4 II IIIIllhIIIIIIIIIIIIIll *7709594 14* FILE# 7709594 YAKIMA COUNTY, WA 11/04/2010 02 18 OOPM ORDINANCE PAGES 14 CITY OF YAKIMA PLANNING Recording Fee 75 00 November 4, 2010 Return To Yakima City Clerk 129 North Second Street Yakima, WA 98901 Document Title Ordinance No. 2010 -45 2010 Text Amendment to the 2025 Comprehensive Plan Grantor City of Yakima Grantee The Public ABBREVIATED DESCRIPTION Ordinance concerning comprehensive planning and amending Chapter 3 of the City of Yakima's Urban Area Comprehensive Plan 2025 PARCEL NUMBERS Not applicable This is a regulatory policy ORDINANCE NO 2010 -45 AN ORDINANCE concerning comprehensive planning and amending Chapter 3 of the City of Yakima's Urban Area Comprehensive Plan 2025 WHEREAS, the Washington State Growth Management Act (GMA) requires counties and cities to prepare Tong -range comprehensive plans pursuant to Ch 36 70A RCW and related laws and regulations, and WHEREAS, RCW 36 70A.130 provides for continuing review and evaluation of comprehensive plans and development regulations at least every seven years and for the revision or amendments to such plans not more than once a year but at least once every seven years, with certain exceptions, and WHEREAS, RCW 36 70A.470 requires that counties and cities planning under RCW 36 70A.040 include in their development regulations a procedure for any interested person, including applicants, citizens, hearing examiners, and staff of other agencies, to suggest comprehensive plan or development regulation amendments, and WHEREAS, RCW Ch 36 70A further requires that the suggested amendments be docketed and considered not more often than once a year, consistent with the provisions of RCW 36 70A.130; and WHEREAS, on March 18, 2003, the City Council enacted Ch 16 10 YMC to provide procedures and criteria for amending and updating the Yakima Urban Area Comprehensive Plan, and WHEREAS, On July 2, 2009, the City of Yakima Planning Department submitted a Comprehensive Plan text amendment application, amending portions of chapter 3 Land Use, and WHEREAS, the City of Yakima Planning Department submitted a State Environmental Policy Act (SEPA) Checklist on April 30, 2010; and WHEREAS, pursuant to the State Environmental Policy Act (SEPA) WAC 197- 11 and YMC 6 88, and prior to the Commission's hearing, the City issued a Final Determination of Non - significance (DNS) and Incorporation by Reference on the proposed Comprehensive Plan text amendment on July 20, 2010, and the appeal period ended on August 3, 2010, and WHEREAS, in accordance with YMC Chapter 1610, the City Planning Commission held appropriate meetings and hearings to review and consider the requested Urban Area Comprehensive Plan amendments, and WHEREAS, pursuant to YMC 16 10 080 and the approval criteria set forth in YMC 16 10 040, the City Planning Commission made a recommendation to a joint 1 meeting of the City Council and Yakima County Commissioners that the requested Urban Area Comprehensive Plan and amendments described above be approved, and WHEREAS, pursuant to YMC 16 10 090, on November 2, 2010, a public hearing regarding the requested Urban Area Comprehensive Plan amendments described above was held, and City Council directed City staff to prepare appropriate legislation to approve the requested amendments, and WHEREAS, it is in the best interests of the City to enact the following to approve the requested Urban Area Comprehensive Plan amendments described above, now, therefore BE IT ORDAINED BY THE CITY OF YAKIMA. Section 1 Findings, Analysis, and Conclusions. Subject to the specific terms of this ordinance, the Yakima City Council adopts the City Planning Commission's September 8, 2010, Findings of Fact, Conclusions and Recommendations regarding City of Yakima's 2010 Comprehensive Plan Text Amendment, City File# CPA #009 -10 A copy of said recommendations is attached as Exhibit "A ", and is incorporated herein by this reference Regarding CPA #009 -10, the City Council finds as follows 1 The requested Urban Area Comprehensive Plan text amendment appropriately updates Chapter 3 Land Use to include a Removal of outdated Future Land Use Designations from Chapter III, and Table III -11, which include Large Convenience Center, Arterial Commercial, and Wholesale/Warehouse, b Addition of the new Future Land Use Map designations General Commercial, Regional Commercial, and Airport Support zoning district to the text and tables of Chapter III -Land Use of the City's 2025 Comprehensive Plan, c. Expansion of the allowed zoning designations within Table III -11 for the Professional Office, Neighborhood Commercial, Community Commercial, Regional Commercial, and I ndustrial Future Land Use Map designations, and d Removal of the Planned Development zoning designations, and Institutional Future Land Use designation 2 The proposed City of Yakima's Urban Area Comprehensive Plan text amendments are consistent with, and update the goals and policies of the Urban Area Comprehensive Plan 2025, 3 The proposed Yakima Urban Area Comprehensive Plan text amendments meet the requirements and considerations set forth in Yakima Municipal Code Chapter 16 10, and the Growth Management Act, RCW Chapter 37 70A, and the Yakima County Wide Planning Policy (CWPP), 4 Environmental review of the requested amendments was done according to the provisions and procedures of the State Environmental Policy Act (SEPA) WAC 197 -11 and YMC 6 88 A Determination of Non - Significance (DNS) for the proposed amendments was issued on July 20, 2010 and the appeal period ended on August 3, 2010; and 2 5 The cumulative impacts of this request together with all previous Comprehensive Plan Amendments have been considered and support the requested amendment. Section 2. Revision of Sections of Existing Comprehensive and Transportation Plans. The Yakima Urban Area Comprehensive Plan 2025, and adopting ordinance #2006 -62 are hereby amended to revise the text, policies, and related provisions of the specific sections as identified in the City of Yakima 2010 Comprehensive Plan Text Amendment . document set forth in Exhibit "B" attached hereto, and incorporated herein by this reference, as if set forth in full Section 3. Amendments to Replace and Supersede. The Yakima Urban Area Comprehensive Plan 2025 is amended by these changes and all such changes are intended to replace and supersede all relevant sections of the existing Comprehensive Plan Section 4. Transmittal to State. Pursuant to RCW 36 70A.106, this Ordinance shall be transmitted to the Washington Department of Commerce as required by law Section 5. Preparation of Final Comprehensive Plan Document. City staff are hereby directed to complete a final addendum document including all adopted changes to the City of Yakima's Urban Area Comprehensive Plan 2025, correction of any typographical edits and inclusion of appropriate graphics and illustrations, consistent with the attached amendments Section 6. Validity. If any section, subsection, paragraph, sentence, clause or phrase of this ordinance is declared invalid or unconstitutional for any reason, such decision shall not affect the validity of the remaining portions of this ordinance Section 7 Ratification. Any act consistent with the authority, and prior to the effective date of this ordinance is hereby ratified and affirmed Section 8. Authorization to File. The City Clerk is hereby authorized and directed to file a certified copy of this ordinance with the Yakima County Auditor Section 9 Effective Date. INDEX Exhibit "A" CITY OF YAKIMA PLANNING COMMISSION FINDINGS OF FACT, PROPOSED AMENDMENT, REVIEW RATIONALE, CONCLUSION AND REASON FOR ACTION, AND RECOMMENDATION AND ACTION TAKEN City of Yakima 2010 Comprehensive Plan Text Amendment September 8, 2010 WHEREAS, the City of Yakima, hereafter referred to as the "City" pursuant to RCW 36 70A.040 is required to plan under the provisions of the Growth Management Act, and WHEREAS, pursuant to RCW 36 70A.130(1) the City is required to take legislative action to review and revise its comprehensive plan and development regulations m accordance with the Growth Management Act, and WHEREAS pursuant to RCW 36 70A.020, goals are set forth to guide the development and adoption of comprehensive plans and adoption of development regulations, and 1. WHEREAS, On December 12, 2006 the City of Yakima adopted by ordinance 2006 -62 the Yakima Urban Area Comprehensive Plan 2025 as required by the Growth Management Act, and WHEREAS, prior to April 30, 2010, the City of Yakima Planning Division reviewed the text and tables of its 2025 Comprehensive Plan, and 2010 Urban Area Zoning Ordinance and identified the need to update certain sections of the Urban Area Comprehensive Plan's Land Use chapter to make it consistent with the City's Urban Area Zoning Ordinance, and WHEREAS, On Apnl 30, 2010, the City submitted a Comprehensive Plan text amendment application, to amend the Yakima Urban Area Comprehensive Plan (YUACP) 2025 and incorporate new information into the City's 2025 YUACP's Land Use chapter; and WHEREAS, the City prepared a State Environmental Policy Act (SEPA) Checklist on April 30, 2010 , and DOC INDEX y I WHEREAS, pursuant to RCW 36 70A, and YMC 15 23 020, the City of Yakima Planning Commission, hereafter referred to as the "Commission," is authorized to make a recommendation to the Yakima City Council, hereafter referred to as the "Council" for their review, consideration, and adoption of Comprehensive Plan Amendments, and WHEREAS, pursuant to City Ordinance #2004 -14 and RCW 36 70A 130 (2) the City of Yakima followed its adopted public participation program, which included the following 1 Twenty days of public comment starting June 24, 2010 and ending on July 19, 2010, 2 Posting on the City of Yakima's web site of the draft Comprehensive on June 24, 2010, and 3 Published notice in a local newspaper of general circulation, issued a press release to local media, and posted notices at the Planning Division and City Clerk's offices on June 24, 2010, and WHEREAS, pursuant to RCW 36 70A.106 notice of all amendments to the City's Comprehensive Plan and development regulations were sent to the Washington State Department of Commerce at least sixty days prior to the amendments being considered for adoption, and WHEREAS, pursuant to the State Environmental Policy Act (SEPA) WAC 197 -11 and YMC 6 88, and prior to the Commission's hearing, the City issued a Final Determination of Non - significance (DNS) and Incorporation by Reference on the proposed Comprehensive amendments on July 20, 2010, and the appeal period ended on August 3, 2010 WHEREAS, A public hearing notice regarding these proposed amendments was published in a local newspaper of record on June 24, 2010, and WHEREAS, said hearing occurred on August 4, 2010, where all persons desiring to comment on the proposed amendments were given a full and complete opportunity to be heard, and WHEREAS, the Commission following public comment and deliberation reviewed and revised staff's recommended amendments, and those proposed revisions were approved by staff, and THEREFORE, the Commission is now satisfied that these proposed amendments to Table III -11, and the associated text of Chapter 3 of the YUACP have been sufficiently considered, and hereby makes and enters the following I PROPOSED AMENDMENT, REVIEW RATIONALE, AND FINDINGS OF FACT Amendment to City of Yakima 2025 Urban Area Comprehensive Plan (UACP) PROPOSED AMENDMENT 1 Removal of outdated Future Land Use Designations from Chapter III, and Table III -11, which include Large Convenience Center, Arterial Commercial, and Wholesale /Warehouse, DOC. INDEX # AA Z 2 Addition of the new Future Land Use Map designations General Commercial, Regional Commercial, and Airport Support zoning district to the text and tables of Chapter III -Land Use of the City's 2025 Comprehensive Plan, 3 Expansion of the allowed zoning designations within Table III -11 for the Professional Office, Neighborhood Commercial, Community Commercial, Regional Commercial, and Industrial Future Land Use Map designations, and 4 Removal of the Planned Development zoning designations, and Institutional Future Land Use designation. REVIEW RATIONALE The City's Yakima Urban Area Comprehensive Plan 2025 was last updated in December of 2006 At that time numerous changes were made to the Land Use chapter Some of the proposed changes identified that various definitions or portions of the Land Use chapter were to be removed, modified, or replaced in a future update Prior to the close of the 2010 Comprehensive Plan amendment period the Planning staff had intended to institute the needed updates during the state's mandated 2013 Comprehensive Plan update process However, following the receipt of several of this year's Comprehensive Plan Map Amendment applications it became readily apparent that certain requested zoning designations could not be supported by a corresponding Future Land Use designation In addition, and perhaps more importantly, Table III -11 Future Land Use and Current Zoning Comparison did not yet include the new 2008 adopted zoning designations It had numerous old zoning and future land use map designations that were identified for removal, and did not provide adequate zoning designations to support increased commercial and industrial activities Therefore, the Planning staff has prepared the draft update to the Land Use chapter of Comprehensive Plan 2025 which incorporated the appropriate amendments to the herein identified Future Land Use and Zoning designations During the Planning Commission's August 4, 2010, hearing on the proposed amendments, the commission held a general discussion on the proposed amendments, and took public testimony The public testimony consisted of a letter and comments from the Yakima County Planning Department represented by Project Planner, Phil Hoge which identified the below mentioned items 1 A Question whether the "Institutions" plan designation was an overlay district or future land use designation, 2 A Question whether the "Mixed Use Plan Development (MU -PD)" is a future land use map designation or a zoning district, and questioning whether it should be removed from the comprehensive plan, and 3 Concern over whether expansion of the implementing zoning districts of the Community Commercial, CBD, Professional Office, and Neighborhood Commercial Future Land Use Map designations provide for proper implementation through planning Findings of Fact by the City of Yakima Planning Comnussion regarding City of Yakima 2010 Comprehensi' e Plan Text Amendments 3 DOC. INDEX In response to the above raised questions the Planning Commission requested that the City Planning Department prepare a formal response to the County's questions which were considered at the August 4 and 11` meetings The City's response was as follows 1 The City concurred with the County's comment that the institutional designation is in reality an overlay rather than an implementing zone and was recommended to be eliminated from the chart without consequence, 2 The four Planned Development zoning categories are not affected by their future land use designations - their creation is governed by zoning alone - so the PD's were removed from Table III -11, 3 The City agreed with the County's suggestion that the Professional Office land use category not be considered as implementing a zoning change to SCC and the category was removed as an implementing zone, 4 The City did not concur with the county that the SCC zoning district is inconsistent with the Future Land Use Designation of Neighborhood Commercial, and recommended that the SCC zoning district remain as submitted, 5 The City recommended that the General Commercial zoning district be removed as an implementing zoning category to the Community Commercial Future Land Use designation, and 6 No additional changes were recommended to the Community Commercial or CBD Future Land Use implementing zones FINDINGS OF FACT The Commission held the required public hearing on August 4, 2010, and held further discussion on the proposed amendments at its August 11, 2010, at which time the Commission made the following findings 1 The Future Land Use Map Designation for General Commercial is identical in name to its companion zoning district, and is recommended to be renamed during the City of Yakima's next Comprehensive Plan update cycle, 2 The Commission agrees with the proposed changes to Chapter III Land Use of the City of Yakima's Comprehensive Plan subject to the changes identified in the City of Yakima Planning Departments memo dated August 6, 2010, and Chapter III draft, 3 The parks and open space designation should be removed from the Future Land Use section as it is not a Future Land Use designation, and 4 The Commission recommended that the Institutional Overlay description be removed from the Future Land Use section of the YUACP, and placed under the zoning section of the YUACP, along with a corrected description. II CONCLUSIONS Findings of Fact by the City of Yakima Planning Commission regarding City of Yakima 2010 Comprehensive Plan Text Amendments 4 DOC. INDEX Having made the Findings set forth above, the Commission now makes the following conclusions 1 Environmental review of the requested amendments was done according to the provisions and procedures of the State Environmental Policy Act (SEPA) WAC 197 -11 and YMC 6 88 A Determination of Non - Significance (DNS) for the proposed amendments was issued on July 20, 2010, and the appeal period ended on August 3, 2010 2 The proposed changes to the City's Urban Area Comprehensive Plan 2025 are consistent with the requirements of the Growth Management Act (GMA), Ch. 36 70A RCW 3 The City followed the procedural requirements of the GMA to notify and advertise the proposed amendments to the City's Urban Area Comprehensive Plan 2025 to the public and to interested agencies, and all oral and wntten comments received during all respective processes have been considered. III RECOMMENDATION It is for the above reasons that the Commission recommends that Council adopt the City of Yakima's 2010 Comprehensive Plan Text Amendments to the City's Yakima Urban Area Comprehensive 2025 with a revision date of September 8, 2010, and further recommends that the Comprehensive Plan's Future Land Use Map Designation for General Commercial be renamed dunng the City's next Comprehensive Plan update Motion Based upon the findings and conclusions outlined above, it was moved and seconded that the City of Yakima Planning Commission recommends APPROVAL of the submitted Comprehensive Plan Text Amendments The motion was carved by a unanimous vote 6 f ) fip n Shoval, Chairma - Date akima Planning mrnission Findings of Fact by the City of Yakima Planning Commission regarding City of Yakima 2010 Comprehensive Plan Text Amendments 5 DOC. INDEX ;,, Exhibit B CHAPTER III - LAND USE FUTURE LAND USE DESIGNATIONS Following is a brief description of each designation on the Future Land Use Map Again, these are land use designations, not zoning districts For a zoning designation or district to be allowed on a piece of land, it must be compatible with these land use designations on the Future Land Use Map Conversely, once the FLUM is adopted, it can be assumed that zoning will be applied that results in land being developed as described in the following The relationship between the FLUM and Zoning Map is described on Table 111- 11 Future Land Use and Current Zoning Comparison Low Density Residential Primarily free standing single - family residences Residential density is Tess than 7 0 dwelling units per acre This is considered the lowest possible residential density that can efficiently support public services Medium Density Residential Characterized by a mixture of single - family detached residences and duplexes, with a variety of other housing types at a residential density ranging between 7 0 and 11 0 dwelling units per acre High Density Residential Multi- family residential development may include apartments, condominiums and townhouses, containing 12 or more dwelling units per acre A limited range of other mixed land uses may be permitted, such as some professional offices and community services Professional Office A wide range of office uses, such as financial institutions, real estate, insurance, engineering, legal, medical offices and other similar business uses, specifically permitted by the applicable zoning district. Institutions Institutions include existing and new large -scale institutional facilities such as hospitals and higher educational facilities that may have significant impacts to the surrounding land uses. Institutions such as hospitals and higher education facilities play an important role in the community, providing needed health and educational services to the citizens of the community and region. Hospitals and higher educational facilities also provide major employment in the Yakima Urban Growth Area and contribute to the growth of Yakima's economy. However, when these institutions are located in or adjacent to residential or pedestrian oriented commercial areas, their activities and facilities can generate noise, traffic, and other effects that could be potentially incompatible with the surrounding land uses Other Yakima institutions that are smaller scale such as churches, schools, libraries, museums, public utilities and government buildings may not be designated as Institutions. These can be developed under the procedures established in the Yakima Urban Area Zoning Ordinance. It is anticipated that uses shown, as "institutions ", on the FLUM will be regulated under an "institutional Overlay (10)" zone. Designation of an 10 on the City's Zoning Map would occur only after approval of a detailed master site plan by the City following the public process, which includes public hearings. The site plan approval would include specific development standards that allow for appropriate growth and development of new or expanding institution, along with methods for mitigating identified impacts. The purpose of the Institutional Overlay designation is to identify specific institutions within the City of Yakima that would benefit from the Institutional Overlay master planning process, and have had prior Comprehensive Plan compatibility consideration taken into account through the adoption of the City' Comprehensive Plan. Uses shown, as "institutions ", on the FLUM underwent preliminarily review during the City of Yakima's 2006/2025 Comprehensive Plan update process by the Regional Planning Commission. Institutional uses shown on the FLUM are not subject to further review by the City of Yakima's Planning Commission provided the boundaries of the Institutional Overlay and Master Plan are substantially consistent with those identified on the City of Yakima's FLUM. Designation of the Institutional Overlay zone (10) on the City's Zoning Map will only occur after approval of a detailed master site plan through the master plan process as specified in the City of Yakima's Zoning Ordinance. The site plan approval would include specific development standards that allow for appropriate growth and development of new or expanding institutions, along with methods for mitigating identified impacts. Land uses which require high auto vi =ibility such as restaurants, service stations, car General Commercial (Alew -Category) General Commercial provides a wide variety of commercial retail and services that are heavily dependent on convenient vehicle access along major travel routes General Commercial land uses may include those uses identified in Neighborhood Commercial or Community Commercial, but do not serve only the adjacent neighborhoods General Commercial includes uses such as fast food restaurants, auto - oriented services and other DOC. YAKIMA URBAN AREA COMPREHENSIVE PLAN INDEX PAGE III -16 # AA-I CHAPTER III - LAND USE commercial services The City has designated these areas with the intent that each will be intensively developed within designated boundaries and that undesirable strip commercial development is avoided ( "Strip Commercial" development is usually described as commercial properties developed along a street in linear fashion (as opposed to the downtown or malls), where individual driveways, separated parking Tots, different building designs and access points, can lead to problems including traffic safety, shopper confusion, higher failure rates among businesses, poor aesthetics, etc ) Regional Commercial The Regional Commercial designation is intended to provide the community with a mix of retail, service and business establishments on a medium to large scale Commercial firms span a wide range of activities such as retail stores, business and professional services, hotel /motel operations, restaurants, theaters and gas stations Generally, regional commercial uses are the source of consumer goods and services for the community and the traveling public Their locational, market area and site requirements tend to be as diverse as the mix of activities In common, these firms are generally dependent upon visibility for customer attraction, and prefer locations with heavy traffic flows The typical size of a regional commercial development is 10 -60 acres and serves a population of 100,000- 200,000 people into more intensive uses in the core of the urban area. REVIEW RATIONALE The City's Yakima Urban Area Comprehensive Plan 2025 was last updated in December of 2006 At that time numerous changes were made to the Land Use chapter Some of the proposed changes identified that vanous defimtions or portions of the Land Use chapter were to be removed, modified, or replaced in a future update Prior to the close of the 2010 Comprehensive Plan amendment period the Planning staff had intended to institute the needed updates during the state's mandated 2013 Comprehensive Plan update process However, following the receipt of several of this year's Comprehensive Plan Map Amendment applications it became readily apparent that certain requested zoning designations could not be supported by a corresponding Future Land Use designation In addition, and perhaps more importantly, Table III -11 Future Land Use and Current Zoning 1 Companson did not yet include the new 2008 adopted zoning designations It had numerous old zoning and future land use map designations that were identified for removal, and did not provide adequate zoning designations to support increased commercial and industrial 1 activities Therefore, the Planning staff has prepared the draft update to the Land Use chapter of Comprehensive Plan 2025 which incorporated the appropriate amendments to the herein identified Future Land Use and Zoning designations 1 During the Planning Commission's August 4, 2010, hearing on the proposed amendments, the commission held a general discussion on the proposed amendments, and took public testimony The public testimony consisted of a letter and comments from the Yakima County Planning Department represented by Project Planner, Phil Hoge which identified the below mentioned items 1 A Question whether the "Institutions" plan designation was an overlay district or future land use designation, 2 A Question whether the "Mixed Use Plan Development (MU -PD)" is a future land use map designation or a zoning district, and questioning whether it should be removed from the comprehensive plan, and 3 Concern over whether expansion of the implementing zoning districts of the Community Commercial, CBD, Professional Office, and Neighborhood Commercial Future Land Use Map designations provide for proper implementation through planning 1 Findings of Fact by the City of Yakima Planning Commission regarding City of Yakima 2010 Comprehensive Plan Text Amendments 3 1 DOC. INDEX 1 1 ' In response to the above raised questions the Planning Commission requested that the City Planning Department prepare a formal response to the County's questions which were considered at the August 4 and 11 meetings The City's response was as follows ' 1 The City concurred with the County's comment that the institutional designation is in reality an overlay rather than an implementing zone and was recommended to be eliminated from the chart without consequence, ' 2 The four Planned Development zoning categories are not affected by their future land use designations - their creation is governed by zoning alone - so the PD's were removed from Table III -11, 3 The•City agreed with the County's suggestion that the Professional Office land use category not be considered as implementing a zoning change to SCC and the category ' was removed as an implementing zone, 4 The City did not concur with the county that the SCC zoning district is inconsistent with the Future Land Use Designation of Neighborhood Commercial, and recommended that the SCC zoning district remain as submitted, 5 The City recommended that the General Commercial zoning district be removed as an implementing zoning category to the Community Commercial Future Land Use designation, and 6 No additional changes were recommended to the Community Commercial or CBD Future Land Use implementing zones ' FINDINGS OF FACT The Commission held the required public hearing on August 4, 2010, and held further discussion on the proposed amendments at its August 11, 2010, at which time the Commission made the following findings 1 The Future Land Use Map Designation for General Commercial is identical in name to its companion zoning district, and is recommended to be renamed during the City of Yakima's next Comprehensive Plan update cycle, 2 The Commission agrees with the proposed changes to Chapter III Land Use of the City of Yakima's Comprehensive Plan subject to the changes identified in the City of Yakima Planning Departments memo dated August 6, 2010, and Chapter ' III draft, 3 The parks and open space designation should be removed from the Future Land Use section as it is not a Future Land Use designation, and 4 The Commission recommended that the Institutional Overlay description be removed from the Future Land Use section of the YUACP, and placed under the ' zoning section of the YUACP, along with a corrected description. II. Institutions 1 Institutions include existing and new large -scale institutional facilities such as hospitals and higher educational facilities that may have significant impacts to the surrounding land I uses. Institutions such as hospitals and higher education facilities play an important role in the community, providing needed health and educational services to the citizens of the community and region. Hospitals and higher educational facilities also provide major - employment in the Yakima Urban Growth Area and contribute to the growth of Yakima's economy. However, when these institutions are located in or adjacent to residential or pedestrian oriented commercial areas, their activities and facilities can generate noise, traffic, and other effects that could be potentially incompatible with the surrounding land uses. Other Yakima institutions that are smaller scale such as churches, schools, libraries, 1 museums, public utilities and government buildings may not be designated as Institutions. These can be developed under the procedures established in the Yakima Urban Area Zoning Ordinance. It is anticipated that uses shown, as "institutions ", on the FLUM will be regulated under an "institutional Overlay (I0)" zone. Designation of an 10 on the City's Zoning Map would occur only after approval of a detailed master site plan by the City following the public process, which includes public hearings. The site plan approval would include specific development standards that allow for appropriate growth and development of new or expanding institution, along with methods for mitigating identified impacts. The purpose of the Institutional Overlay designation is to identify specific institutions within ' the City of Yakima that would benefit from the Institutional Overlay master planning process, and have had prior Comprehensive Plan compatibility consideration taken into account through the adoption of the City' Comprehensive Plan. Uses shown, as "institutions", on the FLUM underwent preliminarily review during the City of Yakima's 2006/2025 Comprehensive Plan update process by the Regional Planning Commission. Institutional uses shown on the FLUM are not subject to further review by the City of Yakima's Planning Commission provided the boundaries of the Institutional Overlay and Master Plan are substantially consistent with those identified on the City of Yakima's FLUM. Designation of the Institutional Overlay zone (10) on the City's Zoning Map will only occur after approval of a detailed master site plan through the master plan process as specified in the City of Yakima's Zoning Ordinance The site plan approval would include specific development standards that allow for appropriate growth and development of new or 1 expanding institutions, along with methods for mitigating identified impacts. Does your proposal address circumstances that have changed since the last time the relevant comprehensive plan map or text was considered? If so, how? Yes. 1. Since the City of Yakima's adoption of the Yakima Urban Area Comprehensive Plan 2025 in December of 2006 it has been identified in the plan that the Future Land Use Map designations for Large Convenience Center, Arterial Commercial, and Wholesale /Warehouse were to be removed in a future update. However, to this date the proposed update has not occurred causing confusion for the general public when submitting Comprehensive Plan Map amendments. 2. In addition to the elimination of the above Future Land Use Map Designations City staff has identified that Table III -11 Future Land Use and Current Zoning Comparison of the Yakima Urban Area Comprehensive Plan 2025 will also require removal of the above Future Land Use Map designations, the zoning designation for the Central Business District Support Zoning District requires renaming to General Commercial, and the Regional Commercial and Airport Support zoning districts are also required to be added to the table in accordance with the adoption of the City of Yakima's 2008 Urban Area Zoning Ordinance (Ord. # 2008 -46). 3. Finally, it was also identified that many of the Future Land Use designations in Table III -11 did not have appropriate corresponding zoning designations to support increased commercial and industrial development. Therefore, the Professional Office, Neighborhood Commercial, Community Commercial, Regional Commercial, and Industrial Future Land Use Map designations are proposed to be expanded as identified in the attached table. This memo presents the City Planning Staff's recommendations regarding 1 the County comments and other related changes to the subject table 1 To begin, we concur with the County's comment that the institutional designation is in reality ' an overlay rather than an implementing zone and that it can therefore be eliminated from the chart without consequence. 2. Similarly as noted in the County letter, the four Planned Development zoning categories are ' not affected by their future land use designations - their creation is governed by zoning alone - so PD's can also be removed from Table III -11, again, without consequence. ' 3. After careful review of the table, city staff also recommends that the HB, Historical Business designation be deleted from the Table. This recommendation is being made because the HB zone was never intended to be enlarged; in fact there is a zoning ordinance stricture against its expansion Any future growth or expansion that is warranted at these sites should be considered as B -2, Local Business and a rezone application to B -2 would be allowed under the Professional Office, Neighborhood Commercial, Community Commercial or General Commercial future land use designations. 1 4 In response to. the County's Item #3 that there is inconsistency between some of the commercial future land use designations and the implementing zoning we provide the following explanation As a city we want to encourage commercial development. Yakima is t far more intensely developed then the outlying county and consequently we are perhaps less concerned with intensity in commercial settings then we would be in say residential zones. We don't see the harm, in fact we can see a great deal of economic good, in allowing ' commercial zoning changes to be considered expeditiously It must be remembered that Table III -11 is not the end of the zoning process but the beginning a. We agree with the County's suggestion that the Professional Office land use 1 category not be considered as implementing a zoning change to SCC 1 DOC. 1 INDEX b As noted in the discussion above, we see no detriment in leaving the possibilities for some future commercial development as broad as possible. The SCC zoning district is consistent with the Future Land Use Designation of Neighborhood Commercial c. No additional changes are recommended to the Community Commercial or CBD Future Land Use implementing zones. 5. As for the confusion brought about by the similar names for zoning and comprehensive plan designations we too see a need to address this issue. Unfortunately, making these changes will affect more than just chapter three of the Comprehensive Plan. In perhaps an all too real reaffirmation of the need for proper process, since we did not give notice that anything more than Chapter three would be reviewed for change we are unable at this time to make the remaining piecemeal changes that might correct this situation. Be assured that we have docketed your concern and we will be addressing it after proper notice has been given. 1 In conclusion, might we suggest that the future land use designations of the comprehensive plan's future land use map are perhaps best viewed as a snapshot of the city of Yakima taken from a height of several miles? From this altitude you may identify residential uses from commercial and industrial but you are unable to delineate the actual use of the land. It is included under the heading Future Land Use Designations, but it is also fisted on Table III -11 in a zoning column. If it is not a future land use designation, it should be deleted from the descriptions of future land use designations. 3 Table III-1 1 is a very important part of the comprehensive plan because it establishes which 1 zoning districts are consistent with the various plan designations ( "land uses" on the table) The Growth Management Act requires that development regulations ( zomng) be consistent with and implement the comprehensive plan (future land use designations or "land uses ") In this regard we offer the follow concerns for your consideration. a. The B2 and SCC zoning districts may not be consistent with and implement the Professional Office future land use because these zones would allow more intensive uses than professional offices. b The SCC zoning distract may not be consistent with and implement the Neighborhood Commercial future land use because this zone would allow more intensive uses than neighborhood commercial. c The zones that implement the Community Commercial and CBD future land use designations should also be similarly considered.
