AN ORDINANCE amending the 1990 budget for the City of Yakima, making an
appropriation of $10,000 in the Arterial Street Fund for
expenditure during 1990 for installation of property protective
barriers in the Lincoln/Pierce intersection area.
WHEREAS, the amount of $10,000 must be appropriated within the Arterial
Street Fund in order to provide funding for the installation of property protective
barriers in the Lincoln/Pierce Intersection area, and
WHEREAS, at the time of the adoption of the 1990 budget it could not
reasonably have been foreseen that the appropriation provided for herein would be
required, and the City Council finds that an emergency exists of the type contemplated
by RCW 35 33.091 and that it is in the best interests of the City to make the transfers
and appropriations herein provided, now, therefore,
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section L The amount of $10,000 is hereby appropriated from the
41, Unappropriated Fund Balance in the Arterial Street Fund to account number
142 142.528 1420 595 12-650 as a 1990 appropriation.
Section 2. This ordinance is one making an appropriation and shall take
effect immediately upon its passage, approval and publication as provided by law and
by the City Charter

SUMMARY EXPLANATION
The Engineering Division and Traffic Division have been approached by several residents in the
Pierce- Lincoln -B couplet area. They are aware of the concrete median barrier placed to protect
the Freeland property at 201 No 7th Avenue The residents, Mr and Mrs Williams and Mr Carl
Rizzo, are requesting similar protection They both have had their property damaged on several
occasions by out -of- control vehicles traveling the Lincoln/Pierce area of the couplet.
The Engineering Division and Traffic Division have previously responded to the Williams and
Carl Rizzo written requests for property protection Service Request #188 and #276 are
attached for Council information.

The Engineering Division prepared a plan to address the Williams and Rizzo concerns.'
The cost for the improvements to the Uncoln/Pierce area to protect the Williams' property
and address their handicap access problems was estimated at approximately $15,000
Of this amount, approximately $3,000 was for property protection and $12,000 was for
handicap accessibility The $15,000 was presented in the 1990 budget, page 437, for
Council consideration Council did not act on the issue because of limited financial
resources with which to address more pressing street improvement needs.
The cost of improvements to the Lincoln/Pierce area to protect the Rizzo properties is
estimated to cost approximately $7,000. This cost was not considered in the 1990 budget
because Carl Rizzo did not pursue his request until after the 1990 budget was adopted.
The configuration of the roadway section in the Lincoln/Pierce area, together with weather
conditions and driver habits are attributing to higher than normal incidence of property
damage by out of control vehicles. A question of the City's liability is raised by the
Williams and Carl Rizzo as to the adequacy of the street design. Staff believes there is
some associated liability in the intersection design and suggests as an interim measure,
until reevaluation of the intersection design can be done, that the property protective
barriers be installed in the intersection area in question.
If the Williams' income level is low enough they may qualify for a loan from CBDG funds to
address their handicap accessibility problems. Staff will be working with the Williams and
the Housing Division to determine if financial loan assistance is available to them 11 a
loan is possible trom CBDG funds and is utilized by the Williams, staff will also be
proposing YMC revisions to accommodate the handicap loading zone that would be
required.
The current unobligated cash reserve of 1/20 gas tax monies in the Arterial Street Fund
(142 Fund) is estimated to be $118,000 by year -end 1990 It is recommended that
$10,000 be appropriated from the 142 Fund for installation of property protective barriers
as depicted on the accompanying map.

Mr. Rizzo contacted the City Planaser's office to uplain of a traffic heard
exists at Pierce Ave/Lincoln couplet intersection. There has been an accident at
tho Yakima Adjustment Service bulld-ng (605 W. Lincoln) and care frequently go over
the c'rb by M Rizzo's business (Carl's Barber Shop, 610 W. Lincoln). He is
rc,cpesting both a short term and long term solution to this problem. He would like t
see an iworim solution of installation of additional curbing or barriers along the
of the corner until a change in the intersection can be node. Raise review
make an assessment of expenses for an interim solution to the problem. The long

Dear Carl:
The City Manager has referred your letter to me to respond to. First,
1 want to respond to your 1/23/90 lettef request to place a barrier
on city right -of -way to protect your property. The City of Yakima
cannot agree to construction of the barrier you proposed on public
right -of -way with the City assuming all liability for it. U you want to
construct your proposed barrier you must acquire City of Yakima
approval to do so and will be required to assume any liability
associated with the barrier. Second, your concerns and that of the
Williams will be presented to the Yakima City Council on March 20th,
1990. At that time 1 will present the attached plan 1 previously
shared with you. At that time 1 will be requesting the money to
implement the plan. 1 anticipate the plan improvements can be in
place by mid 1990.

Dear Sir,
I have the property at Pierce and West Lincoln Avenue.
I have had four trucks hit on my proerty because of this
poorly designed corner My insurance is going to cancel
the uninsured motorist portion of my policy They say
this corner is a hazard unless I do something about it
I have also had three buildings hit several times. I
have been repairing them myself as my other insurance
company has complained about the number of accidents that
have occurred and I am afraid they will cancel me also.
I would like to pour a curbing on city easement about
60' long, 12" high and 16" wide to try and passify the

insurance company until the city can put in concrete
abutments around the corner the same way they did on
Pierce Avenue and B Street.
I would also like to be relieved of all responsibility
for the curb that I pour on city property

Action Taken
Mike Donahue, Traffic Engr. and Al Rose and Dennis Covell of the Engr. & Utilities Dept
have talked with Mr & Mrs. Williams on several occasions in the last two months to
discuss their concerns about traffic safety in Pierce/B couplet area.
The attached memo and map outline a proposed solution for the Williams concerns.
The cost of the proposal is approximately $15-20,000. This cost could be covered
by a 1/2c gas tax fund appropriation.
It is recormended this request be referred to Council for consideration tt the
W2V, 7t4, 1989 budget hearing on capital project funding.

The atached drawing is a proposed solution for the problem that
Mr. & Mrs. Williams perceive at their location. It reflects much
of what they wanted to see based upon our conversation with them
at their home on Sept. 22, 1989 and my conversation with Mrs.
Williams on October 2, 1989.
The Williams have a large two bay carport adjacent to their
garage. The combined width of these two structures is over 40
feet. The carport houses one of their automobiles and a 20';
motor home. Mrs. Williams has expressed a strong desire to be
able to utilize both structures fully and she needs to be able to
easily access parking adjacent to their residence from these
structures. Adjacent to the garage is a 20' alley right-of-way
with corresponding approach off Pierce Avenue. The existing
right -of -way for Pierce Ave. is 30' for both the west half and
the east half.
At the present time City code prohibits parking between the curb
and property line along Pierce Avenue since Pierce Ave. is a
principle arterial (Ch. 8.66). Additionally City code specifies
maximum widths for residential driveways as 12 feet for single
driveways and 20 feet for double driveways (Ch. 8.64). This same
code permits the merger of a driveway approach with an alley ap-
proach when the two approaches are within 5 feet of each other.
However the maximum width for the combination is 40 feet.
The attached proposal would require a variance from the above
mentioned chapters of the City code. It would create a safer
condition for the Williams. Mr. Williams is wheelchair bound and
requires quite a lot of assistance in exiting their vehicles.
They are an elderly couple with some health problems beyond that
requiring the wheelchair. They are, however, quite active and
able to get around quite well, but because of the changes made
for Pierce Ave., Lincoln to "B" Street in 1975 they have
encountered some hardship. This proposal would amend the alley
approach, shift the curb and sidewalk toward the right -of -way 8
feet, provide a 40' driveway approach and a disabled loading area

accessible from the garage and carport. The indented strip would
provide protection for a vehicle from the high volume of traffic
passing by the location. The primary access to the residence is
from Pierce Ave. via a wheelchair ramp to the front porch. If
the ramp were to be moved to the Jefferson Ave. side it would be
too steep for either Mr. Williams or his wife to be able to
maneuver up to the entry. Because of this particular problem the
location of all access points along Pierce Ave. seems prudent.
In addition to the curbing modifications the proposal also in-
cludes concrete barriers strategically located to help keep
vehicles within the roadway areas should they go out of control.
At the alley side of the Williams' garage 4 concrete filled pipe
barriers are proposed to try and prevent future damage to the
garage. The safety aspect of these barriers should be explored
if there is any quettions from the Traffic Division. The
Williams have had their garage damaged on at least two different
occasions and have expressed a concern with this aspect of the
total problem.
The cost for the proposal as shown would be in the range of
$15,000 to $20,000.

Our garage and contents have had extensive damage two times and
numerous vehicles have gone through our yard. The vehicles
causing the damage or which came across our property were
traveling East on West Lincoln from North 16th Avenue and could
not make the curve - hitting the island and losing control.
The traffic going west on West Lincoln turn onto North Pierce -
crash into traffic going east on West Lincoln. A stop sign
should be placed there in place of the yield sign for westbound
traffic.
Harriers need to be placed on both sides of street at West
Lincoln and North Pierce to alley.
Three heavy pole barriers, five feet apart are needed on the
north side of garage in alley between West Lincoln and Jefferson
Avenue.
Need handicapped loading zone (between sidewalk and curb) and
ZONE coding change along West side of North Pierce from Jefferson
to alley between Jefferson and West Lincoln to allow for the
handicapped loading zone.
It is requested that favorable consideration be given to the
above needs in order to correct the safety hazards presently
existing.
