HomeMy WebLinkAbout1982-2584 VACATING A PUBLIC ALLEY ORDINANCE NO. ;257Y AN ORDINANCE providing for the vacation of a public alley in the City of Yakima, Washington. WHEREAS, a petition has been filed with the City Council of the City. of Yakima requesting the vacation of the hereinafter described public alley, and WHEREAS, a hearing by the City Council was duly held on said petition, and as a result of such hearing the City Council finds it to be in the best interests of the City of Yakima that said petition be granted and that said alley be vacated, now, therefore, 410 BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. The following public alley in the City of Yakima, Washington, to wit: The alley lying between Lot 16, Block 17, Elberta- - Addition, as recorded in Volume "A" of Plats, page 133, records of Yakima County, Washington; and Lot • 11, Edson's Addition, as recorded in Volume "A" of Plats, page 135, records of Yakima County, Washington. be, and the same is hereby vacated. Section 2. The City of Yakima hereby reserves all necessary easements, and the right to exercise and, grant easements, over, along, and across, and above and below the surface, for the installation, construction, repair and maintenance of city and other public utilities which may now exist in said alley or which may hereafter be installed or constructed therein, as well as easements for furnishing other public services as may hereafter be deemed necessary or desirable by the City; and no building or other structure shall be constructed on any portion of the vacated alley without the prior approval of the City. 01/ Section 3. The reservation of easements by Section 2 of this ordinance precludes the erection by abutting property owners of gates or other barriers so as to prevent access into 111 the vacated alley by city and other public utility personnel and, equipment for installation, construction, maintenance and repair purposes or by personnel and equipment to furnish other public services, without prior arrangements with the City to provide such access. Section 4. This ordinance shall be in full force and effect thirty days after its passage, approval and publication as provided by law and by the City Charter; provided, this dik ler ordinance shall not become effective until compensation in the amount of $1,298.28 has been paid to the City.
