AN ORDINANCE annexing property to the City of Yakima and zoning said
property (North Fruitvale Phase 2 Annexation)
WHEREAS, proceedings have been held in accordance with all
applicable laws for the annexation to the City of Yakima of the property
hereinafter described, and
WHEREAS, a notice of intention was filed with the Yakima County
Boundary Review Boar) as required by law for this annexation and, after the
elapse of forty -five days without the Board's jurisdiction having been invoked,
the annexation has been deemed approved the annexation has been deemed
approved in accordance with RCW 36 93 100, and
WHEREAS, pursuant to due and legal notice, the City Council held a
public hearing on said annexation on the 9th day of April, 1991, and, as a result
thereof, finds that such property should be annexed to the City of Yakima and
further finds that the property should retain its current zoning pursuant to the
Yakima Urban Area Zoning Map and that such zoning and classification is in
• accord with the Yakima Urban Area Comprehensive Plan, the General Plan of
the City of Yakima, that owners of not Tess than seventy -five percent of the
assessed valuation of property within the area described below have petitioned
the City Council for annexation, that the needs of the City and community do
require the hereinafter set forth zoning classification, and the highest and best
use for said property is as hereinafter determined, now, therefore,
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. The property identified on the map attached hereto as Exhibit
"A" and legally described in Exhibit "B ", attached hereto and incorporated by
reference herein, is hereby annexed to the City of Yakima, Washington
Section 2. The owners of the hereinbefore described real property
annexed to the City of Yakima shall be required to assume existing
indebtedness of the City of Yakima.
Section 3. The hereinbefore described real property annexed to the City
of Yakima is hereby zoned as it is currently zoned and depicted on the official
zoning map for the unincorporated portion of the Yakima Urban Area which
map is maintained in the Yakima County Planning Department and which map
• is incorporated herein by reference

Section 4. The next regularly amended Zoning District Map prepared by
and for the City of Yakima shall show said property as hereinbefore zoned and
classified
Section 5. The City Clerk is hereby authorized and directed to file a
certified copy of this ordinance with the County Auditor of Yakima County and
with the Board of County Commissioners of Yakima County, Washington
Section 6. There is hereby granted to Yakima Valley Disposal, Inc., in
accordance with RCW 35 13.280 an exclusive franchise to collect and dispose
of certain garbage and refuse in the hereinbefore described real property
annexed to the City of Yakima, in accordance with the specific terms of
Ordinance No 3220 of the City of Yakima and in accordance with the terms of
the Franchise Agreement attached to Ordinance No 3220 of the City of Yakima.
Section 7. This ordinance shall be in full force and effect the first day of
the calendar month next following thirty days after its passage, approval and
publication as provided by law and by the City Charter

Legal Description
•
Beginning at the point of intersection of the extended south
right - of-way line of Fruitvale Boulevard with the existing
corporate limits line of the City of Yakima as established by
Annexation Ordinance B -2237;
Thence westerly along the south right -of -way line of Fruitvale
Boulevard to its intersection with the northerly right -of -way line
of Castlsvale Road;
Thence westerly along the north right -of -way line of Castlsvale
Road to the east right -of -way line of North 28th Avenue;
Thence northerly along the east right -of -way line of North 28th
Avenue to the point of intersection of the extended easterly
right -of -way line of North 28th Avenue and the north right -of -way
line of Fruitvale Boulevard;
Thence northwesterly along the northerly right -of -way line of
Fruitvale Boulevard to its intersection with the northerly
right -of -way line of River Road;
Thence easterly along the north right -of -way line of River Road to
the west line of said Section 14;
Thence northerly along the vast line of said Section 14 to the
Northwest Corner thereof;
Thence continuing northerly, along the vest line of Section 11,
Township 13 North, Range 18 East, W.K. to the center of the Neches
River;
• Thence in a generally easterly direction along the center of the
Naches River to its intersection with the east line of the
Southwest Quarter of said Section 11;
Thence southerly along the east line of said subdivision to the
Southeast Corner thereof;
Thence southerly along the oast line of the Northwest Quarter of
aforesaid Section 14 to the south right -of -way line of River Road;
Thence easterly along the south right -of -way line of River Road and
said south right -of -way line extended to the easterly right -of -way
line of North 20th Avenue, being a point on the existing corporate
limit line as described in Annexation Ordinance 3133;
Thence southerly along the westerly lines of parcels described in
Annexation Ordinances 3133 and 602, to the existing corporate limit
line of the City of Yakima as established by Annexation Ordinance
B -2237 located in Fruitvals Boulevard;
Thence following said corporate licit line westerly and southerly
to a point on the extended south right- of-vay line of Fruitvale
Boulevard, said point being the point of beginning.
Except that portion previously annexed as the City Shop complex
under Annexation Ordinance 2009.

Comes now, the following named person(s), firm(s) or corporation(s)
and petition the City Council of the City of Yakima that the following described property situate in
Yakima County, Washington, to - wit.
See attached Legal Description (on reverse)
be annexed to the City of Yakima, and in support of said Petition, the above named person(s), 41,
firm(s) or corporation(s) allege and show that they are the owners of not less than 75 percent in
value according to the assessed valuation of said property for which annexation is petitioned, that
said property is not now within the limits of any incorporated town, that said property is contiguous
to the City of Yakima, that a plat or drawing of the boundaries of said property which is sought to be
annexed is attached hereto, that the City Council of the City of Yakima has determined that it will
accept the proposed annexation and that it will require the assumption of existing City
indebtedness by the area proposed by this petition to be annexed, as reflected by the following
quotation from the minutes of the August 28. 1990 meeting of the Yakima City Council
It was duly moved, seconded and passed that the annexation proposed by petition No.
1 1 07 (Notice of Intention to Commence Annexation Proceedings) be accepted by the City of
Yakima and that the area sought to be annexed be required to assume the City's existing
indebtedness "
The petitioners agree to pay the expenses of publications and posting of notices of this petition,
and to assume and pay existing City indebtedness.
WHEREFORE, petitioners pray that the City Council make and enter an Order fixing the time and
place of hearing this petition pursuant to R.0 W 35 13140, that due notice be given of such
hearing and that upon a hearing the said property be annexed to the City of Yakima.
