AN ORDINANCE relating to public safety and morals; declaring
habitually barking dogs a nuisance; providing for
impound of such dogs; declaring keeping of such
dogs or refusal to allow impound to be a crime and
amending Section 6.20.040, enacting as new
sections -- Sections 6.20.020 and 6.20.030 and
repealing Section 6.20.080 all of the City of
Yakima Municipal Code.
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1: Section 6.20.020 of the City of Yakima Municipal
Code is hereby enacted as a new section to read as follows:
"6.20.020 Habitually Barking Dogs -- Nuisance: It is a
nuisance for any person in control of premises to keep,
harbor or maintain thereon any dog or dogs which individually
or together habitually bark, growl, yelp, howl or whine so
loudly and for such duration as to unreasonably disturb the
peace, quiet, comfort and repose of others within the City of
• Yakima. Any such dog or dogs may be seized and impounded if
such disturbance re- occurs after the person in control of the
premises has received two prior warnings within a period of
six months from any law enforcement or animal control officer
of the City of Yakima. It is not a defense that prior
warnings involved different dogs."
Section 2: Section 6.20.030 of the City of Yakima Municipal
Code is hereby enacted as a new section to read as follows:
"6.20.030 Refusal to Surrender Impounded Dogs -- Penalties:
It is unlawful for any person in control of premises to
refuse to surrender to any law enforcement or animal control
officer of the City of Yakima any dog or dogs sought to be
confiscated or impounded under the provisions of Chapters
6.14, 6.18, 6.20 or 6.22 of the City of Yakima Municipal
Code. The penalty for violation of this section shall be
ninety (90) days in jail or five hundred dollars ($500) or
both."
Section 3: Section 6.20.040 of the City of Yakima Municipal
Code is hereby amended to read as follows:

"6.20.040 Unreasonable Disturbance by Barking Dogs: It is
unlawful for any person in control of premises to keep,
harbor or maintain on said premises any dog or dogs which
individually or together bark, yelp, howl or whine so loudly Aft
and for such duration as to unreasonably disturb the peace,
quiet, comfort and repose of others within the City of
Yakima."
Section 4: This ordinance shall be in full force and effect
30 days after its passage, approval, and publication as provided
by law and by the City Charter.
PASSED BY THE CITY COUNCIL, signed and approved this
