ORDINANCE NO. 3254
AN ORDINANCE approving construction of a new Roosevelt Elemen-
tary School at 120 North 16th Avenue and approv-
ing vacating the rights -of -way, consisting of
that portion of North 17th Avenue north of Sum -
mitview to the dead end, together with the unused
alley platted on the current school grounds,
running north and south; the north -south alley
between 17th and 18th Avenues, south of Summit -
view, to the dead end; and an unused alley run-
ning east -west from 18th to 16th Avenues within
the City of Yakima.
WHEREAS, a master application for construction of a new
Roosevelt Elementary School at 120 North 16th Avenue and for
vacation of the rights -of -way, consisting of that portion of
North 17th Avenue north of Summitview to the dead end, toge-
ther with the unused alley platted on the current school
grounds, running north and south, the north -south alley be-
tween 17th and 18th Avenues, south of Summitview to the dead
end; and an unused alley running east -west from 18th to 16th
• Avenues has been filed with the City Clerk; and
WHEREAS, the owners of more than two - thirds of the pro-
perty abutting said streets and alleys have signed the vaca-
tion petition; and
WHEREAS, after due notice, after hearing by the hearing
examiner, and as result of this Council's hearing, the City
Council finds that it is in the best interest of the City that
the master application and the petition to vacate be granted,
now, therefore,
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1: The vacation of the rights -of -way consisting
of that portion of North 17th Avenue north of Summitview to
the dead end, together with the unused alley platted on the
current school grounds, running north and south; the north -
south alley between 17th and 18th Avenues, south of Summitview
to the dead end, and an unused alley running east -west from
18th to 16th Avenues and the master application for construc-
tion of a new Roosevelt Elementary School at 120 North 16th

Avenue as described in the detailed site plan, together with
• an administrative adjustment of building height permitting
construction of a building up to 40 feet tall is approved,
subject to the following conditions
A. Approval by City planning staff of a detailed
site plan identifying
(1) Landscaping details and irrigation plan;
(2) Location of fence and pedestrian circulation
pathways onto the site,
(3) Other significant features of the site as
reflected on the preliminary site plan and in
the staff report.
B. City review and approval of a demolition plan
identifying the various stages of demolition and house
moving.
C. Yakima County Health District approval of
demolition debris disposal plan.
D. City Engineer approval of the following:
(1) Drainage plan and calculations;
(2) Water and sewer line plans and specifica-
tions, including easements;
(3) Street improvement plans and specifications,
including sidewalk construction, right-of-way
dedication, easements, and curbs and gutters,
(4) Public utility easements and all other needed
easements;
E. City Public Works approval of the following
(1) Installation of up to two new street lights
along 18th Avenue;
(2) Curb cut specifications, including waiver
recommendation for southern entrance on 18th
Avenue to exceed the maximum width standards
in the Municipal Code.
F. City Public Works Department may restripe
Summitview Avenue in the vicinity of 18th Avenue with a
110 left turn lane if deemed necessary after the first full

academic year of experience with the new school, in which
IIP case the School District shall pay the cost of seal
coating and restriping that portion of Summitview Ave-
nue.
G. City Public Works Department may determine
after the first full academic year of operation of the
new school that pedestrian improvements be constructed on
Summitview Avenue to deal with additional student pedes-
trian traffic, in which event the cost of improvements
shall be paid by the School District.
Section 2. The findings, conclusions, and recommendation
of the hearing examiner and attached map are incorporated \
herein and made a part hereof.
Section 3 This ordinance shall be in full force and
effect 30 days after its passage, approval, and publication as
provided by law and by the City Charter. This ordinance shall
not be valid unless approved by Yakima School District #7 as
provided below.

This master application was the subject of a public hearing
conducted by the Examiner on February 7, 1990. The Staff Report
presented by Mrs. Joan Davenport recommended approval. There was
no opposition. The Examiner inspected the property prior to the
hearing.
SUMMARY OF RECOMIIENDATIOJ4. The Examiner recommends approval
of this master application, including vacating a portion of North
17th Avenue and three alleys, construction of a new school, and
administrative adjustment of the building height limitation to
permit a building approximately 37 feet high rather than the 35-
foot height limitation in R -1.
From the view of the site, the matters contained in the
official record including the Staff Report, a review of applicable
statutes, ordinances and case law, and from evidence received at
the hearing, the Examiner makes the following:
FINDINGS
1. Staff Report. The Staff Report is adopted in its
entirety, incorporated herein by reference, and attached hereto as
Exhibit "A," subject to minor modifications concerning building
height and the number of street lights.
2. Street Vacation. The street being vacated is that

portion of North 17th Avenue north of Summitview to the dead -end,
together with three alleys, rather than the two noted in the staff
report. The alleys consist of an unused alley platted on the
current school grounds, running north and south, the north -south
alley between 17th and 18th Avenues, and an unused alley running
east -west at the end of 17th and 18th Avenues.
3. n: _v ,_ el . The building will be
approximately 36 1/2 feet tall due to the gymnasium, higher than
the 35 -foot height limitation in the R -1 zone. Accordingly,
administrative adjustment of the height is requested and should be
approved permitting a building up to 40 feet high. This will not
be detrimental to the area and is consistent with the intent of the
Urban Area Zoning Ordinance. It should also be noted that the
building will be a two -story building rather than a one -story
building. The gym has to be 36 1/2 feet tall in order to allow the
City Parks Department to utilize the gymnasium for volleyball.
This school is similar to the other new prototypical schools, such
as Ridgeview, built by the district in recent years.
This particular school is being built lower than the original
grade. Architect Harlan Dunn testified that if this school were
built on the original grade, it would be 17 feet higher.
4. $DNB. A number of letters were received commenting on
the mitigated determination of non - significance (MDNS) entered by
the District. Dr. Robert Alexander testified at the hearing
concerning the District's response to these comments. Mrs. James
McDonald had expressed concern about the nature of the wall or berm
on the south side of the school. The school can set the fence in
toward the building in order to avoid disrupting the existing
mature trees. Landscaping will be on the school side of the fence,
and will not be a maintenance burden for adjacent land owners.
Adjacent residents on Park Lane expressed concern about the
impact on the irrigation system. Park Lane is apparently on a one -
street private system which can be retained. That system will be
capped off where it currently serves two houses on 17th, which will
be removed.

s. Vehicular Traffic. As reflected in the staff report,
considerable effort has been made to study the impact of this
expansion on the traffic flow on Summitview Avenue, a major
arterial. The District has agreed to dedicate a ten -foot strip of
right -of -way along their frontage on Summitview, and to construct
curb returns on 18th Avenue which will accommodate the wide turns
made by busses. Eighteenth Avenue will also be widened by the
District in order to provide a left turn onto Summitview. It will
have three 12 -foot lanes and on- street parking on the west side.
No neighbors appeared at the hearing with concerns about parking.
Of particular concern to the Examiner was the impact on
Summitview traffic of school busses turning left from Summitview
onto 18th. School District policy is to avoid left turns from
busses if at all possible, and the current planning is to have
busses travel through the city in a loop which will place them
eastbound on Summitview, making a right turn onto 18th.
If experience shows that there is a problem, there is enough
width on Summitview to stripe a turn lane for use into 18th. If
this becomes necessary the District should bear the cost of seal
coating and restriping Summitview.
6. pedestrian Traffic. , The City Traffic Engineering
Department is more concerned about pedestrian traffic, particularly
students, crossing Summitview, than the impact of vehicular
traffic. The traffic study did not address this issue.
The School District believes that most of the additional
students at Roosevelt will be bussed there, and that future student
foot traffic will be similar to that currently existing. In their
view, the current situation is adequate and does not warrant a
pedestrian crossing signal on Summitview. There are crosswalks
1110 provided periodically west of 16th on Summitview, as well as at
16th. Shelley Harlington from Traffic points out that it is the
delay encountered by children rather than the number of children
which is significant in determining whether or not a crossing
signal is warranted. Unfortunately part of Summitview does not
have sidewalks, which may encourage children to cross the street at
unsafe locations.
From a vehicular .traffic flow perspective, additional lights

on Summitview are not desirable if the children can be handled
safely with existing conditions. The more lights, the more
vehicular traffic delays, and the less efficient the arterial.
If experience indicates that additional traffic signals for
student crosswalks are justified, the cost of installation should
be borne by the District because it is directly related to the
school activities and increase in size.
From the foregoing Findings, the Examiner makes the following:
CONCI,USIONB
L. The Examiner has jurisdiction.
2. All notice provisions have been complied with.
3. Vacation of these rights -of -way is consistent with
RCW Ch.35.79 and Yakima City Ordinance No. D -5630.
4. The master application conforms to the goals and policies
of the Yakima Urban Area Comprehensive Plan and to the intent of
the Yakima Urban Area Zoning Ordinance.
Based upon the foregoing Findings and Conclusions, the
Examiner submits to the Yakima City Council the following:
RECOMMENDATION
1. Approve vacating the rights -of -way, consisting of that
portion of North 17th Avenue north of Summitview to the dead -end,
together with the unused alley platted on the current school
grounds, running north and south; the north -south alley between
17th and 18th Avenues, south of Summitview to the dead -end; and an
unused alley running east -west from 18th to 16th Avenues.
2. Approve construction of a new Roosevelt Elementary School
at 120 North 16th Avenue, in compliance with the detailed site
plan.
3. Approve an administrative adjustment of building height
permitting construction of a building up to 40 feet tall, subject
to the following conditions:

PROJECT DESCRIPTION
1 Expand the existing Roosevelt Elementary School campus from 2 6 acres to
approximately 8.0+ acres by acquiring 26 residences due west of the present
school campus site Demolish or move the acquired residences for purposes of
site development,
2 Vacate a portion of North 17th Avenue and two alleys to allow for expansion of
school campus.
3 Construct a new elementary school of 50,258 square feet, enrollment of 540
students and 26 classrooms, library,
EXISTING ZONING AND LAND USE
The development site is currently zoned R -1, Single Family Residential and is
occupied by the existing school, single family homes, North 17th Avenue and alleys.
Surrounding properties have the following characteristics

URBAN AREA COMPREHENSIVE PLAN
A stated objective of the Urban Area Plan is to assure that future development is
compatible with existing uses. The Urban Area Plan does not include policies related
to the placement of schools or other community facilities. Compatibility and
development criteria are to be reviewed and determined on an individual site basis.
The Comprehensive Plan includes goals and objectives related to housing and
residential neighborhoods. The Plan outlines those measures on HG-15, which
encourages a wide variety of housing types at affordable levels. A primary policy of
this Housing Section is to preserve structurally sound housing. Single Family
residential areas should be protected against disruptive commercial, industrial and
multi-family developments.
Roosevelt school has been located in its present location since the 1920s. The S
school provides an essential service to the community and is an integral portion of
the residential neighborhood.
The Arterial Street Plan in the Urban Area Comprehensive Plan identifies 16th Avenue
as a Principle Arterial and Summitview Avenue as a Major Arterial. The impact of
this proposed development upon the Arterial street system should be carefullly
evaluated in determining compliance with the Comprehensive Plan.
URBAN AREA ZONING ORDINANCE
A stated purpose of the R-1 Zoning District is to establish and preserve residential
neighborhoods for detached single family homes , duplexes and other uses
compatible with the district. The district is characterized by 45% lot coverage, large
building setbacks and access via local streets
Schools are classified under Community Facilities and listed as a Class 3 use in all
Residential Zoning Districts, including the R-1 Zoning District. The purpose of the
Class 3 Public Hearing is to receive public comment and determine whether or not
the proposed use is compatible with the surrounding neighborhood, based on the
input at the hearing, the provision of public services and compliance with the
Comprehensive Plan

UAZO STANDARDS
The site development plan for the proposed Roosevelt elementary school complies
with the standards of the UAZO and no adjustments of the standards have been
identified as necessary by the proposed design. Below is a summary of the UAZO Site
Design standards'
Ouilding Setbacks and Height: The new building will be one story in height and not
exceed the 35 foot height standard in the R-1 zone Setbacks for the buildings will
exceed the standard of 40 feet from the centerline of local access roads, and the
standards for Arterial roadways established in Table 5-1 of the UAZO.
Sitescreenitg, Some area residents located south of the school site near Park Lane
have expressed concern regarding the impact of the school expansion project upon
their properties. Concerns ranged from playground noise to visual impacts. The
School District proposes to construct a berm running laterally from 18th to 16th
Avenues which would be landscaped with trees, shrubs and a wall to limit pedestrian
traffic. The height of the wall is proposed at 6 feet in height and would be located on
the southern property line. A 6 foot wall is permitted in the residential districts within a
sideyard setback area, if the sideyard does not abut a street (UAZO 15.05 02G(2))
In addition, the applicant proposes to retain approximately 22 large trees from the
development site and to plant a wide variety of large, broadleaf shade trees such as
Lindens and maples along the perimeter of the campus and around the buildings and
grounds The existing brick wall and fence along Summitview Avenue will be
retained.
Parking,. The existing Roosevelt school has 20 parking spaces. The proposed
school complex will have 78 parking spaces. The UAZO Parking standard for
elementary schools is three spaces per classroom, which equals 78 required spaces.
DESIGN REVIEW
A design Review Team meeting was held on August 30, 1989 to discuss this project,
with the applicant present. Another DRT meeting was held on January 11, 1990 to
discuss traffic impacts. DRT responses are summarized:
Wastewater Diyision: We have a 6 line located in 17th Avenue and under the
• proposed school site which will need to be replaced with a steel pipe
Soil Conservation. Ashue Loam soils should not cause any limitations to building.
Fire Dept, Recommends a lock box system for emergency fire access to building and
a fire hydrant at southern driveway to school

PP&L. Street Vacation will not pose any problems for service. Four power poles
may need to be moved from development site. The building seems to be
surrounded by asphalt which absorbs heat.
Water Division. A 6" cast iron water line located in 17th and 18th Avenues. The
hydrants may need to be relocated and possibly other hydrants installed The
proposed development covers an entire irrigation district (North system #622) If the
School District intends abandon the existing lines, there is no purpose in the
irrigation district.
Health District: Some concern about disposal of house demolition wastes, which
when burned can produce toxic substances. The City should condition approval of
project upon School District compliance with WAC 173-304 and other health codes
which regulate disposal of solid wastes.
Police. The street vacation may cause some inconvenience, but should not affect the
area to any great extent. Traffic and playground noise will not increase. Security
lighting is a recommendation for safety and natural surveillance during after hours
functions. Additional target hardening measures, backed by a good alarm system
would be a benefit. The layout should allow for officers and others to spot suspicious
persons/ circumstances.
City Engineer: Summitview Avenue is Major Arterial, with only 60 feet of right of way,
while the standard is 80 feet in width. We recommend the School District dedicate a
10 foot strip of right of way along their frontage of Summitview Additional right of way
triangles may be necessary around the intersection of Summitview and 18th Avenue.
The radii of the curb returns of the intersection of 18th Avenue should be increased to
service bus tuming movements.
Widening of Summitview Avenue to accommodate a left turn lane into 18th Avenue
will probably not be necessary at this time, as suggested in the traffic study
Eighteenth Avenue will need to be widened to provide a left turn onto Summitview with
three 12 -foot lanes and an area for on street parking for the west side of 18th
Avenue. Clear View Triangles should be maintained at intersections.
Traffic Engineer: Required a traffic study, prepared by a licensed engineer which
addresses impact of street closure to neighborhood, existing road improvements and
signage requirements.
Recommends school participate in seal coat of Summitview if it becomes necessary to
restripe the street to include a left turn bay at 18th Avenue, due to traffic congestion
or collisions, etc. There is adequate existing pavement width to stripe the tum lane,
if necessary Traffic circle at Park Lane and 18th Avenue not recommended, Street
lights required along 18th Avenue The traffic study and additional letter of January
17, 1990 from the Consultant do not address the need for a school crossing signal at
Summitview Avenue, nor preform a warrant analysis for such.

Casca Natural Gas. We have a 2° main in 17th Avenue. Also, nine residences to
be torn down have gas service A gas line is located in. the right of way of 18th
Avenue
SEPA
The Yakima School District #7, as a unit of government, was lead agency for the
Environmental Review and issued the threshold determination for this project. A
Mitigated Determination of Non-significance was issued by the School District on
August 16, 1989 The comment period ended on August 31, 1989 The School
District held a neighborhood meeting at the school during the comment period,
which was widely attended by the neighborhood Based on comments from the
neighborhood and from the City as well as other agencies, the school district
conducted further Environmental Review
Issues which were addressed in the supplemental Environmental Review ranged from
traffic impacts to residential displacement and landscaping A Traffic Analysis was
prepared by a Licensed Engineer, with written specifications from the City Traffic
Engineer
On January 19, 1990, the School District amended the mitigated DNS issued in
August and released a Final Mitigated DNS A full copy of the DNS has been made
available to the Hearing Examiner A total of six mitigating measures were identified
in the DNS by the School District. In summary, these items are as follows
1 To reduce the potential for wind erosion, air pollution and the like, during
demolition and construction activities a temporary sprinkler system shall be
installed and operated daily to reduce dust. The school District will cultivate the
soil every one to two weeks to control proliferation of noxious weeds.
2. Demolition wok and associated waste disposal of debris shall be conducted
by a licensed, bonded contractor, under the specifications of the Yakima
County Health District.
3. To minimize noise impacts to the adjoining residential areas, the play
areas will be located away from most of the residences, and, a landscaped
buffer will be installed including a wall and landscaped berm

5. To minimize the visual impacts of the school expansion project, the building
will be constructed with a low sightline of the roof, be built of a subdued color ,
separate play areas from housing areas, and landscape the property,
including the wall and berm.
6. To mitigate traffic impacts, the School District proposes the following
a. Widen 18th Ave to accommodate a left turn lane and on-street parking
on the west side
b. Bus turnarounds and loading activities shall be provided on school
property,
c. All school bus access shall be off of 18th Avenue and Summitview,
d Pedestrian access shall be accommodated at all four corners of the
site,
e Monitor side street traffic volumes, to determine if devices need to be
installed to reduce school related traffic through residential areas.
f Monitor pedestrian traffic to determine if a pedestrian -activated
crosswalk light is necessary, or some other measure to ensure safety of
pedestrians crossing Summitview at 18th Avenue
The City of Yakima agrees with these measures and mitigating conditions.
NEIGHBORHOOD COMPATIBILITY
The demolition of 25 homes and numerous outbuildings has been an issue of
concern for some area residents. None of the homes to be demolished have been
identified as having significant historical interest. The District is not sure if any of the
residences will be moved to another location There is little available land in the
immediate vicinity of the school property The moving of a house is only financially
and structurally feasible for short moves of 6 to 12 blocks, depending on conditions.
To mitigate these impacts to the neighborhood character, as referenced above, the
School District has attempted to design a facility which will be compatible
STREET VACATION CRITERIA
The City of Yakima adopted administrative policies and criteria for the granting of
Street vacation requests These criteria and the compliance of this project is
summarized below
1. The Petition must explain the public benefit of the project and the
reasoning of the proposed vacation and the limits of the vacation.

The stated public use of the area to be vacated is for school site development. The
public benefit of this project is increased availability of school facilities, and a more
modern, efficient building The additional acreage for the elementary school is to
bring the school site up to state standards.
North 17th Avenue, is a minor local street which dead-ends about 460 feet south of
Summitview Avenue. Also included in this petition, is the proposal to vacate three
alleys in the vicinity The vacation of these alleys should not negatively impact any
other property interests and are a necessary element of the proposed project.
Unless strong neighborhood opposition materializes at the public hearing, staff is of
the opinion that the public interest would be best serviced by expanding the school
campus and vacating the street and alleys.
2. The vacation of right of way does not deny any sole access to any
property. This vacation requests would not deny any sole access to any property
• 3. Petitions should be consistent with the Six Year Transportation
Improvement Plan, Urban Area Comprehensive Plan and other official
City plans and policies.
The current TIP does not reflect any planned improvements to the adjoining
roadways, nor the roadways to be vacated The recommendations from City
Engineering and Public Works regarding the dedication of additional right of way
along Summitview Avenue should be required to ensure future compatibility of the
school complex with any improvements which may be necessary for the Arterial
system.
4. Vacation requests should be appropriate with existing and anticipated
development In the area , based on zoning, current use and long range
plans.
An elementary school has been located in this area since the 1920s An elementary
school is a necessary community facility and is compatible with the existing zoning, if
site considerations can be adequately addressed
5. Existing Utilities (public and franchised) should be relocated at the
developers expense or an adequate easement provided. Where
appropriate, if existing utilities are deemed not necessary this
requirement may be waived.
An irrigation district will probably need to be abandoned, as well as an existing gas
line in 17th Avenue These utility questions, as well as the relocation of water and
sewer lines have been addressed in a preliminary fashion and the applicant is
working closely with the City Engineering Division Easements will be required along
some of these utilities.

FINDINGS
1 The proposal is consistent with the goals and objectives of the Urban Area
Comprehensive Plan, and the intent of the Urban Area Zoning Ordinance.
2. Environmental Review conducted by the School District complied with the
statutory requirements of RCW 43.21C, SEPA Regulations. The City concurs with
the findings of the District.

3. Notice requirements were complied with for the street vacation, master
application and SEPA
4 The proposal to vacate the subject street and alleys will have a minimal impact
upon the arterial roadway system. It has potential for a greater impact on residential
streets.
RECOMMENDATION
The City of Yakima Office of Environmental Planning has reviewed the application and
recommends approval of the proposed Master Application Class 3 Review subject to
the following conditions
1 A Detailed Site plan be approved by the City Planning Staff which identifies
(a) Landscaping details and irrigation plan,
(b) location of fence, and pedestrian circulation pathways onto the site,
(c) other significant features of the site, reflected on the preliminary site plan
and reviewed at this public hearing
2 A demolition plan submitted to City Planning and Codes Divisions to review which
identifies the various stages of demolition and house moving
3 Yakima County Health District approval of demolition debris disposal plan

4. City Engineer approval of the following
(a) Drainage plan and calculations,
(b) Water and Sewer line plans and specifications, including easements;
(d) Street improvement plans and specifications, including sidewalk
construction, right of way dedication, curbs and gutters.
5. City Public Works approval of the following
(a) Street lighting and signage improvements,
(b) Curb cut specifications, including waiver recommendation for southern
entrance on 18th Ave to exceed the maximum width standards in the YMC
6. City Public Works Department may restnpe Summitview Avenue in the vicinity of
18th Avenue with a left turn lane if deemed necessary due to collisions or congestion
resulting from the development of the school site The school district should
participate in the cost of seal -coating the Summitview Avenue frontage of the School
District property to facilitate the surface for painting
7 The School District Traffic Analyses does not consider the need for pedestrian
improvements at Summitview Avenue As suggested in the MDNS, an evaluation
should be conducted atter construction to determine what improvements, if any, are
necessary.
7 Staff recommends the requested petition to vacate a portion of North 17th Avenuea
dn the three alleys be recommended to City Council for approval The proposed use
is clearly in the best interest of the neighborhood and community at large
Modifications to utility line locations can be accommodated by the proposed plans.
Closure of the street has an impact on local tratfic, but has been thoroughly addressed
in the Environmental Review and City Traffic Engineering Division review
