HomeMy WebLinkAbout1990-3258 Land development fees 1110 ORDINANCE NO. 1 325 -) AN ORDINANCE relating to land development fees, including fees regarding pedestrian skybridges, and amending Section 15.26.010 of the City of Yakima Municipal Code. BE IT ORDAINED BY THE CITY OF YAKIMA: Section I. Section 15.26.010 of the City of Yakima Municipal Code is hereby amended to read as follows "15.26.010 Interest - Land Development Fees. A. Intent. It is the purpose of this chapter to consolidate land development fees formerly charged under Chapters 15.11. and 15.04, Zoning, Chapter 6.88, Environmental Policy, Chapter 14.15, Short Subdivisions, Chapter 14.25, Subdi- visions, environmental checklists and statements, as well as fees for street and alley vacations, shoreline permits, and pedestrian skybridges into one chapter. Consolidation will provide easy access to related charges and create a simplified means for future fee adjust- ments. A. Land Development Fee and Schedule. A41.& Mayor ATTEST: g o--e-e.)„,, City Clerk Publication Date J PA I 3 1990 Effective Date: MAY 1 2 1990 111, - 4 - (ordflnddv1p) 1 CITY OF YAKIMA DIVISION OF ENVIRONMENTAL PLANNING PROCEDURAL GUIDELINES FOR SKY BRIDGE APPLICATIONS AS ADOPTED BY THE YAKIMA CITY COUNCIL ON APRIL 10„ 1990 1 Once a skybridge application form, attachments and fee have been filed with the City of Yakima Department of Community and Economic Development, the application will be reviewed by the staff to determine the completeness When determined to be sufficient, a date will be scheduled for review by the Design Review Team and a tentative hearing date scheduled. 2 Prior to the Public Hearing the staff will conduct a technical review (DRT) involving notification to all City Departments, Public Agencies and the applicabt(s) which may have an interest in the right of way City Staff will prepare a recommendation, based upon the comments received by the Planning Department from various agencies and departments. 3 Notice of the Public Hearing will be published within 12 days of the hearing 4 All property owners within three hundred feet of the subject area and the applicant(s) will be notified by mail, using the records of the Yakima County Assessor, at least ten days prior to the Public Hearing The applicant(s) are to be provided posting notices and are to return signed statements acclaiming the property was properly posted. 5 The Hearing Examiner will issue a written recommendation to the Yakima City Council within ten working days after the Public Hearing The City Council action is at a Public Meeting The final action by City Council requires a two-step process of set date for public meeting and the actual public meeting to affirm or reject the recommendation of the Hearing Examiner If the recommendation from the Hearing Examiner is for approval staff shall prepare an information packet for the City Council, and agenda sheet. The City Legal Department will prepare an ordinance to enact the vacation which includes the terms and conditions of the vacation. If the Hearing Examiner recommends denial of the application, staff shall forward to the City Council the Recommendation of the Hearing Examiner and pertinent contents of the application file 6 The applicants are to be notified of the final action of the City Council. An application cannot be processed unless it is complete and the filing fee paid. Conceptual drawings of the proposed skybridge, which shall include its location, size, height above ground surface, and cost estimate, b. Conceptual drawings of alternatives to the skybridge, with cost estimates, c. Drawings of the proposed skybridge showing its visual appearance, d. Photographs of the location and immediately surrounding area, e An environmental checklist as required (and may be amended) by Section 6 88.090 of in Yakima Municipal Code substantially in the form provided by WAC 197-11-960 (and as may be amended), f A statement of the reasons for the necessity of the proposed skybridge, and g Any additional information deemed necessary by the Department for processing the application II The application should include a narrative addressing the following a. Public need for or benefit from the proposed skybridge b Adequacy of horizontal and vertical clearance c. Assurance of structural adequacy d Potential conflict with existing or proposed utilities, street lighting, or traffic control devices, e View blockage, f Interruption or interference with existing streetscape, g Reduction of natural light, h Reduction of pedestrian activity at street level, i The number of pedestrian projects to use the skybridge, J Effect on commerce and enjoyment of neighboring land use, k. Availability of reasonable alternatives, I Effect on traffic and pedestrian safety, m Consistency with the city's comprehensive plan, n Accessibility for elderly and handicapped, and o Such other matters as the Department deems necessary to the public health, safety, and welfare 1111 ATTACHMENTS The following items should be submitted to complete this application These items may be waived by the Department of Community and Economic Development, if just cause for such waiver is submitted by the applicant. 1 A title search or report, is required to be submitted describing the legal status and ownership of the right of way (this requirement may be waived), 2. A survey of the area to be vacated (this requirement may be waived) , 3. An accurate legal description of the area in which the skybridge is to be sited. DEVELOPMENT STANDARDS AND GUIDELINES In addition to the requirements of Ch 11 60 Y M.0 and applicable building codes, the following provides guidance and direction as to the design standards and guidelines that will be used in reviewing skybridge construction plans Additional standards or requirements may also be required 1 Design A The skywalks should be an enclosed structure and should have at least seventy percent transparency, excluding structural framing members, distributed evenly along the length of the skywalk so as to achieve an open character and reveal pedestrian use of the structure Finish materials on the exterior of the structure should be restrained, conservative and noncompetitive in character with the connecting buildings and other pedestrian skywalks within the central business district. B. Skybridges are to be designed by a State of Washington Licensed Structural Engineer C. All glazing within the skywalk structure shall be not less than one-quarter inch thick tempered glass set in metal frames Skywalks must have internal, controlled, year-round drainage to adjoining building systems or to storm sewer, constructed and maintained to the satisfaction of the City of Yakima. 2. Dimensions--Angulation--Slope. A Skywalks should be no less than eight feet nor more than fourteen feet in width, and no more than fourteen feet in height. B The horizontal angulation of a skywalk off the centerline of the street should not exceed five percent of the width of the street. Skywalks should be level to within one percent tolerance between building contact points 3. Arch -- Vertical Clearance A. No skywalk should have an arch with a rise between the lowest end and the midpoint greater than five percent. B Skywalks should have a minimum of sixteen and one-half feet clearance above the existing street grade in the center lane, and a minimum of fifteen feet clearance above the street pavement at the curb and over alleys. 4 Ramps -- Malls and Walkways. A. Ramps within the skywalk structure should be distributed continuously, uniformly, and symmetrically at an incline not exceeding one foot vertically for every twelve feet of horizontal distance (approximately eight and three tenths percent) There should be no steps within a skywalk structure or in walkways associated with skywalks B. Malls and walkways continuing from skywalks through buildings shall be maintained reasonably clear of obstructions so as to permit the skywalk system to effectively function in accordance with its purpose, to move pedestrian traffic rapidly 111 within congested areas of the city. 5 Signs -- Lighting. A. No advertising, readerboards, or other signs, except City traffic signs, shall be permitted on the internal or external portions of the skywalk structures Distinct internal directional signs designating routes within the skywalk system may be permitted, and such signing indicating routes to street access shall be provided at all vertical accesses. Decorations for holiday, seasonal, and civic events may be placed on skywalk structures, on a temporary basis, subject to the prior written approval of the director of public works. B. Skywalks must have inconspicuous, nonglare, internal lighting, and where necessary for pedestrian safety and convenience, inconspicuous external lighting C Signs located on or facing on the sidewalk indicating the direction to and location of skywalk entrances shall conform to guidelines established by the City and shall meet the following criteria 1. Skywalk entrance direction signs on sidewalks or placed on a structure fronting on the sidewalk should be reasonably standardized and uniform throughout the downtown area. 2. The signs should not be a safety hazard or unduly restrict pedestrian % movement. 3. The signs should be aesthetically pleasing and complementary with existing street furniture 4 Signs should be simple, readable, and contain no advertising 5. The costs of the sign except City traffic signs, and associated maintenance shall be borne by the property owners. 6. Street Access. Consideration should be made for skywalks to have adequate pedestrian access to and from the street level, such access to be available at, at least, one of the termini points of each skywalk. 7. Limitation on Permits A. No more than one permit for a pedestrian skywalk should be granted in any one block of street frontage In cases of unusually long blocks, or unusual property or physical problems, two skywalks may be permitted so long as their combined width does not exceed ten percent of the length of the block. B Structures other than skywalks spanning public streets shall not preclude a pedestrian skywalk in the same block and such structures shall not be calculated in the ten percent limitation set forth hereinabove In each case, the application review shall carefully evaluate the need for an additional structure across such street and the location of the proposed pedestrian skywalk in relation to the existing structure with the intent of keeping the structures spanning the street to the minimum number necessary for a successful pedestrian skywalk system. 8. INSPECTIONS Periodical inspections by a registered structural engineer will be required in accordance with Local, State or Federal Regulations. 111 EXCERPT FROM DECEMBER 12, 1989 YAKIMA CITY COUNCIL MINUTES 16. CONSIDERATION OF Pd ORDINANCE ESTABLISHING STANDARDS. FOR SKYBRIDGES Council member Barnett pointed out that this proposed ordinance on the skybridges does not comply with the Hearing Examiner's process and asked if it could be re-written to incorporate that process. Mr. Skone indicated the ordinance was prepared by Preston Thorgrimson's office, however, it can be rewritten if that is Council's desire. It was MOVED BY FOY, SECONDED BY BEAUCHAMP, THAT THE ORDINANCE BE REWRITTEN TO CONFORM TO THE HEARING EXAMINER'S PROCESS. The motion carried by a unanimous voice vote. 0
