AN ORDINANCE repealing the Volunteer Firefighters Relief and Pension Fund and
Volunteer Firefighters Pension Board; amending the title of Chapter
191, amending Sections 1 91 010, 1 91 020, 1 91 030, 1 91 060,
1 91 070, and 1 91 080; and repealing Section 1 91 050, all of the City of
Yakima Municipal Code
WHEREAS, in 2004 the City of Yakima became aware that its volunteer firefighters no
longer meet the definition under state law for individuals eligible to participate in volunteer
firefighters' relief and pension funds, and
WHEREAS, the City of Yakima Volunteer Firefighters Pension Board held its last
meeting on May 3, 2004, and thereafter disbanded, and
WHEREAS, the Yakima Municipal Code needs to be updated to repeal the Volunteer
Firefighters Relief and Pension Fund and the Board established to oversee it; now therefore,
BE IT ORDAINED BY THE CITY OF YAKIMA.
Section 1. The title of City of Yakima Municipal Code Chapter 1 91 is hereby
amended as follows
" e - - - _'RESERVE OFFICERS' RELIEF AND PENSION
FUND"
Section 2. Section 1 91 010 of the City of Yakima Municipal Code is hereby
amended as follows
"1.91.010 Creation of-volunteer-firefighters-Land and reserve officers' relief and
pension fund.
Pursuant to RCW Chapter 41.24, there is created a special fund to be designated
the v ol u nteer firefighters' and reserve officers' relief and pension fund, which shall be
made up of all monies budgeted for such purposes, all assessments made upon
members of the e - • - • - - • - - •• • • - • - • • eserve police department,
and bequests, fees, gifts, emoluments or donations given or paid into same "
Section 3. Section 1 91 020 of the City of Yakima Municipal Code is hereby
amended as follows:
"1 91 020 Deductions to be made from reimbursement of expenses.
The director of finance and budget shall, when making out warrants for the
reimbursement of vol firefighter and reserve officer expenses, deduct and
withhold from said warrants any and all fees and contributions required to be paid by
said s reserve officers pursuant to the Volunteer Firefighters' and
Reserve Officers' Relief and Pension Act, RCW Chapter 41.24 (and any amendments
thereto) All amounts so withheld shall be paid and credited to the v ol u nteer firefighters'
and reserve officers' relief and pension fund "
Section 4. Section 1 91 030 of the City of Yakima Municipal Code is hereby
amended as follows
"1 91 030 City contributions to fund.
The director of finance and budget shall pay into the volu firefighters' and
reserve officers' relief and pension fund all fees and contributions that the city is
required to make pursuant to statute, together with any other monies specifically
obligated by the city council for said purposes."
Section 5. Section 1 91 050 of the City of Yakima Municipal Code is hereby
repealed in its entirety
Section 6. Section 1 91 060 of the City of Yakima Municipal Code is hereby
amended as follows
"1 91 060 Board of trustees -- Meetings -- Rules.
€ashThe board of trustees shall meet on the call of its chair on a regular monthly
meeting day when there is business to come before it. €ashThe board of trustees shall
make all such rules and regulations as may be necessary to carry out the purpose for
which it is created, and shall in all respects proceed in accordance with and be
governed by the statute as enacted by the provisions of RCW Chapter 41.24 "
Section 7 Section 1 91 070 of the City of Yakima Municipal Code is hereby
amended as follows
"1.91 070 Enrollment under relief and compensation provisions.
All reserve officers shall be enrolled pursuant to-RGW
/11.2 , 1.020(1) (and any amendments-thereto)-and RCW 41.24 450 (and any
amendments thereto) under the relief and compensation provisions of the Volunteer
Firefighters' and Reserve Officers' Relief and Pension Act for the purpose of providing
protection for said firef,,, reserve officers and their families from death or disability
arising in the performance of their duties as-firefighters-Of reserve officers "
Section 8. Section 1 91 080 of the City of Yakima Municipal Code is hereby
amended as follows
"1.91.080 Inclusion in-volunteer-firefighter-and reserve officer pension
provisions.
The city of Yakima elects, pursuant to RCW 41.24 400, to
participate in the pension and retirement provisions of the Volunteer Firefighters' and
Reserve Officers' Relief and Pension Act, whereby any qualifying v ol u nteer firefighter or
reserve officer may enroll under the pension provisions of said Act to avail himself or
herself of the retirement benefits available thereunder "
Section 9. This ordinance shall be in full force and effect 30 days after its passage,
approval, and publication as provided by law and by the City Charter

SUMMARY EXPLANATION
In 2004, the City of Yakima became aware that its volunteer firefighters no longer meet the
definition under state law for individuals eligible to participate in Volunteer Firefighters' Relief
and Pension funds. Therefore, the City of Yakima Volunteer Firefighters Pension Board held
its last meeting on May 3, 2004, and thereafter disbanded This ordinance will update the
Yakima Municipal Code by repealing the Volunteer Firefighters Relief and Pension Fund and
the ordinance establishing the Board that oversaw the Fund
