HomeMy WebLinkAbout1996-016 Alarm monitoring fee structure ORDINANCE NO. 96- 1 6 AN ORDINANCE: Relating to fire prevention and private fire alarm system connection and monitoring; changing references to the "City fire alarm center" to "City dispatch center", and altering the monthly fee structure for provision of fire alarm monitoring service, and amending Sections 10.03 030, 10.03.050, , 10 03.060, 10 03 070, 03 080, 10 03 090, 10 03 095, 10 03100, 10.03 110, and 10 03120, all of the City of Yakima Municipal Code. BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. Section 10 03 030 of the City of Yakima Municipal Code is hereby amended to read as follows "10.03.030 Definitions As used in this chapter, unless a different meaning clearly appears from the context, the following words and phrases shall have the following meanings ascribed to them. 1 "Alarm receiving system" means a system either privately owned or municipally owned, used to receive and record electrical signals from a remote • location and connected to a protective fire detection and /or fire suppression system used for the purpose of summoning assistance 2. "City fife-gaff/1 dispatch" means the municipal fire communications and dispatch control point owned and operated by the City of Yakima. 3 "Private fire alarm system" means a system installed within a building used for the purpose of detecting and /or suppressing a fire condition." Section 2 Section 10 03 050 of the City of Yakima Municipal Code is hereby amended to read as follows "10.03.050 Application for permit -- Fee. Applications for permits for the connection of private fire alarm systems or installation of alarm receiving systems in the city fire dispatch center shall be made to the Office of Code Administration at 129 North 2nd Street, Yakima, Washington. A permit fee of one hundred dollars shall be paid to the Yakima city treasurer for each private fire alarm system connection to the municipally owned fire alarm system, which fee shall be paid prior to the connection to the municipally owned • fire alarm system." (Ink.ked /fire alarm sys =worms r. wok Section 3 Section 10 03 060 of the City of Yakima Municipal Code is hereby 0 amended to read as follows. "10.03.060 System plan to be filed. Prior to the installation or modification of a private fire alarm system connected to an alarm receiving system installed in the city fire -alarm dispatch center, or an alarm receiving system installed in the city fife-alarm dispatch center, two copies of the system plan, consisting of specifications and wiring diagrams, and two copies of the floor plan of the building or premises to be protected by the private fire alarm system, shall be filed in the city of Yakima office of code administration, and shall be subject to approval as provided by Section 10 03.070 of this chapter before a permit shall be issued." Section 4 Section 10 03 070 of the City of Yakima Municipal Code is hereby amended to read as follows. "10.03.070 Alarm system standards. All private fire alarm systems connected to city -of- Yakima -owned facilities and all alarm receiving systems installed in the city fire -alarm dispatch center shall comply with Standards No 72B, 72C, or 72D, 1975 Edition, and with Standard No 72E including Appendices A and B, 1974 Edition, of the National Fire Protection Association." Section 5 Section 10 03 080 of the City of Yakima Municipal Code is hereby amended to read as follows "10.03.080 Installation costs. The owner shall pay all costs and bear any other expense incidental to the installation of alarm receiving equipment in the city fire- garrn dispatch center, which shall be accomplished at no expense to the city " Section 6 Section 10 03 090 of the City of Yakima Municipal Code is hereby amended to read as follows. "10.03.090 Ownership — Maintenance. A. Owner's Responsibility Private fire alarm systems, including alarm receiving equipment installed in the city fire -ate eispatch center, shall remain the property of the private system owner who shall make, or cause to be made, all repairs to and otherwise perform service on such equipment within twenty -four hours after notification by the Yakima fire department of the necessity for any such repair or service (mlwlad /fm .1em .ys mmitmv%.jw t B. Maintenance Agreement Required. The owner or. operator of each private 0 fire alarm system connected to alarm receiving equipment installed in the city fire alarm center shall execute a written inspection and maintenance agreement with a person, firm, or corporation engaged in the business of alarm system maintenance, a copy of which agreement shall be submitted to the office of code administration and shall be maintained on file at the Yakima fire department. C. Exception to Maintenance Agreement Requirement. The requirement of subsection B of this section shall not apply to any private fire alarm system which is inspected and maintained by the owner or operator of the system or the occupant of the protected premises in accordance with a program approved by the Yakima fire chief or his designate " Section 7 Section 10 03 095 of the City of Yakima Municipal Code is hereby amended to read as follows "10.03.095 Resetting private fire alarm systems. A. Whenever the Yakima fire department responds to an alarm, the Yakima fire department shall not be under any duty to reset any private fire alarm system Resetting the private fire alarm systems shall be the responsibility of the owner or • operator of the system. B Upon completion of an alarm activation investigation or resolution of an emergency, the owner /operator of the system shall be notified of the alarm activation. If no owner /operator is available or cannot or will not reset the alarm system, then the code enforcement office shall be notified. The owner /operator shall be advised that the owner /operator is responsible to reset the alarm system or to have the alarm system reset by a qualified person. If no emergency exists, apparatus shall notify the alarm center city dispatch that the system is out of service and alarm dispatcher shall notify the owner /operator or code enforcement. If an alarm system has a Potter Box. Yakima fire department personnel shall check to see if the code wheel is in one of the red, blue or green positions." Section 8 Section 10 03 100 of the City of Yakima Municipal Code is hereby amended to read as follows "10.03.100 Transmitter equipment -- Fee. A fee of fifteen Leia dollars a month for each signalcede digital transmitter device 0 connected to the telephone system, this charge includes basic system monitoring and monitoring of one alarm zone and Been t dollars fifty cents for each alarm zone (mlw) /fire alarm .y. mau .jw Above the basic level of service, - - - - - = • - - - = - - - -- - -: • = - shall be paid to the city of Yakima by the owner or operator of each private fire alarm system connected to alarm receiving equipment in the city fired dispatch center, which fee shall be paid at such times and in such accumulative amounts as may be billed from time to time by the city " Section 9 Section 10 03 110 of the City of Yakima Municipal Code is hereby amended to read as follows. "10.03.110 Waiver of liability. The owner of premises protected by a private fire alarm system with alarm receiving equipment in the city fire -alarm dispatch center, and the occupant of those premises if occupied by someone other than the owner, and the owner and operator of such private system shall file with the city e>nee office of code administration a waiver of liability releasing the city of Yakima, its agents, officers and employees from any increased duty or increased standard of care in detecting or suppressing any fire, or in responding to any alarm, where such increased duty of increased standard of care may otherwise result from the installation of a system pursuant to this chapter; which waiver of liability shall further absolve the city of Yakima, its agents, officers and employees from liability or all damages and liability of any nature based or resulting from the 40 installation of the private fire alarm system and alarm receiving equipment, which waiver shall include a provision absolving the city of Yakima, its agents, officers and employees from liability for all damages and liability arising from any malfunction or failure of the fire alarm circuit or appurtenant equipment or devices. The waiver shall be executed on forms provided by the city and shall be submitted to the city office of code administration and maintained on file in the administrative offices of the Yakima fire department prior to the installation of the private fire alarm system." Section 10 Section 10 03 120 of the City of Yakima Municipal Code is hereby amended to read as follows "10.03.120 Disconnection of equipment. The fire chief or his designate may disconnect or remove any fire alarm receiving equipment from the city fifes dispatch center or discontinue service to any private fire alarm system in the event the owner or occupant of the premises protected by the system or the owner or operator of the alarm receiving system fails to comply with the requirements of this chapter " (Nw)Qd /fire arm .y. mareanng.
