AN ORDINANCE annexing property to the City of Yakima and zoning said
property (Andrews /Hunter Partnership Annexation)
WHEREAS, proceedings have been held in accordance with all
applicable laws for the annexation to the City of Yakima of the property
hereinafter described, and
WHEREAS, a notice of intention was filed with the Yakima County
Boundary Review Board as required by law for this annexation and, after the
elapse of forty -five days without the Board's jurisdiction having been invoked,
the annexation has been deemed approved in accordance with RCW
36 93 100, and
WHEREAS, pursuant to due and legal notice, the City Council held a
public hearing on said annexation on the 11th day of June, 1991, and, as a
result thereof, finds that such property should be annexed to the City of Yakima
and further finds that the property should retain its current zoning pursuant to
the Yakima Urban Area Zoning Map and that such zoning and classification is
in accord with the Yakima Urban Area Comprehensive Plan, the General Plan
of the City of Yakima, that owners of not less than seventy -five percent of the
assessed valuation of property within the area described below have petitioned
the City Council for annexation, that the needs of the City and community do
require the hereinafter set forth zoning classification, and the highest and best
use for said property is as hereinafter determined, now, therefore,
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. The property identified on the map attached hereto as Exhibit
"A" and legally described in Exhibit "B ", attached hereto and incorporated by
reference herein, is hereby annexed to the City of Yakima, Washington
Section 2. The owners of the hereinbefore described real property
annexed to the City of Yakima shall be required to assume existing
indebtedness of the City of Yakima.
Section 3. The hereinbefore described real property annexed to the City
of Yakima is hereby zoned as it is currently zoned and depicted on the official
zoning map for the unincorporated portion of the Yakima Urban Area which
map is maintained in the Yakima County Planning Department and which map
• is incorporated herein by reference

Section 4. The next regularly amended Zoning District Map prepared by
and for the City of Yakima shall show said property as hereinbefore zoned and
classified
Section 5. The City Clerk is hereby authorized and directed to file a
certified copy of this ordinance with the County Auditor of Yakima County and
with the Board of County Commissioners of Yakima County, Washington
Section 6. There is hereby granted to Yakima Valley Disposal, Inc., in
accordance with RCW 35 13 280 an exclusive franchise to collect and dispose
of certain garbage and refuse in the hereinbefore described real property
annexed to the City of Yakima, in accordance with the specific terms of
Ordinance No 3220 of the City of Yakima and in accordance with the terms of
the Franchise Agreement attached to Ordinance No 3220 of the City of Yakima.
Section 7. This ordinance shall be in full force and effect the first day of
the calendar month next following thirty days after its passage, approval and
publication as provided by law and by the City Charter

Legal Description
All that portion of the Southwest Quarter of the Northwest Quarter
of Section 21, Township 13 North, Range 18 East, W.M. described as
follows
Beginning at the point of intersection of the centerline of ,
Summitview Avenue with the east right -of -way line extended
south of North 63rd Avenue, said point being on the corporate
limits of the city of Yakima; thence North, leaving the
corporate limits of the city of Yakima, along said extended
east right -of -way line, to the northwest corner of Lot 3,
Keith's 63rd Avenue Addition according to the plrt the•eof
recorded in Volume °Q' of Plats, Page 6, records of Yakima
County, Washington; thence East, along the north line of said
Lot 3, to the southeast corner of Lot 4, of said plat; thence
northerly, along the east line of said Lot 4, to the northwest
• corner of Lot 13 of said plat, thence East, along the north line
of said Lot 13 to the northeast corner thereof; thence North,
along the east line of said Keith's 63rd Avenue Addition to the
northeast corner of Lot 8 of said plat, said point being on the
north line of Lot 10, Huxtable Model Orchards according to the
plat thereof recorded in Volume "E' of plats, page 41, records
of Yakima County, Washington; thence East, along the north line
of Lots 10 and 9 of said plat, to a line parallel with and 165
