AN ORDINANCE relating to licenses and business regulations,
changing felony disqualification standards for
taxi driver's licenses, private detectives, and
private security guard licenses and amending
Sections 5.78.190, 5.48.070, and 5.62.040 of the
City of Yakima Municipal Code.
HE IT ORDAINED BY THE CITY OP YAKIMA:
Section 1: Section 5.78.190 is hereby amended to read as
follows:
"5.78.190 City driver's license - Qualifications.
Each applicant for a city driver's license provided for
in this chapter shall:
1. Be at least twenty-one years of age;
2. Be duly licensed to operate a motor vehicle
for hire under the laws of the state of Washington;
3. Submit with the application a certification
from a medical doctor, or the Yakima County Health Dis-
trict, certifying that applicant is free from any infir-
mities of body or mind likely to render him unfit to
• drive a for-hire vehicle, and specifically that applicant
is free from epilepsy, vertigo or heart trouble.
4. Not have been convicted, within ten years
preceding the time of making the application, of com-
mitting any felony directly related to the applicant's
ability to operate a motor vehicle for hire; not have
been convicted or forfeited bail within five years of any
crime, other than the aforementioned felonies, reasonably
related to the applicant's ability to operate a motor
vehicle for hire; not have committed, forfeited bail or
paid a penalty within the past five years on three or
more moving motor vehicle traffic violations.
5. Demonstrate to the satisfaction of the chief
of police the applicant's ability to operate and control
a for-hire vehicle and his familiarity with traffic
regulations."
Section 2: Section 5.62.040 is hereby amended to read as
follows:
"5.62.040 Application - Renewal - Hearings.
Application for licenses shall be made to the city clerk
on such form as the city clerk may require, which shall
show thereon the applicant's name, age, present and
previous residence and occupation for a period of not
less than five years immediately prior to such applica-
tion, the address of his place of business, and the name
of his employer, if any; and shall state whether or not

the applicant has ever been convicted of a felony. Such
application shall be signed and verified by the appli-
cant. If the applicant is a firm or corporation, the
application shall be made by its resident manager, who
shall meet the qualifications herein set forth.
All applications for licenses shall be forwarded
to the chief of police for investigation and report. The
chief of police shall require that each applicant be
fingerprinted and his photograph taken; and a full inves-
tigation made into the character, reputation and ability
of the applicant.
If the chief of police finds that the applicant
is a proper person to hold a license, he shall direct the
city clerk to issue said license; otherwise, he shall
direct the city clerk to deny said license. Licenses may
be renewed from year to year by the city clerk, without
referral to the chief of police; except as to those
licenses which the chief of police advises the city clerk
in writing require further investigation; which applica-
tions for renewal shall then be handled in the same
manner as original applications. No license required
herein shall be issued to any person unless he is of good
moral character and has not been convicted of any felony
within ten years of application which directly relates to
the occupation, vocation or business regulated by the
license. If the issuance of any licenses hereunder is
denied, the applicant shall have the right of hearing
before the city manager, by filing an appeal within ten

days after said permit is denied. The findings of the
city manager on such appeal shall be final and conclu-
sive."
Section 3: Section 5.48.070 is hereby amended to read as
follows:
"5.48.070 Identification card - Qualifications -
Issuance. Each applicant for a private security officer
identification card shall be fingerprinted and photo-
graphed, and the Yakima police department shall make an
investigation of the background of the applicant. No
identification card shall be issued to any person unless
the investigation discloses that the applicant has not,
within ten years of the date of application, been con-
victed of any felony charge directly related to the
occupation, vocation, or business regulated by this
chapter, or any other criminal charge involving moral
turpitude. In the event an applicant is denied the
issuance of an identification card, the unsuccessful
applicant shall have the right to a hearing with regard
to the denial before the Yakima city council by filing a
written notice of appeal with the city clerk within ten
days after the application is denied. The decision of
the city council on the appeal shall be final and conclu-
sive."

411 Section 4: This ordinance shall be in full force and
effect thirty days after its passage, approval, and publica-
tion as provided by law and by the City Charter.
