AN ORDINANCE relating to building regulations; adopting by reference the
Uniform Building Code, 1991 Edition, copyright 7:)91 by the
International Conference of Building Officials, regulating
the erection, construction, enlargement, alteration, repair,
moving, removal, conversion, demolition, occupancy, equi-
pment, use, height, area and maintenance of buildings or
structures in the City of Yakima; and amending Sections
11 04 010, 11 04 015, 11 04 020, 11 04.025, 11 04 027,
11 04 055 and 11 04 070, all of the City of Yakima Municipal
Code
WHEREAS, R C W 35 21 180 authorizes cities and towns within the State
of Washington to pass ordinances adopting by reference compilations and
codes relating to the construction of buildings, and
WHEREAS, the City Council of the City of Yakima has heretofore
examined and understands the scope and purpose of the regulations of the
Uniform Building Code, 1991 Edition, copyright 1991 by the International
Conference of Building Officials, and deems it in the best interests of the
City that such Uniform Building Code and Regulations for Barrier -Free
Facilities be adopted as the law of the City of Yakima, and
WHEREAS, one or more copies of such Uniform Building Code have here-
tofore been filed and are now on file in the office of the Code Adminis-
tration Manager of the City of Yakima for use and examination by the public,
as required by law, now, therefore,
BE IT ORDAINED BY THE CITY OF YAKIMA
Section l Section 11 04 010 of the City of Yakima Municipal Code is
hereby amended to read as follows
"11 04 010 As - ption of Uniform Building Code The Uniform
Building Code, 1988 Edition, copyright 1991 by the International
Conference of Building Officials, consisting of the Uniform Building
Code, all appendices thereto except Appendices Chapters One, Twelve,
Fifty -one, Fifty- three, Seventy, and a separate supplement volume
thereto entitled Uniform Building Code Standards, of which no less than
one or more copies each have been filed and now are on file in the
office of the Code Administration Manager of the City of Yakima, is
hereby adopted and incorporated as fully as set out in full herein, as
the building code of the City of Yakima; except as hereinafter amended,
and the provisions and regulations of the City of Yakima and the sev-
eral sections or numbers therein shall constitute, and may be referred
to as, the numbers of this chapter "
Section 2 Sec 11.04 015 is hereby amended to read as follows
"11 04 015 Amendment to Sect4pn 102 Section 102 of the Uniform
Building Code, as applied to the City of Yakima, is hereby amended to

'Sec 102 purpose The purpose of this code is to provide minimum
standards to safeguard life or limb; health, property and public welfare by ,
regulating and controlling the design, construction, quality of materials,
use and occupancy, location and maintenance of all buildings and structures
within this jurisdiction and certain equipment specifically regulated
herein
Adoption or enforcement of this code shall not be construed for the
particular benefit of any individual person or group of persons, other than
the general public In the event of a conflict between the intent of this
section and any other section herein, this section shall govern insofar as
applicable '"
Section 3 Section 11 04 020 of the City of Yakima Municipal Code is
hereby amended to read as follows
"11 04 020 Amendment to Section 201 Section 201 of the Uniform
Building Code, as applied to the City of Yakima, is hereby amended to
read as follows
'SECTION 201 There is hereby established in the City of Yakima
the Division of Code Administration in the Department of Community and
Economic Development which shall be under the jurisdiction of the Code
Administration Manager designated by the appointing authority Where -
ever the term Building Official is used in this code it shall be
construed to mean the Code Administration Manager '"
Section 4 Section 11 04 025 is hereby enacted as a new section of
the City of Yakima Municipal Code to read as follows
"11 04 025 Amendment to Section 420 Section 420 of the Uniform

Building Code, as applied to the City of Yakima is hereby amended to
read as follows
'SECTION 420 SENSITIZER is a chemical that causes a substantial
proportion of exposed people or animals to develop an allergic reaction
in normal tissue after repeated exposure to the chemical
SERVICE CORRIDOR is a fully enclosed passage used for transporting
HPM and for purposes other than required exiting
SHAFT is an interior space, enclosed by walls or construction,
extending through one or more stories or basements which connects
openings in successive floors, or floors and roof, to accommodate
elevators, dumbwaiters, mechanical equipment or similar devices or to
transmit light or ventilation air
SHAFT ENCLOSURE is the walls or construction forming the
boundaries of a shaft
SHALL
(a) With respect to the functions and powers of the Director of
Community and Economic Development, the Code Administration Manager, any
agents and employees of the City of Yakima and any board authorized
hereunder, a direction and authorization to act in the exercise of sound
discretion and in good faith;

(b) With respect to the obligations upon owners and occupants of
premises and their agents, a mandatory requirement to act in compliance with
this code at the risk of civil and criminal liability upon failure so to
act '
SMOKE DETECTOR is an approved detector which senses visible or
invisible particles of combustion The detector shall bear a label or other
identification issued by an approved testing agency having a service for
inspection of materials and workmanship at the factory during fabrication
and assembly
STAGE See Chapter 39
STORY is that portion of a building included between the upper surface
of any floor and the upper surface of the floor next above, except that the
topmost story shall be that portion of a building included between the upper
surface of the topmost floor and the ceiling or roof above If the finished
floor level directly above a basement or unused under -floor space is more
than 6 feet above grade as defined herein for more than 50 percent of the
total perimeter or is more than 12 feet above grade as defined herein at any
point, such basement or unused under -floor space shall be considered as a
story
STORY, FIRST, is the lowest story in a building which qualifies as a
story, as defined herein, except that a floor level in a building having
only one floor level shall be classified as a first story, provided such
floor level is not more than 4 feet below grade, as defined herein, for more
than 50 percent of the total perimeter, or more than 8 feet below grade, as
defined herein, at any point
STREET is any thoroughfare or public space not less than 16 feet in
• width which has been dedicated or deeded to the public for public use
STRUCTURAL OBSERVATION means the visual observation of the structural
system, including, but not limited to, the elements and connections at
significant construction stages, and the completed structure for general
conformance to the approved plans and specifications Structural
observation does not include or waive the responsibility for the inspections
required by Sections 305 and 306
STRUCTURE is that which is built or constructed, an edifice or building
of any kind, or any piece of work artificially built up or composed of parts
joined together in some definite manner.
SURGICAL AREA is the preoperating, operating, recovery and similar
rooms within an outpatient health -care center '"
Section 5 Section 11 04.027 is hereby enacted as a new section of
the City of Yakima Municipal Code to read as follows:
"11 04 027 Amendment to Section 307 Section 307 of the Uniform
Building Code, as applied to the City of Yakima, is hereby amended to
read as follows.
'Sec. 308 Certificate of Occupancy_
(a) Use or Occupancy No building or structure shall be used or
occupied, and no change in the existing occupancy classification of a
building or structure or portion thereof shall be made until the building
official has issued a Certificate of Occupancy therefor as provided herein

EXCEPTION Group R, Division 3, and M Occupancies

Issuance of a Certificate of Occupancy shall not be construed as an
approval of a violation of the provisions of this code or of other
ordinances of the jurisdiction Certificates presuming to give authority to
violate or cancel the provisions of this code or of other ordinances of the
jurisdiction shall not be valid
(b) Change in Use Changes in the character or use of a building
shall not be made except as specified in Section 502 of this code
(c) certificate Issued After the building official inspects the
building or structure and finds no violations of the provisions of this code
or other laws which are enforced by the code enforcement agency, the
building official shall issue a Certificate of Occupancy which shall contain
the following
1 The building permit number
2 The address of the building
3 The name and address of the owner
4 A description of that portion of the building for which the
certificate is issued
5 A statement that the described portion of the building
complies with the requirements of this code for the group and
division of occupancy and the use for which the proposed
occupancy is classified •
6 The name of the building official
(d) Temporary Certificate If the building official finds that
no substantial hazard will result from occupancy of any building or
portion thereof before the same is completed, he may issue a temporary
Certificate of Occupancy for the use of a portion or portions of a
building or structure prior to the completion of the entire building or
structure
(e) posting The Certificate of Occupancy shall be posted in a
conspicuous place on the premises and shall not be removed except by
the building official
(f) Revocation The building official may, in writing, suspend
or revoke a certificate of occupancy issued under the provisions of
this code, whenever the certificate is issued in error, or on the basis
of incorrect information supplied, or when it is determined that the
building or structure or portion thereof is in violation of any
ordinance or regulation or any of the provisions of this code
(g) public Nuisance It is a public nuisance to use or occupy a
building or structure, or any part thereof, of the groups enumerated in
subsection (a) herein without there having been issued a valid
Certificate of Occupancy for such building, structure or part thereof
Such public nuisance shall be subject to prevention or abatement by
injunction or other appropriate legal remedy in the superior court of
Washington in Yakima County '^ •

Section 6 Section 11 04 055 of the City of Yakima Municipal Code is
hereby ame -ded to read as follows
"11 04 055 Bt?rtdment to Subsection 3802(a) Subsection 3802(a)
of the Uniform Building Code, as applied to the City of Yakima is
amended to read as follows
'Sec 3802 (a) Where Required An automatic fire- extinguishing
system shall be installed in the occupancies and locations as set forth
in this section
For special provisions and hazardous chemicals and magnesium, and
calcium carbide, see the Fire Code
EXCEPTION Automatic sprinkler systems shall not be required for
controlled atmosphere storage rooms in which refrigeration apparatus is
installed to control the temperature in the storage rooms and gas -tight
seals are incorporated in the construction of the rooms so as to
facilitate the maintenance of an atmosphere within the storage rooms
that is lower in oxygen content and higher in nitrogen and carbon
dioxide content than normal atmosphere '"
Section 7 Section 11 04 070 of the City of Yakima Municipal Code is
hereby amended to read as follows
"11 04 070 Adoption of Regulations for Barrier -Free Facilities
The Washington State Regulations for Barrier -Free Facilities, dated
July 1990, as promulgated by the Washington State Building Code
411 Council, of which regulations not less than one copy of each have been
and now are on file in the office of the Code Administration Manager,
are adopted and incorporated as fully as if set out in full herein, as
supplements and amendments to the Uniform Building Code adopted by this
chapter "
,Section 8 A new section 11 04 080 is hereby added to the Yakima
Municipal Code as follows
"11 04 080 Adoption of Washington State Water Conservation Performance.
Standards The Washington State Water Conservation Performance Standards
dated July 1, 1990, as promulgated by the Washington State Building Code
Council, of which regulations not less than one copy of each have been and
now are on file in the office of the Code Administration Manager, are
adopted and incorporated as fully as if set out in full herein, as
supplements and amendments to the Uniform Building Code adopted by this
chapter "
Section 9 A new section 11 04 090 is hereby added to the Yakima
Municipal Code as follows
"11 04 090 Adoption of the Washington State Ventilation and Indoor Air
Ouality Code. The Washington State Ventilation and Indoor Air Quality Code,
dated July 1, 1991, as promulgated by this Washington State Building Code
411 Council, of which regulations, not less than one copy of each have been and
are now on file in the office of the Code Administration Manager, are

adopted and incorporated as fully as if set out in full herein, as "
supplements and amendments to the Uniform Building Code adopted by this e
chapter
$e-tion 10 This ordinance shall be in full force and effect thirty
days after its passage, approval and publication as provided by law and by
