AN ORDINANCE relating to licenses and business regulation;
regulating the painting of lot, business block or
house number on curbs, partially exempting curb
number painting from business license tax; ex-
empting such activity from the ban on door-to-
door solicitation, enacting Subsection 5.56.050D
and Section 8.52.070 as a new subsection and
section and amending Section 5.52.050 all of the
City of Yakima Municipal Code.
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1: Subsection 5.56.050D of the City of Yakima
Municipal rode is hereby enacted as a new subsection to read
as follol,s

D. Painting curb numbers. The provisions of this chap-
ter shall not apply to persons who are the holder of a
%alid permit under the provisions of Section 8.52.070 of
the City of Yakima Municipal Code when engaged in ped-
dling or street selling of the services of curb number
painting."
leak Section 2: Section 5.52.050 of the City of Yakima Muni-
cipal Code is hereby amended to read as follows:
"5.52.050 Exemptions.
The provisions of this chapter shall not apply to
(-) Any person in respect to engaging in any of the
following enumerated business activities: franchised
electric powcr, telephone, gas and passenger transporta-
tion companies,
(1') Fraternal benefit societies as defined by Section
41.36.010 of the Revised Code of Washington, fraternal
mutual property insurers as defined by Section 48.36.410
of the Revised Code of Washington, and nonprofit corpora-
tions organized under or existing by virtue of Chapter
24.03 of the Revised Code of Washington if such nonprofit
corporations provide in their bylaws for the assessment
of each member of a fixed sum to be held by the corpora-
tion to be paid as death benefits on the death of a mem-
ber for the purpose of assisting widows, orphans or other
persons dependent on a deceased member;
(c) Any religious society, association or corpora-
tion, through the operation of any hospital, clinic,
resort or other institution devoted exclusively to the
care of healing of human beings; provided, that no exemp-
tion is granted where the income therefrom inures to the

benefit of any physician, surgeon, stockholder or indi-
\idual by virtue of ownership or control of such hospi-
tal, clinic, resort or other institution,
(d) Private detective agencies licensed under Chapter
5 62;
(e) Merchant patrolmen licensed under Chapter 5.48;
(f) Auctioneers licensed under Chapter 5.14;
(g) Merry-go-rounds licensed under Chapter 5.02;
(h) Any instrumentality of the United States, State
of Washington, or political subdivision thereof;
(1) Any farmer, gardener or other person who sells,
delivers or peddles any fruits, vegetables, berries,
butter, eggs, fish, milk, poultry, meats, or any farm
product or edibles raised, caught, produced or manufac-
tured by such person within the State of Washington;
(j) Any person, who is the holder of a valid permit
under Section 8.52.070 of the City of Yakima Municipal
Code, engaged in the business of curb number painting and
wh) devotes no more than six hundred hours per year to
said business;
(k) Newsboys engaged in the sale or delivery of news-
papers and magazines or periodicals to the reading pub-
lic,
(1) An blind person engaged in business activities
in the citx,
(m) Any person, firm or corporation which the city is
prohibited from taxing under the laws of the United
States or of the State of Washington,
(n) Any person operating a business as a whole pro-
prietorship without full or part time employees who de-
\otes less than six hundred hours a year to said
business."
Section_____ 3 Section 8.52.070 of the City of Yakima Muni-
cipA Code is hereby enacted as a new section to read as fol-
lows
8.52.070 Curb number painting.
A. It is unlawful for any person to engage in the busi-
nPss of painting lot, business block or house numbers on
a curb without obtaining a valid permit to do so under
the terms of this section.
B. The Code Administration Manager shall issue a permit
without charge, to any person who desires to engage in
the business of painting lot, business block or house
numbers on curbs and who fills out an application. The
application shall contain the name, address, physical de-
scription, date of birth, and recent photograph of the
applicant. The permit shall be valid for six months from
the date of issuance.
C. Regulations.
(1) All curb numbering shall conform to the numbering

scheme adopted in this chapter.
(2) All curb numbering shall be three inches tall, in
Mock letter form and stenciled. Numbers shall be
painted in black on a white rectangular pre-painted back-
ground.
(3) Paint shall be applied only by brush or roller.
Spray painting is prohibited.
(4) Paint shall be applied only during daylight
huurs.
(5) The City shall not be responsible for wear and
tear on curb numbers caused by snow removal, street
cleaning and repairs.
(6) The Code Administration Manager may make such
additional rules and regulations which are necessary to
carry out the purpose of this chapter.
D. The Code Administration Manager may, upon written
notice to the permittee, revoke any permit granted under
this section for 'iolation of a provision of this chap-
ter. The permittee may appeal such revocation by filing
d written appeal, stating the grounds for appeal, with
the City Manager within five days of receipt of the revo-
cation After written notice to the Appellant, the Cit■
Nonacler or his designee shall hold an informal hearing to
determine whether the permit should be reinstated or
re■oked."
Section 4 This ordinance shdll be in full force and
f,fect 30 days after its passage, approval, and publication as
pro‘ided h■ law and b‘ the City Charter.
