HomeMy WebLinkAbout1991-3373 Vacating • ORDINANCE NO . l 33747 CI AN ORDINANCE vacating two alley rights -of -way located between North Front Street and North 1st Street and between East "A" Street and Lincoln Avenue, and approving Class 3 Application for special detention facility, all subject to all of the conditions contained in the Hearing Examiner's Recommendation. WHEREAS, the Board of Yakima County Commissioners has filed a petition with the City Clerk requesting vacation of two alley rights -of -way located between North Front Street and North 1st Street and between East "A" Street and Lincoln Avenue; and WHEREAS, said petition was signed by the owners of more than two thirds of the property abutting upon the alley sought to be vacated; and WHEREAS, Yakima County proposes to use the vacated alley • rights -of -way to construct a special detention facility and additional parking, and requests Class 3 Application approval for such use; and WHEREAS, after due and legal notice pursuant to RCW Chapter 35.79, after a public hearing by the Hearing Examiner, and after a public hearing by the City Council of the City of Yakima, the City Council finds that it is in the best interest of the City that said petition to vacate said alley rights -of- way be granted, and that said Class 3 Application to construct a special detention facility be approved, all subject to all of the conditions contained in the Hearing Examiner's Recom- mendation found in Examiner No. I91- 81 -24, a copy of which is attached hereto as Exhibit A and incorporated by reference herein, now, therefore, BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. The Hearing Examiner's Recommendation to vacate two 20 foot wide alley rights -of -way located on the 411 respective north -south centerlines of Block 8 and Block 9 of - 1 - (ord /vctnrow.rp) the Plat of the Town of North Yakima, and to approve the Class 3 Application to construct a special detention facility with additional parking; is hereby affirmed, and said alley rights - of -way, as legally described below, shall be vacated, and the Class 3 Application approved, when the conditions set forth in Section 2 below have been fully satisfied, to -wit. Two 20 foot wide alleys located on the respective north -south center- lines of Block 8 and Block 9 of Plat of the Town of North Yakima, located in Section 19, Township 13 North, Range 19 E.W.M., records of Yakima County, State of Washington Section 2. This vacation and Class 3 Application approv- al to construct a special detention facility are expressly made subject to the following conditions. A. The City shall retain a 20 foot wide utility easement, in the location of the existing alleys for both blocks. The easement shall be prepared and recorded by the City. B. The County shall obtain written permission from any utility purveyor utilizing the easement prior to any construction over the easement. C. Delivery loading areas and truck turn - around areas shall be designed and constructed pursuant to a final site plan which is responsive to the issues identified in the Hearing Examiner's findings, and is approved by the City. D. Oil /water separators shall be installed in new drywells, and any drywells which are removed shall be closed in accordance with applicable government regulations. E. An on -site drainage plan prepared by a profes- sional engineer shall be submitted to the City Engineer's office for approval. F. The City Engineer shall determine whether roof run -off requires oil /water separators. G. The trash compactor, if not relocated to the west side of the existing jail, shall be redesigned to turn it around in its existing location. The waste grease container shall disappear. H. The existing alley approach at "B" Street will be closed off, redesigned, or relocated, to accommo- date the loading area and the various options outlined in the findings, subject to review and approval by the City. I. The existing alley approach at "A" Street on the jail block shall be moved apart to have a 20 foot safety island of full height curb between the Health District access and the jail access. - 2 - (ord /vctnrow.rp) • J. The approach at North First Street, located near 111 the southeast corner of the proposed jail, will be closed off with a full height curb and the existing curb cut directly north of the Health District building will be revised as necessary to accommodate better traffic flow. K. The existing Budget Rental curb cut will be closed with full height curb. L. The ground between the sidewalk and the new jail on the north and east shall be landscaped with grass consistent with the existing jail. Street trees and a spacing and caliper consistent with those around the existing jail and the Health District building shall be installed on "B" Street and North First Street, subject to site distance requirements for driveways and loading areas. Section 3. The Yakima City Council hereby adopts the findings, conclusions, and recommendations pertaining to this vacation and Class 3 Application approval which are contained in the Hearing Examiner's Recommendation, City Numbers UAZO CL(3) #5 -91 and UAZO R/W VAC #2 -91, Examiner No. I91- 81 -24, a true copy of which is attached hereto as Exhibit A and incor- porated by reference herein. Section 4. The City Clerk is hereby authorized and directed to file a certified copy of this ordinance with the ® Clerk of, the Yakima County Board of County Commissioners and the Yakima County Auditor. Section 5. This ordinance shall be in full force and effect 30 days after its passage, approval, and publication as provided by law and by the City Charter. The staff report presented by Mr. Dan Valoff recommended approval of both alley vacations and approval of the special detention facility, subject to a number of conditions. Yakima County Public Works Director Daniel Hesse appeared on behalf of the County. There was no opposition. The Examiner inspected the property prior to the hearing, and reviewed the sally port in the company of Jail Administrator Mike Schreiner and Dan Hesse. SUMMARY OF RECOMMENDATION. The Examiner recommends vacating both alley rights -of -way, and approving the jail. From the view of the site, the matters contained in the official record, including the staff report, a review of both the Yakima Urban Area Comprehensive Plan and the Yakima Urban Area Zoning Ordinance, and from evidence received at the hearing, the Examiner makes the following: FINDINGS 1. Applicants. Board of Yakima County Commissioners. 2. Location. Southwest corner of North First Street and East "B" Street; Yakima County Assessor's Parcel Nos. 191319- 22414, - 22415, - 22416, - 22418, and -22487 (jail). The legal description for both blocks is: Block 8 and Block 9 of Plat of the Town of North Yakima, located in Section 19, Township 13 North, Range 19 E.W.M., records of Yakima County, State of Washington. EXAMINER'S RECOMMENDATION - 1 HEARING EXAMINER FOR THE CRY AND COUNTY OF YAKIMA POST OFFICE BOX 4 YAKIMA, WASHINGTON 96)907 (509) 248 -0706 3. Application. Master application for right -of -way vacation and Class 3 review. 4. Proposed Use. Yakima County wants to build a 200 bed special detention facility east of and connected to the existing county jail. It would be located on the southwest corner of North First and East "B" Streets. The facility will house minimum security inmates, reducing the population at the jail, with a possible net addition of about 100 inmates between the two facilities. Approximately 15 additional jail employees will be added, with four employees during a maximum shift. The new building will eliminate 40 to 45 of the approximately 400 parking spaces serving the Yakima County Courthouse and Health District facilities. The County plans to make additional improvements to the block north of "B" Street, adding more parking in the future. The old Crest Linen site will probably become a parking lot, but only after additional scheduled hazardous waste analysis and removal or remediation if needed. This summer the County plans to pave the additional area north of the courthouse where the old county shops were removed, adding approximately 33 spaces. In conjunction with the new jail, the County wants to vacate the alley in the jail /Health District block, and in the block to the north with the old Safeway building and Crest Linen site. These are blocks which are part of the original plat of North Yakima, with the alleys running from East Lincoln Avenue to East "A" Street, between North Front Street and North First Street. The County owns both blocks, and therefore all of the parcels adjacent to the alleys. Prior to receipt of the Class 3 application, the City had received the right -of -way vacation application, which was processed, with a hearing by the Examiner conducted April 9, 1991. That hearing was continued and consolidated with the hearing on the EXAMINER'S RECOMMENDATION - 2 HEARING EXAMINER FOR THE CRY AND COUNTY OF YAKIMA POST OFFICE BOX 4 YAKIMA, WASHINGTON 98907 (5091 248 -0706 Class 3 application, in order to have combined review of the entire project. Although not designated on the application forms, the City has treated this matter as a master application, and the County agrees with that procedure. The building is planned to be one story, with approximately 31,500 square feet. The project is currently out to bid to architects for design, and therefore the exact configuration is not known, although the specifications require a one story building extending roughly from the sidewalk on "B" Street to just south of the lobby entrance to the existing jail, and east to North First Street. The lobby of the new building is located in the southwest corner, near the lobby of the existing jail. A loading dock and service bay is located on the north side of the building across from the lobby, in the area of the existing sally port on the north end of the existing jail. The sally port is the garage door opening on both sides of the building on the north end of the existing jail, utilized for service deliveries. The purpose of the alley vacations is to allow design and redevelopment flexibility in the future. Utility easements will continue to exist within the current alleys and all utility and access requirements will be met. Reduced copies of the layout of both blocks, showing the alleys, the layout of the jail block showing the new facility superimposed on the existing block, the interior layout of the new facility, and its elevations, are attached as Exhibit "A," consisting of six pages. 5. Current Zoning and Use. This property is located in the Central Business District (CBD) zoning district. The site is surrounded by other Yakima County government facilities including the county courthouse, county morgue, vehicle parking /storage lots, and two small office buildings. The Yakima Health District office building and clinic is also adjacent to the site. Adjacent properties have the following characteristics. Public Use of the Right -of -Way. The rights -of -way are currently paved. The jail block alley is used by the public and service vehicles to access the existing jail and the visitor parking lot. The Health District parking on that block has separate driveway approaches from both North First Street and East "A" Street. A number of underground and overhead utilities are located in both alley rights -of -way. 7. Criteria for Right -of -Way Vacation. City policy identifies five criteria for consideration: 7.1 Public Benefit. These alleys currently provide parking access for employees and visitors, and emergency vehicle access. With respect to the existing jail, the fire access to the building is at the north and south ends, in the open stairwells. The hydrants and building standpipes are located on Front Street. Written comments in the file indicate that the fire department apparently uses both alleys if they need to get a fire truck from their fire station on North First Street to the jail. The logic of that is not immediately apparent, since it means that fire trucks are crossing arterials mid - block, fighting traffic, when they are equipped to trigger the traffic signals which exist on North First Street. If the new jail is built over the alley in the jail block, it simply means that fire trucks come down North First, look at the Health District building, and then turn on "A" Street and go to the south end of the building. Access will be available mid -block on North First Street, just north of the Health District, and mid - block, at the existing alley location, on the south side of the block on "A" Street. The public benefit from vacating the alleys allows construction of the new jail in a way which consolidates deliveries, consolidates visitor access, and minimizes the need for EXAMINER'S DECISION - 4 HEARING EXAMINER FOR THE CITY AND COUNTY OF YAKIMA POST OFFICE BOX 4 YAKIMA, WASHINGTON 98907 (509) 248-0706 additional staff and management. Vacating the alley in the old Safeway /Crest Linen block removes a possible impediment to future possible construction of additional government facilities, such as a law and justice building. Easements for utilities will be retained, and any future development will be reviewed for compliance with traffic and emergency services access. Because these blocks are owned by one entity, there is no public benefit to retaining the alleys so long as utility easements are retained. 7.2 Denial of Access. This vacation request does not deny sole access to any property. 7.3 Consistency with Transportation Plans. There are no planned improvements to these alleys. The Six -Year Road Plan does identify street improvement projects scheduled for Lincoln Avenue and East "B" Street, adjacent to these alleys. Those improvement projects will not be affected by this vacation, which is consistent with both the Six -Year Road Plan and all relevant City plans and policies. 7.4 Consistency with Existing and Anticipated Development and Zoning. This area is zoned and developed as part of the City's Central Business District. The CBD plan adopted by the City identifies this area as being located in the government center district, which includes the courthouse, city hall, and nearby educational buildings. The existing and anticipated use of these blocks for municipal facilities, and public and employee parking, is consistent with current and projected zoning and development. 7.5 Relocation of Utilities. A 20 foot easement for utilities, down both alleys, will be retained by the City. City water and irrigation departments have no problem with this vacation. The sewer line in the alley services only County facilities and is the end of the line. That portion of the line in the alley will be abandoned to the County, which will then own and be responsible for maintenance of the line located in the block EXAMINER'S DECISION - 5 HEARING EXAMINER FOR THE CITY AND COUNTY OF YAKIMA POST OFFICE BOX 4 YAKIMA. WASHINGTON 90907 (509) 248-0706 which services the jail. Cascade Natural Gas will probably abandon the existing line under the new structure, which they indicate is not a problem. The gas line already runs around the perimeter of the southern half of the block. Abandoning that line to be covered by the new building will not affect gas distribution in the area. Pacific Power and Light will continue to have lines down both alleys. The County plans to underground the lines in the vicinity of the new jail, but otherwise the lines will remain overhead. Phone lines will also be underground under the new building. All utilities have been provided for, and any required relocation will be taken care of at County expense. Vehicular access will be provided as reflected on the site plan and described herein, with any required fire hydrants located per City Fire Marshal specifications. 8. Compensation. City Resolution No. D -5630 details the compensation policy. Government entities are exempt from payment, so the City will not receive any compensation for vacation of the alleys. 9. Traffic Study. A traffic study was not required by the City Planning Department. 10. Class 3 Review. 10.1 Yakima Urban Area Comprehensive Plan. One of the purposes of the plan is to see that future development is compatible with existing uses. Compatibility and development criteria are to be reviewed and determined on a case -by -case basis. The City's intent for the downtown area, as reflected in its Downtown Futures Plan, indicates that there is a substantial area downtown designated as government. This proposal is consistent with the comprehensive plan. Compatibility issues and special concerns will be dealt with relative to the zoning ordinance, considered below. 10.2 Yakima Urban Area Zoning Ordinance. The purpose of the Central Business District zone is to preserve the CBD as the region's center of commerce, industry, recreation, and culture. The District is characterized by very intensive development and a EXAMINER'S DECISION - 6 HEARING EXAMINER FOR THE CTTY AND COUNTY OF YAKIMA POST OFFICE BOX 4 YAKIMA, WASHINGTON 98907 (509) 248 -0706 variety of land uses, including government offices. Detention centers are a Class 3 use in the CBD zone. (YMC Ch.15.04, Table 4 -1.) Since the right -of -way request and the Class 3 request are being treated by stipulation as a master application, the Examiner's decision on the Class 3 aspect is also treated as a recommendation, going to the Council with the right -of -way vacation recommendation for Council decision. If handled under separate applications the Class 3 application would have been a final decision by the Examiner, appealable to the Council. 10.3 Development Criteria. This project complies with all of the ordinance requirements. No adjustments to development standards have been requested. The building will comply with the required 40 foot setback from the center line off arterials for Lincoln, and 30 feet from the center line for North First, with a zero lot line setback for the rear, next to the Health District. The zone allows 100 percent lot coverage. This proposal leaves a strip of open area along the sidewalk on "B" Street and North First street, which will be landscaped with grass consistent with the existing jail. There are no sitescreening requirements in this area, but the existing jail block has been previously landscaped, except for this area, with trees in sidewalk wells, which is also consistent with the street tree landscaping for the Courthouse directly east. Although not proposed in the site plan, there is no serious objection by the County to a requirement that street trees be planted consistent with the existing landscaping for the Health District building and jail. The major concern the County has is that any landscaping not interfere with security, meaning that shrubbery adjacent to the building is not appropriate. With respect to parking, this block is located in the downtown business district and therefore exempt from parking. In some instances it may be appropriate, in considering compatibility, to require parking in the downtown area, but in this instance it is not necessary to decide that point. A public parking lot exists diagonally to the Health District, on the southeast corner of the EXAMINER'S DECISION - 7 HEARING EXAMINER FOR THE CITY AND COUNTY OF YAKIMA POST OFFICE BOX 4 YAKIMA. WASHINGTON 98907 (509) 248-0706 intersection of North First Street and "A" Street. In addition, there are approximately 360 parking spaces serving the Courthouse and Health District facilities, with new parking planned for this summer in the vicinity of the old county shops directly north of the Courthouse. The old Crest Linen site will eventually be developed as parking, but is currently undergoing assessment work for hazardous wastes. Once that problem is resolved that area will be redeveloped by the County. There are no specific future plans for development on the Safeway /Crest Linen block, but it is likely that another government structure will be built there in the reasonably near future, at which time all of these issues will be subject to review again. The Health District submitted comments reflecting significant concern about the design of the jail and its impact upon their available parking. The Health District has recently committed itself to provide a pediatric clinic, but has made no attempt to deal with any parking problems generated by the clinic. By comparison, it is probable that the clinic will generate more of a parking problem than the new jail, since by design not too many people are supposed to be leaving that sort of facility. The Health District will retain its two rows of diagonal parking on the west side of its building. They will also retain two rows of diagonal parking on the north side of the building, but that area's driveway access to North First Street will probably be widened to some extent to accommodate emergency access and better traffic flow. The existing alley on the south half of the jail block will in effect remain, with the alley curb cut on "A" Street moved west 20 feet to maintain the proper distance between the Health District driveway and the alley driveway, pursuant to normal City requirements. Although not reflected on the site plan there is a possibility that additional parking will be available on both sides of the current alley. The parking adjacent to the jail, on the west side of the alley, is inset a considerable distance, leaving the possibility of additional spaces on the east side of the current alley. The area near the lobby entrance of the new • EXAMINER'S DECISION - 8 HEARING EXAMINER FOR THE CITY AND COUNTY OF YAKIMA POST OFFICE BOX 4 YAKIMA. WASHINGTON 96907 (509) 248-0706 jail will be redesigned to provide proper radiuses for turning vehicles, including fire trucks. There are considerable advantages to building this jail next to the existing jail, but it does carry with it the need to accommodate some of the existing jail's idiosyncracies. The major problem is the loading area on the north side of the block, where the alley currently is. At that location is the trash compactor serving the jail, which will also serve this facility. The compactor is on a pad and connected to the sally port that cuts through the north end of the jail, from east to west. That is a loading area servicing the kitchen and laundry and janitorial needs of the existing jail building. The kitchen of the existing jail is located in the northeast corner of the jail. Food will be moved from that kitchen into the new facility, apparently by use of the sally port and service area. Some considerable questioning at the hearing results in the conclusion that the jail has on average one or fewer service vehicle deliveries per day. Twice a week the jail receives a food shipment, and the rest of the week miscellaneous deliveries of janitorial and related supplies. About every ten days the trash compactor is emptied. As a result of this review, it was discovered that the trash compactor was basically installed backwards. In order to be removed it currently has to be pulled out, turned around, and then mounted on the truck, requiring some considerable maneuvering which now occurs in the alley. What needs to happen is to have the loading chute into the trash compactor transferred to the other side, so that the front of the compactor can face east instead of west. County Public Works is already taking care of that problem. This will mean that the garbage truck can back up to it and load it without a lot of additional maneuvering. The other event that requires maneuvering is the food truck twice a week. It is typically a short wheel base single axle semi, which currently uses the alley. The proposed loading area is not large enough to provide turn-around space. County Public Works EXAMINER'S DECISION - 9 HEARING EXAMINER FOR THE CITY AND COUNTY OF YAKIMA POST OFFICE BOX 4 YAKIMA. WASHINGTON 99907 (509) 240.0706 proposes two possible alternate solutions. The existing sally port doors are not high enough to allow a vehicle of that type to drive through. With the loss of the alley, some provision has to be made for a turn - around. One approach proposed by Mr. Hesse is to have two curb cuts on "B" Street. The westerly curb cut would be located in the vicinity of the west end of the trash compactor and would allow an eastbound truck to make a right turn in near the loading door, and then exit, on a right turn out a bit east of the existing alley curb cut. This would entail two curb cuts fairly close together on an arterial, but they would be right turn in, right turn out, which presents little disruption of arterial traffic, while getting the truck off the street. The other alternative is to widen or relocate the northerly curb cut on North Front Street somewhat to the south, and create a diagonal driveway cutting across the corner of the block, with an exiting curb cut onto East "B" Street near the middle of the old jail. The truck would then pull in from North Front Street and utilize the north sally port for unloading supplies. The trash compactor could be moved to the west side of the building, in a mirror image of its existing location. That would take a new concrete pad, and other than a hole in the building would not require any internal modifications other than replumbing the hydraulics. It is premature, without a final site plan, to determine if the compactor should be moved. The existing waste grease tank currently sitting at curb side near the alley will have to disappear in order to provide maneuvering space near the east sally port. For aesthetic reasons it should permanently disappear or be permanently hidden. All unused curb cuts will be closed and all new curb cuts will be constructed pursuant to City specifications. 11. Environmental Review. With respect to the Class 3 application, Yakima County was lead agency and issued a threshold Determination of Non- significance on May 6, 1991. The 15 day comment period ended May 21, with no comments having been received. Street vacations are categorically exempt from SEPA review. EXAMINER'S DECISION - 10 HEARING EXAMINER FOR THE CRY AND COUNTY OF YAKIMA POST OFFICE BOX 4 YAKIMA, WASHINGTON 98907 (509) 248 -0706 WAC 197- 11- 800(2)(h) and YMC Ch.6.88. 12. Public Notice. Public notice of the hearing was provided in accordance with the ordinance. From the foregoing Findings, the Examiner makes the following: CONCLUSIONS 1. The Examiner has jurisdiction. 2. All notice provisions have been complied with. 3. Vacation of this right -of -way is consistent with RCW Ch.35.79 and Yakima City Ordinance No. D -5630. No public purpose is served by retaining the right -of -way. 4. The Class 3 application complies with the objectives of the Urban Area Comprehensive Plan, the intent of the CBD zoning district, and the provisions of the Urban Area Zoning Ordinance, subject to the conditions set forth in the recommendation below. Based upon the foregoing Findings and Conclusions, the Examiner submits to the Yakima City Council the following: RECOMMENDATION Approve vacating the alley rights -of -way located in Block 8 and Block 9 of Plat of the Town of North Yakima, located in Section 19, Township 13 North, Range 19 E.W.M., records of Yakima County; and approve the Class 3 application for approval to construct a detention facility, subject to the following conditions: 1. The City shall retain a 20 foot wide utility easement, in the location of the existing alleys for both blocks. The easement shall be prepared and recorded by the City. 2. The County shall obtain written permission from any utility purveyor utilizing the easement prior to any construction over the easement. 3. Delivery loading areas and truck turn - around areas shall be designed and constructed pursuant to a final site plan which is responsive to the issues identified in the findings above, and is approved by the City. 4. An on -site drainage plan prepared by a professional engineer shall be submitted to the City Engineer's office for approval. 6. The City Engineer shall determine whether roof run -off requires oil /water separators. 7. The trash compactor, if not relocated to the west side of the existing jail, shall be redesigned to turn it around in its existing location. The waste grease container shall disappear. 9. The existing alley approach at "B" Street will be closed off, redesigned, or relocated, to accommodate the loading area and the various options outlined in the findings, subject to review and approval by the City. 9. The existing alley approach at "A" Street on the jail block shall be moved apart to have a 20 foot safety island of full height curb between the Health District access and the jail access. 10. The approach at North First Street, located near the southeast corner of the proposed jail, will be closed off with a full height curb and the existing curb cut directly north of the Health District building will be revised as necessary to accommodate better traffic flow. 11. The existing Budget Rental curb cut will be closed with full height curb. 12. The ground between the sidewalk and the new jail on the north and east shall be landscaped with grass consistent with the existing jail. Street trees with a spacing and caliper consistent with those around the existing jail and the Health District building shall be installed on "B" Street and North First Street, subject to site distance requirements for driveways and loading areas.
