AN ORDINANCE relating to administration, establishing by ordinance the Yakima Arts
Commission, describing the responsibilities and duties of the Commission,
the membership of the commission and the appointed commission
members terms of service on the commission; and adding YMC 1.36 as a
new chapter of the Yakima Municipal Code.
Section 1. A new chapter 1.36 of the City of Yakima Municipal Code is hereby added to read
as follows:

YAKIMA ARTS COMMISSION
Sections:
1.36.010 Establishment and Mission.

1.36.010 Establishment and Mission. The Yakima Arts Commission shall
report to the Yakima City Council or a designated subcommittee of the Council,
The Yakima Arts Commission shall work to enhance the cultural and aesthetic
quality of life in the City of Yakima by actively pursuinq the placement of public art in
public spaces and by actively seeking to expand public access to visual and
performing arts.
1.36.020 Duties. The duties of the Yakima Arts Commission shall include, but
shall not be limited to:
A. Encouraging public art, establishing procedures for selection and approval of
art pieces, suggesting placement of public art and arranging for ongoing
maintenance of public art in public places throughout the City of Yakima,
B. Advise and assist city departments, commissions, and committees, as well as
the City Council, regarding artistic components of all municipal government projects
under consideration by the city. The Commission may also serve as a resource for
artistic components of land use developments;
C. Develop relationships with existing organizations and community groups
having a stake and interest in good building and public space design and
development;
D. Encourage connections with regional, state, and national organizations with an
interest in art, artistic values, and similar goals;
E. Pursue gifts and grants available to the City of Yakima for the purposes of
cultural and artistic activities and enhancements of public spaces in the City of
Yakima;
F. Promote and engage in activities that enrich the lives of the City of Yakima's
residents through artistic education and expression;
G. Work with existing arts organizations, communt( groups, and artists in the
delivery of programs and activities as well as assist in fostering collaboration and
stability; and,
H. Serve as a voluntary advisory resource for the aesthetic review of _private
development.
1.36.030 Membership and terms of service. The Yakima Arts Commission
shall have no less than thirteen (13) and no more than fifteen (15) members
comprised as follows:
A. Two working artists ("working artist" shall be a person who has had their works
of art exhibited in professional gallery spaces and/or has had their work included in
professionally luried exhibitions or permanent collections);
B. Four to six community members. The community members shall be from
diverse backgrounds and shall have no vested interest in any particular art or
cultural endeavor;
C. Six persons each of whom represent one of the following six professionally
staffed local arts organizations — The Yakima Symphony Orchestra, The Capitol
Theatre, Allied Arts of Yakima Valley, the Seasons Music Festival, the Larson
Gallery, and the Yakima Valley Museum;
D. One member of the Yakima City Council.
All members shall be appointed by the Yakima City Council. The initial
Commission members shall serve staggered terms. One-third of the initial total
membership shall be appointed for an eighteen (18) month term, one-third shall be
appointed for a thirty (30) month term, and one-third shall be appointed for a forty-
two (42) month term. Thereafter, appointed members shall each serve a four (4)
Year term, with each term ending on June 30 of its termination year. No member
shall serve for more than two (2) four (4) year terms.
Section 2. If any section, subsection, paragraph, sentence, clause or phrase of this ordinance is
declared invalid or unconstitutional for any reason, such decision shall not affect the validity of
the remaining portions of this ordinance.
Section 3., This ordinance shall be in full force and effect 30 days after its passage,
approval, and publication as provided by law and by the City Charter.

ITEM TITLE: An Ordinance establishing the Yakima Arts Commission, describing the
responsibilities and duties of the Commission, the membership of the
commission and the appointed commission member's terms of service on the

SUMMARY EXPLANATION:
On December 1, 2009, the Yakima City Council adopted Resolution R-2009-166, which was
intended to establish the Yakima Arts Commission and the duties and responsibilities of the
Arts Commission.
However, in order to include the Arts Commission within the structure of the City's code, it is
necessary to memorialize it in ordinance form. The establishment and mission of the
Commission, its duties, membership and terms of service in the ordinance are the same as
were specified in the resolution.
This action will add the Yakima Arts Commission to the Yakima Municipal Code as YMC
Chapter 1.36.
