j • AN ORDINANCE relating to building regulations; adopting by reference
the Washington State Energy Code, settin• new energy
conservation standards for commercial and residential
structures within the City of Yakima; repealing existing
energy code standards; repealing Chapter 11 05 and
reenacting a new Chapter 11 05 and the various sections
thereof as a new chapter and new sections of the City of
Yakima Municipal Code.
WHEREAS, R C W 35 21 180 authorizes cities and towns within the
State of Washington to pass ordinances adopting by reference compila-
tions and codes relating to construction of buildings, and
WHEREAS, the City Council of the City of Yakima has heretofore
examined and understands the scope and purpose of the Washington State
Energy Code, 1991 Edition, by the Washington State Building Code Council
and deems it in the best interests of the City of Yakima that the
Washington State Energy Code, as amended herein, be adopted as the law
of the City of Yakima, and
WHEREAS, one copy of the Washington State Energy Code has been
filed with the office of the City Clerk of the City of Yakima for use
• and examination by the public as required by law, now, therefore,
BE IT ORDAINED BY THE CITY OF YARIMA
Section l Chapter 11 05 of the City of Yakima Municipal Code,
including Sections 11 05 010, 11 05 020, 11 05 030, 11 05 040 and
11 05 050 thereof, is hereby repealed
Section 2 Simultaneously with the repeal of Chapter 11 05 of
the City of Yakima Code and Sections thereof provided for by Section 1
of this ordinance, there is hereby enacted a new Chapter 11 05 "Energy
Code ", and Sections 11 05 010, 11 05 020, 11 05 030, 11 05 040 thereof,
of the City of Yakima Municipal Code to read as follows

ENERGY CODE
11. 05 010 adoption of the Washington State Energx
Code The Washington State Energy Code adopted by the Washington
State Building Code Council, effective July 1, 1991, codified as
Chapter 51 -11 of the Washington Administrative Code of which not
less than one copy has been and now is on file in the office of the
City Clerk of the City of Yakima, is hereby adopted and
incorporated as fully as if it were set out in full herein as the
energy code of the City of Yakima, except as hereinafter amended;
• and the provisions and regulations of the City of Yakima and the
several sections or numbers herein shall constitute, and may be
referred to, as the numbers of this chapter

11 05 020 *r± n _ o S ion 101 _2 _ Section 101 2 of
the Washington State Energy Code, as adopted by this chapter, is
hereby amended to read as follows •
'101 2 Purpose and Intent The purpose of this Code is
to provide minimum standards for new or altered buildings and
structures or portions thereof to achieve efficient use and
conservation of energy
The purpose of this Code is not to create or otherwise
establish or designate any particular class or group of persons who
will or should be especially protected or benefitted by the terms
of this Code
It is intended that these provisions provide flexibility to
permit the use of innovative approaches and techniques to achieve
efficient use and conservation of energy These provisions are
structured to permit compliance with the intent of this Code by any
one of the following three paths or designs
1 A systems analysis approach for the entire building and
its energy -using sub - systems which may utilize
renewable energy sources; Chapter 4
2 A component performance approach for building
elements and mechanical systems and components; Chapter
5
3 A prescriptive requirements approach; Chapter 6
Compliance with any one of these approaches meets the intent
of this Code This Code is not intended to abridge any safety or
health requirements required under any other applicable codes or •
ordinances
The provisions of this Code do not consider the efficiency
of various energy forms as they are delivered to the building
envelope A determination of delivered energy efficiencies in
conjunction with this Code will provide the most efficient use of
available energy in new building construction
Adoption and enforcement of this Code shall not be construed
for the particular benefit of any individual person or group of
persons, other than the general public In the event of a conflict
between the intent of this section and any other section herein,
this section shall govern insofar as applicable '
11 05 030 Amendment to Section 109_ Section 109 of the
Washington State Energy Code, as applied to the City of Yakima, is
hereby amended to read as follows
'Section 109 Violations It shall be unlawful for any
person, firm, or corporation to erect or construct any building, or
remodel or rehabilitate any existing building or structure in the
City, or allow the same to be done, contrary to or in violation of
any of the provisions of this Code
It is a public nuisance for any person, firm or corporation
to erect or construct any building or structure, or remodel or
rehabilitate any existing building or structure or allow the same
to be done contrary to or in violation of any of the provisions of •
this Code Such public nuisance shall be subject to prevention and

abatement by injunction or other appropriate remedy in the superior
court of Washington in Yakima County '
S 11 05 040 Am ndmnt to Stion 201.1 Section 201 1 of
shington State Energy Code, as applied to the City of Yakima,
is hereby amended to read as follows
'Section 201.1
BASEMENT WALL: The opaque portion of a wall which encloses a
basement and is partially or totally below grade
BELOW GRADE WALLS Walls or the portion of walls which are
entirely below the finished grade or which extend two feet or
less above the finish grade
BUILDING, EXISTING See the Washington State Building Code
BOILER CAPACITY The rate of heat output in Btu /h measured
at the boiler outlet, the design inlet and outlet conditions
and rated fuel /energy input
BUILDING ENVELOPE The elements of a building which enclose
conditioned spaces through which thermal energy may be
transferred to or from the exterior or to or from spaces
exempted by the provisions of Section 101 3 1
BUILDING OFFICIAL The Code Administration Manager or his
duly authorized representative
• BUILDING PROJECT A building or group of buildings,
including on -site energy conversion or electric - generating
facilities, which utilize a single submittal for a
construction permit or are within the boundary of a
contiguous area under one ownership
SEQUENCE A consecutive series of operations
SERVICE SYSTEMS All energy -using systems in a building that
are operated to provide services for the occupants or
processes housed therein, including HVAC, service water
heating, illumination, transportation, cooking or food
preparation, laundering or similar functions
SERVICE WATER HEATING Supply of hot water for domestic or
commercial purposes other than comfort heating
SERVICE WATER HEATING DEMAND The maximum design rate of
energy withdrawal from a service water heating system in a
designated period of time (usually an hour or a day)
SHADED Glazed area which is externally protected from
direct solar radiation by use of devices permanently affixed
to the structure or by an adjacent building, topographical
feature, or vegetation
SHALL
111 (a) With respect to the functions and powers of the Code
Administration Manager any agents and employees of the City
of Yakima and any board authorized hereunder, a direction and

authorization to act in exercise of sound discretion and in
good faith
(b) With respect to the obligations of owners and occupants
of premises and their agents, a mandatory requirement to act
in compliance with this Code at the risk of civil and
criminal liability upon failure so to act
SINGLE FAMILY One and two family residential dwelling units
with no more than two units in a single building
SKYLIGHT. A glazing surface that has a slope of less than
sixty degrees from the horizontal plane
SLAB -ON- GRADE, EXTERIOR: Any portion of a lab floor in
contact with the ground which is less than or equal to
twenty -four inches below the final elevation of the nearest
exterior grade
SLAB - BELOW -GRADE Any portion of a slab floor in contact
with the ground which is more than twenty -four inches below
the final elevation of the nearest exterior grade
SOLAR ENERGY SOURCE Source of natural daylighting and of
thermal, chemical or electrical energy derived directly from
conversion of incident solar radiation
STANDARD FRAMING All framing practices not defined as
"intermediate" or "advanced" shall be considered standard
(See Advanced framed ceiling, Advanced framed walls,
Intermediate framed wall.)
SUBSTANTIALLY REMODELED OR REHABILITATED Any alteration or
restoration of a building or structure within any twelve
month period, the cost of which exceeds sixty percent of the
current replacement value of the particular building or
structure
SYSTEM A combination of central or terminal equipment or
components and /or controls, accessories, interconnecting
means, and terminal devices by which energy is transformed so
as to perform a specific function, such as HVAC, service
water heating or illumination
Section 3 This ordinance shall be in full force and
effect thirty days after its passage, approval and publication as
provided by law and by the City Charter
