ORDINANCE NO. 95- 61
• AN ORDINANCE: relating to health and sanitation, and amending City of
Yakima Municipal Code, Subsections 4.16 140(C)(1),
4.16 170(c), 4.16.170(d) and 4.16.170(i)
BE IT ORDAINED BY THE CITY OF YAKIMA:
1 SECTION 1. Subsection 4.16 140(C)(1) of the City of Yakima Municipal Code is
2 hereby amended to read as follows.
3 4.16.140 Classification of premises - Charges
4
5 (C )(1) Commencing February 1, 1995, there are imposed for refuse
6 collection in the residential classification the following charges for each
7 single - family dwelling and for each residential unit in any multiple
8 dwelling:
9 Basic charge for one -can
1 0 residential service at alley
1 1 or curb $ 6 08 per month
1 2 Extra charge for the second
1 3 and each additional can at alley
1 4 or curb $ 3 19 per month
1 5 Basic charge for one -can
1 6 residential carry -out service $11 78 per month
1 7 Extra charge for the second
1 8 and each additional can with
1 9 carry -out service $ 3.54 per month

2 5 Call -back charge $ 6.08 flat rate
2 6 "Call -Back charge" as used herein means a charge to be imposed when
2 7 any customer fails to place the garbage can at the appropriate place for
2 8 collection during the regularly scheduled pickup, resulting in a
2 9 customer request for garbage collection service at a time other than the
3 0 regularly scheduled time

3 3 SECTION 2 Subsection 4 16.170(c) of the Yakima Municipal Code is hereby
3 4 ' amended to read as follows.
3 5 4.16.170 Collection of garbage in residential district - Regulations

3 7 (c) Such containers shall be watertight, of good construction with no dents,
3 8 and except as provided in subsection (k) of this section, shall be of not more
3 9 than thirty- gallon capacity with a handle at each side thereof and with tight
4 0 fitting lids. The gross weight of any container when full shall not exceed
4 1 seventy-five sixty -five pounds, unless the customer has established carry -out
4 2 service as provided in subsection (d)(1) below. in which case the gross weight
4 3 of any container when full shall not exceed fifty pounds. and-the
4 4 the- eEmpty containers shall not a weigh more than fifteen pounds.
4 5 SECTION 3 Subsection 4.16 170(d) of the Yakima Municipal Code is hereby
4 6 amended to read as follows.

4 9 (d) Garbage or refuse containers shall be kept on the residential property at all
5 0 times. No garbage-et-refuse containers fans shall be kept or stored on any

5 7 containers shall interfere with the convenient, sightly and sanitary
5 8 enjoyment of private property.
5 9 .(1) A reasonable time before regularly scheduled pickup. unless the refuse
6 0 collection customer has established carry -out service as specified in
6 1 subsection (2) below. containers shall be placed at the property line at the
6 2 alley adjacent to the property, or, for properties not adjoining an alley. at
6 3 the curb of the adjoining street. A reasonable time after pickup,
6 4 customers shall' return containers to their usual position.
6 5 (2) Refuse collection customers may establish carry -out service for garbage
6 6 cans as follows: "Carry -out service" as used herein means collection
6 7 service for sunken containers or for any container not placed at the
6 8 property line as specified in subsection (1) above. Carry -out service
6 9 containers shall be located for collection where they are convenient and
7 0 accessible within one hundred feet of the alley adjacent to the property,
7 1 or, for properties not adjoining an alley. within one hundred feet of the
7 2 adjoining street .

7 3 SECTION 4. Subsection 4.16 170(i) of the Yakima Municipal Code is hereby
7 4 amended to read as :follows •

7 7 (i) All can containers shall be placed for collection on regularly scheduled
7 8 pickup days in such a position that no employee or collector of the city
7 9 refuse division shall be respired to open any gate or
8 0 door or obstruction of any kind in Order to obtain` access to the same,
8 1 provided, however, that such employee or collector may open the door or
8 2 gate to an enclosure which is specifically designed and used solely for -the
8 3 keeping of such containers.
8 4 SECTION 5. This ordinance shall be in full force and effect 30 days after lts passage,
8 5 approval, and publication as provided by law and by 'thety Char.-ter.
