water, sanitary sewer, natural gas, telephone, electricity and other utilities required for commercial 1 development. (4) The extent to which the proposed rezone is in compliance with and /or 1 deviates from the goals and policies as adopted in the Yakima Urban Area Comprehensive Plan and the intent of the Zoning Ordinance: 1 (a) The Comprehensive Plan: This rezone request is in compliance with the goals and policies adopted in the Comprehensive Plan and the current zoning of the subject parcel is not in compliance with the Comprehensive Plan. The Future Land Use Map III -3 designation for the applicant's parcel was changed to provide for commercial uses in 2001 as part of the normal Comprehensive Plan update. The Yakima Urban Area Comprehensive Plan 2025 Future Land Use Map designates this parcel as General Commercial. General Commercial allows a wide variety of commercial retail and service uses that are heavily dependent on convenient vehicle access along major travel routes. 1 General Commercial land uses may include those uses identified m Neighborhood Commercial or Community Commercial, but do not serve the adjacent neighborhoods only. General Commercial includes uses such as fast food restaurants, auto - oriented services and other commercial services. The City has designated these areas with the intent that each will be intensively developed within designated boundaries and that undesirable strip commercial development is avoided. (b) The Zoning Ordinance: Subsection 15.03.020(K) of the Urban Area Zoning Ordinance states that the purpose of the General Commercial (GC) zoning district is to accommodate wholesale and retail activities with some high- density residential development. The district is primarily located near and along the major arterials as designated in the Yakima Urban Area Comprehensive Plan. Like .the:--CBD district, a variety of land uses are permitted. However, the intensity of development is intended to be less than in the CBD district. Most commercial uses are listed m Table 4 -1 of Chapter 1 15.04 of the UAZO as Class (1) permitted uses in the GC zoning district. Any new development on the subject parcel will have to comply with the development standards in the GC zoning district. Those include structure setback standards in Table 5 -1 of Chapter 1 15.05, parking standards in Table 6 -1 of Chapter 15.06, sitescreening standards in Chapter 15.07, signage standards in Chapter 15.08 and other applicable development standards in the Urban Area Zoning Ordinance and other ordinances. (5) The adequacy of public facilities such as roads, sewer, water and other required public services: The subject parcel is currently served by all necessary public facilities such as City street, sewer, water, garbage, transit, fire and police facilities and services. The proposed rezone is an exempt activity under the Transportation Capacity Management Ordinance, but future development of the site may require concurrency review if deemed necessary by the City Traffic Engineer. The adequacy of the available public facilities will be determined when a specific use of the parcel is 1 proposed. (6) The compatibility of the proposed zone change and associated uses with 1 neighboring land uses: Although no specific new use is proposed for the parcel, General Commercial (GC) uses which . would be allowed on the subject parcel by the • proposed rezone would be compatible with neighboring commercial uses west of Fair Avenue between East Nob Hill Boulevard and East Central Avenue. Properties to the east contain a towing business, an espresso stand and the Central Washington State Fair Park. Property to the south and west contain the Broadway Fire Station and its outdoor training facility. A six - foot -high view- obscuring fence was erected by the Fire Department around its outdoor training facility. A six - foot -high view obscuring fence 1 was also erected for the towing yard owned by this applicant to the east of the subject parcel. The subject parcel is located between General Commercial uses on the east, west and south. As surrounding properties were rezoned and developed, this house has become incompatible with neighboring land uses to the east, west and south. The existing single - family residence on the parcel would become a legal nonconforming use in the GC zoning district that would remain compatible with existing residential uses north of East Central Avenue. The application indicates that the residential use of the parcel will likely be changed to a commercial use. Development standards such as setback, off -street parking, sitescreening and other requirements would promote compatibility of any new commercial development with neighboring land uses. (7) The public need for the proposed change: The application indicates that there is a need for GC -zoned property in this area for several reasons. Three properties to the east that were rezoned to allow for commercial uses about three years ago are now developed and being used. Prior to that, the last available properties in the area were the car wash and espresso stand located south of the subject parcel on East Nob Hill Boulevard. As GC property is becoming available, it is quickly developed. In addition, the staff report correctly points out that the requested rezone would fulfill the public need for a parcel's zoning classification to be consistent with its Comprehensive Plan designation. Consistency of the Rezone with Development Regulations and with the Comprehensive Plan under the Criteria Required by Section 16.06.020 of the Yakima Municipal Code is determined by consideration of the following factors: (1) The types of land uses permitted at the site by the City's Two - Family Residential (R -2) zoning district are not consistent with the Comprehensive Plan's General Commercial designation for the subject parcel, but the uses permitted by the I proposed General Commercial (GC) zoning district would be consistent with the Comprehensive Plan's current General Commercial designation for the subject parcel. (2) The density of residential development or the level of development such 1 as units per acre or other measures of density are not a factor weighing against this rezone request. Any future proposed use on the subject parcel would have to comply 1 with applicable GC zoning ordinance provisions relating to the density of development. (3) The availability and adequacy of infrastructure and public facilities are present and support the applicant's request for approval of the rezone with the fmal determination as to the adequacy of such public facilities to be made when a specific use is proposed for the subject parcel in the future. (4) The characteristics . of the development on the subject parcel will be consistent with applicable development regulations. Since this is a nonproject rezone request, any new development will have to be consistent with the GC zoning provisions and applicable development regulations. 1 CONCLUSIONS 1 Based on the above Findings, the Examiner reaches the following Conclusions: (1) The Hearing Examiner has jurisdiction under Subsections 15.23.030(C) and (E) of the UAZO to make a recommendation to the Yakima City Council regarding this rezone application. How is the rezone request in compliance with and /or deviate from the 1997 Yakima Urban Area Comprehensive Plan as amended? - 1 The rezone request is in compliance with the Yakima Urban Area Comprehensive Plan, as amended because the Future Land Use Map Designation for the property was changed in 2001 as part of a normal Comprehensive Plan Update (see UAZO CPA #3 -01). By rezoning the subject property to C®wnwarc4 this will bring the land use designation and zoning into compliance with the Yakima Urban Area Comprehensive Plan and Yakima Urban Area Zoning Ordinance as required by State Law (reference RCW 36.70A.040(3)(d)). 1 1 DOC. If not, what mitigating measures are going to be implemented to address any short falls in public services that may exist? 1 The subject property currently contains a single - family residence. It is connected to public water, sanitary sewer, natural gas, telephone and electricity. Thus, all urban services are currently located on or near the property. According to City Engineering, all urban services have been sized to accommodate future development. Storm water is currently retained on site.. The property is served by a hard surfaced local access street, which also retains storm water within the street grid. The property is also served with City police, fire and garbage service. 1 D. Is the proposed zone change and associated land use changes compatible with the existing neighboring uses? What mitigating measures are planned to address 1 incompatibility, such as site screening, buffering, building design, open space, traffic flow alteration, etc.? The ro osed zone change is com compatible with neighboring land uses because established uses are p p P g g commercial and industrial in nature. Properties to the east contain a towing business, espresso stand and the Central Washington State Park. Property to the south and west contain the Broadway Fire Station and its outdoor training facility. As the abutting property to the south and west are owned by the fire station, there is a 6 -foot high view obscuring fence that was erected by the fire department to separate the subject property residential use from the outdoor training facility which occurs at the fire station. Immediately to the east is a towing yard (owned by this property owner), it too, has a 6 -foot high view obscuring fence. In essence, the subject property is "squished" between ta(, uses on.the west, south and east sides. As surrounding properties were rezoned and developed, this last remaining house has become incompatible which neighboring land uses. This situation was anticipated through the Comprehensive Plan Amendment in 2001. The likely use of the single - family residence will now be changed from its current residential use to a commercial use. No mitigation is proposed as part of this rezone.
