WHEREAS, a master application for construction of a new Adams Elementary School at 723 South 8th Street and a petition for vacation of the portion of South 9th Street located be- tween Race and Adams Street has been filed with the City Clerk; and WHEREAS, the owners of more than two - thirds of the pro- perty abutting said street have signed the vacation petition; and WHEREAS, after due notice, after a hearing by the hearing examiner, and as result of this Council's hearing, the City Council finds it is in the best interest of the City that the master application and the petition to vacate be granted, now, therefore, BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1: The vacation of the right -of -way consisting of that portion of South 9th Street located between Race and Adams Street and the master application for construction of a new Adams Elementary School at 723 South 8th Street, as de- scribed in the detailed site plans submitted with the applica- tion, and including 78 on -site parking spaces, together with an administrative adjustment of building height permitting construction of a building up to 40 feet tall is approved, subject to the following conditions: 11, - 1 - (ord /admselem) A. Approval by City planning staff of a detailed • site plan identifying. (1) Landscaping details and irrigation plan; 1111 (2) Location of fence and pedestrian circulation pathways onto the site; (3) Other significant features of the site as reflected on the preliminary site plan and in the staff report. B. City review and approval of a demolition plan identifying the various stages of demolition and house moving. C. Yakima County Health District approval of demolition debris disposal plan. D. City Engineer approval of the following: (1) Drainage plan and calculations; (2) Water and sewer line plans and specifica- tions, including easements; (3) Street improvement plans and specifications, including sidewalk construction, right-of-way dedication, easements, and curbs and gutters; (4) Public utility easements and all other needed easements; E. City Public Works approval of the following: (1) Installation of five or less new street lights along Race Street and 8th Street, as determined by the City; (2) Curb cut specifications, including waiver for southern entrance on 8th Street to exceed the maximum width standards in the Municipal Code. Section 2: The findings, conclusions, and recommendation 1111 of the hearing examiner and attached map are incorporated herein and made a part hereof. Section 3. This ordinance shall be in full force and effect 30 days after its passage, approval, and publication as 111 provided by law and by the City Charter. The Staff Report presented by Mrs. Joan Davenport recommended approval. There was no opposition. The Examiner inspected the property prior to the hearing. + 0: . :COI -_ The Examiner recommends approval 4110 of this master application, including vacating a portion of South 9th Street, construction of a new school, and administrative adjustment of the building height limitation to permit a building approximately 37 feet high rather than the 35 -foot height limitation in R -1. From the view of the site, the matters contained in the official record including the Staff Report, a review of applicable statutes, ordinances and case law, and from evidence received at the hearing, the Examiner makes the following: FINDIN ©S 1. The Staff Report is adopted in its entirety, incorporated herein by reference, and attached hereto as Exhibit "A," subject to minor modifications concerning building height and 4110 the number of street lights. 2. The building height, with gymnasium, will be approximately 36 1/2 feet. The height limitation in the Single - Family Residential (R -1) zone is 35 feet. The number of new street lights to be installed by the district along Race Street and 8th Street has been revised from the staff recommendation of six to five, based upon the input at the hearing from 14s. Shelley Harlington of Traffic Engineering. This has been agreed to by the district, and may be further reduced by the City upon calculation of lighting levels. 4. Vacation of the street does not create any significant traffic concerns and all criteria for vacating the right -of -way have been met. S. Notice of the public hearing was provided in accordance with the zoning ordinance and applicable state law. From the foregoing Findings, the Examiner makes the following: CPNCLUB I 1. The Examiner has jurisdiction. 2. All notice provisions have been complied with. 3. Vacation of this right -of -way is consistent with 4111 RCW Ch.35.79 and Yakima City Ordinance No. D -5630. 4. The master application conforms to the goals and policies of the Yakima Urban Area Comprehensive Plan and to the intent of the Yakima Urban Area Zoning Ordinance. Vacate a portion of South 9th Street for expansion of school campus. 3. Construct a new elementary school of 50,258 square feet, enrollment of 540 students and 26 classrooms, library; 4. Demolish existing Main school but retain gym building and classroom wing. EXISTING ZONING AND LAND USE The development site is currently zoned R -1, Single Family Residential and is occupied by the existing school, single family homes and South 9th Street Surrounding properties have the following characteristics. LQCATION ZONING EXISTING USE North of East Race St R -1 Martin Luther King Park, Washington Middle School South of Adams St R -1 Single Family, school parking lot 0 East of Alley R -1 Single Family West of 8th St R -1 Single Family 0 s URBAN AREA COMPREHENSIVE PLAN A stated objective of the Urban Area Plan is to assure that future development is compatible with existing uses. The Urban Area Plan does not include policies related to the placement of schools or other community facilities. Compatibility and development critena are to be reviewed and determined on an individual site basis. All adjoining streets around the development site are classified as local access streets in the Arterial Road Plan of the Comprehensive Plan. The Comprehensive Plan includes goals and objectives related to housing and residential neighborhoods. The Plan outlines those measures on HG-15, which encourages a wide variety of housing types at affordable levels. A primary policy of this Housing Section is to preserve structurally sound housing Single Family • residential areas should be protected against disruptive commercial, industrial and multi-family developments. III Adams school has been located in its present location since the 1911. The older portion of the existing school was built in the early 1930s. The school provides an essential community service to the community and is an integral portion of the residential neighborhood. URBAN AREA ZONING ORDINANCE A stated purpose of the R-1 Zoning District is to establish and preserve residential neighborhoods for detached single family homes , duplexes and other uses compatible with the district. The district is characterized by 45% lot coverage, large building setbacks and access via local streets Schools are classified under Community Facilities and listed as a Class 3 use in all Residential Zoning Districts, including the R-1 Zoning District. The purpose of the Class 3 Public Hearing is to receive public comment and determine whether or not the proposed use is compatible with the surrounding neighborhood. based on the input at the hearing, the provision of public services and compliance with the 0 Comprehensive Plan. UAZO STANDARDS • The site development plan for the proposed Adams elementary. school is a generalized site plan. Specific site details are under review regarding utilities, (2) 4 1110 0 grading and drainage The general site plan, as submitted, complies with the standards of the UAZO and no adjustments of the standards have been identified as necessary by the proposed design. Below is a summary of the UAZO Site Design standards: Building Setbacks and Height; The new buildings will be one story in height and not exceed the 35 foot height standard in the R-1 zone. Setbacks for the buildings will exceed the standard of 40 feet from the centerline of local access roads. Sitescreening. The School District proposes to construct a chain link fence around the perimeter of the school yard. This fence will be four foot in height and not be view obscuring Staff recommends that no sitescreening measures be required along the road frontages, but a detailed landscape plan should be submitted and reviewed by staff which identifies new trees and other significant landscaping features Parking. The existing Adams school development has 72 parking spaces, including 40 the parking lot south of Adams Street. With the new school complex 78 parking spaces will be developed on site, and the small parking lot south of Adams Street will be retained, for a total of approximately 90 parking spaces. The UAZO Parking 0 standard for elementary schools is three spaces per classroom. Adams Replacement school will have a total of 26 classrooms and 30 faculty members. The available parking will exceed the standard of 78 spaces required for this school. DESIGN REVIEW A design Review Team meeting was held on August 30, 1989 to discuss this project, with the applicant present. DRT responses are summarized WastewateLPMsion: We have an 8" line located under the proposed school site which will need to be replaced with a steel pipe. Soil Conservation, Ashue Loam soils should not cause any limitations to building Fire Dept; Recommends a lock box system for emergency fire access to building PP&L. Street Vacation will not pose any problems for service Four power poles may need to be moved from development site The building seems to be surrounded by asphalt which absorbs heat. Water Division. A 6" steel water line located in 9th Street will need to relocated . 0 Hydrants may need to be relocated or additional ones installed. Health District. Some concern about disposal of house demolition wastes, which when burned can produce toxic substances. The City should condition approval of project upon School District compliance with WAC 173-304 and other health codes which regulate disposal of solid wastes. Police. The street vacation may cause some inconvenience, but should not affect the area to any great extent. Traffic and playground noise will not increase Security lighting is a recommendation for safety and natural surveillance during atter hours (3) functions Additional target hardening measures, backed by a good alarm system would be a benefit. The layout should allow for officers and others to spot suspicious persons/ circumstances. City Engineer: Adjoining streets have adequate right of way New curb, gutter and sidewalk will have to be replaced at southeast comer of 8th St and Race Street and at Adams Street, when curb return radii are increased, and along the present right of way for 9th Street, if vacated. Driveway approaches shall be of standard City design of 30 fee, with minimum 35 feet turning radius, or determined by City Drainage plan must be approved. Iraffic Engineer: Required a traffic study, prepared by a licensed engineer which addresses impact of street closure to neighborhood, existing road improvements and signage requirements. Street lights to be installed along perimeter of site, No parking on east side of 8th Street from Adams to Race Streets; No access onto existing alley; Sidewalks, curb and gutter to be installed on all streets adjacent to development. A total of 6 new lights are recommended. • Housing Division. What is historical significance of school? What will the environmental impacts of demolition be like for neighborhood? The statement that "most selling costs will be paid by the school" should be questioned to determine what is not paid. Is there help for tenants? Cascade Natural Gas. We have a 2" main on west side of 9th Street between Race and Adams. We need to know if line will be retired. Also, service now to 705 South 8th Street residence from South 8th Street which will need to be retired. NEIGHBORHOOD COMPATIBILITY The demolition activity, more than any other aspect of the Adams School project is expected to impact the neighborhood The housing stock to be demolished is generally in fair condition, and in need of minor or major repairs. The school district intends to phase the demolition activity of the 28 homes and numerous out -buildings. The District has been looking for ways to mediate the impact of this activity on the neighborhood, including the sale of some homes in order that they may be moved to vacant lots nearby At the present time, the exact number of homes which might be moved instead of demolished is not known. The School District was not required to follow Uniform Relocation Act requirements, which would have mandated moving costs to be paid by the school district for rental tenants. The School District has made some community contacts regarding the limited availability of these services, if deemed a problem for some tenants The issue of • relocation of tenants and property acquisition by the School District is not a matter related to these proceedings. The School District has made its policy related to these matters a part of the public record. (4) 0 SEPA The Yakima School District #7, as a unit of government, was lead agency for the Environmental Review and issued the threshold determination for this project. A Mitigated Determination of Non-significance was issued by the School District on August 16, 1989. The comment period ended on August 31, 1989. The School District held a neighborhood meeting at the school during the comment period, with little neighborhood attendance. Although the School District received some comments on this project, the Mitigated DNS, as issued in August, 1989 was not amended and still stands. The City of Yakima concurres with the Mitigating conditions issued by the School District with the DNS. STREET VACATION CRITERIA The City of Yakima adopted administrative policies and criteria for the granting of 0 Street vacation requests. These criteria and the compliance of this project is summarized below 1. The Petition must explain the public benefit of the project and the reasoning of the proposed vacation and the limits of the vacation. The stated public use of the area to be vacated is for school site development. The public benefit of this project is increased availability of school facilities, and a more modern, efficient building The additional acreage for the elementary school is to bring the school site up to state standards. South 9th Street presently serves as a local access road, with less than 500 vehicles trips per day ( not counted in Traffic Study). These trips will be easily redistributed to 8th Street or 10th Street at only a minor inconvenience to the residents. Unless strong neighborhood opposition materializes at the public hearing, staff is of the opinion that the public interest would be best serviced by expanding the school campus and vacating the street. 2. The vacation of right of way does not deny any sole access to any 0 property. This vacation request would not deny any sole access to any property 3. Petitions should be consistent with the Six Year Transportation improvement Plan, Urban Area Comprehensive Plan and other official City plans and policies. The current TIP does not reflect any planned improvements to this alley, nor is this 0 location addressed in any adopted City Plan. Work is presently underway with the (5) 0 • "Sundome Neighborhood Study as well as the 1-82 Corridor Study which will address interchange development and design Some minor modifications to signage of local roads, pavement markings and other such items may result from the study which are applicable to the school and park region of the neighborhood. 4. Vacation requests should be appropriate with existing and anticipated development in the area , based on zoning, current use and long range plans. This area has long been a residential area and will likely remain such into the foreseeable future. Based on the land use studya nd plan for this area, some propoerties, particularlly those close to the Fairgrounds may be recommended for transition to commercial uses. However, this area is not expected to change in land use. 5. Existing Utilities (public and franchised) should be relocated at the • developers expense or an adequate easement provided. Where appropriate, if existing utilities are deemed not necessary this requirement may be waived. • The right of way of 9th Street does provide a utility corridor which contains a as line, irrigation line and a sewer line The 6" water line will remain in service and be relocated. One new hydrant and one relocated hydrant is proposed The gas line will be abandoned and service provided from 8th Street. The 8" sewer line will be rerouted. Environmental Review conducted by the School District complied with the statutory requirements of RCW 43.21C, SEPA Regulations. (6) I i 1 1 1 1 111 0 3. Notice requirements for the street vacation, master application and SEPA were complied with. 4. Impacts to the Public Street system will be minimized if the curb return radii at the intersection of 8th Street and Race and 8th Street and Adams are improved, curb, gutter and sidewalks constructed as planned and street lights installed , on Adams and 8th Street. RECOMMENDATION The City of Yakima Office of Environmental Planning has reviewed the application and recommends approval of the proposed Master Application Class 3 Review subject to the following conditions: 1. A Detailed Site plan be approved by the City Planning Staff which identifies. 411 (a) Landscaping details and irrigation plan, (b) location of fence, and pedestrian circulation pathways onto the site, la (c) other significant features of the site, reflected on the preliminary site plan and reviewed at this public hearing. 2. A demolition plan submitted to City Planning and Codes Divisions ro review which identifies the various stages of demolition and house moving 3. Yakima County Health District approval of demolition debris disposal plan. 4 City Engineer approval of the following (a) Drainage plan and calculations, (b) Water and Sewer line plans and specifications, including easements; (d) Street improvement plans and specifications, including sidewalk construction, right of way dedication, easements, curbs and gutters. 5 City Public Works approval of the following (a) Installation of 6 new streetlights along Race Street and 8th Street, (b) Curb cut specifications, including waiver recommendation for southern entrance on 8th Street to exceed the maximum width standards in the YMC. 0 ' 0 (7 ) . . 0 • 6 Staff recommends the requested petition to vacate a portion of 9th Street be recommended to City Council for approval. The proposed use is clearly in the best interest of the neighborhood and community at large Modifications to utility line locations can be accomodated by the proposed plans. Closure of the street has a minor impact on local traffic, which would still have various alternative routes of access. No compensation is required to be paid to the City for the area to be vacated.
