HomeMy WebLinkAbout1991-3400 Uniform Sign Code t ORDINANCE NO 1' AN ORDINANCE relating to building regulations; adopting by reference, and amending certain sections of, the Uniform Sign Code, 1991 Edition, copyright 1991 by the International Conference of Building Officials; amending Sections 11 08 010, 11 08 020, 11 08 025, 11 08 027 and 11 08 029, all of the City of Yakima Municipal Code WHEREAS, R C W 35 21 180 authorizes cities within the State of Washington to pass ordinances adopting by reference printed compilations and codes, and WHEREAS, the City Council of the City of Yakima has heretofore examined and understands the scope and purpose of the regulations of the Uniform Sign Code, 1988 Edition, copyright 1991 by the International Conference of Building Officials, and deems it in the best interest of the City that such Uniform Sign Code be adopted as the law of the City of Yakima, and WHEREAS, one or more copies of such Uniform Sign Code have heretofore been filed in the office of the Code Administration Manager of the City of Yakima for use and examination by the public, as required by law, now, therefore, BE IT ORDAINED BY THE CITY OF YAKIMA Section 1 Section 11 08 010 of the City of Yakima Municipal Code is hereby amended to read as follows "11 08 010 Adoption of Uniform Sign Code The Uniform Sign Code, 1991 Edition, of the International Conference of Building Officials, of which not less than one or more copies have been and now are on file in the office of the Code Administration Manager of the City of Yakima, is hereby adopted and incorporated as fully as if set out in full herein, as the Sign Code of the City of Yakima, except as hereinafter amended, and the provisions and regulations of the City of Yakima; and the several sections or numbers therein shall constitute, and may be referred to as, the numbers of this chapter " Section 2 Section 11 08 020 of the City of Yakima Municipal Code is hereby amended to read as follows "11 08 020 Ampn mpnt to Section 103 Section 103 of the Uniform Sign Code, adopted by this chapter, is hereby amended to read as follows RESORD /N1 1 8/8/91 'Sec. 103 Enforeeme'nt A► (a) Authority The Code Administration Manager or his representative is hereby authorized and directed to enforce all the provisions of this code For these purposes, the Code Administration Manager shall have the power of a law enforcement officer (b) Right of Entry Whenever necessary to make an inspection to enforce any of the provisions of this code, or whenever the building official or his authorized representative has reasonable cause to believe that there exists in any building or upon any premises any condition or code violation which makes such building or premises unsafe, dangerous or hazardous, the building official or his authorized representative may enter such building or premises at all reasonable times to inspect the same or to perform any duty imposed upon the building official by this code, provided that if such building or premises be occupied, he shall first present proper credentials and request entry; and if such building or premises be unoccupied, he shall first make a reasonable effort to locate the owner or other persons having charge or control of the building or premises and request entry If such entry is refused, the building official or his authorized representative shall have recourse to every remedy provided by law to secure entry When the building official or his authorized representative shall have first obtained a proper inspection warrant or other remedy provided by law to secure entry, no owner or occupant or any other persons having charge, care or control of any building or premises shall fail or neglect, after proper request is made as herein provided, to promptly permit entry therein by the building official or his authorized representative for the purpose of inspection and examination pursuant to this code (c) Board of Appeals In order to provide for reasonable inter- pretation of the provisions of this code there is hereby established a Board of Appeals as provided in the Building Code (d) Violations It shall be unlawful for any person, firm or corporation to erect, construct, enlarge, alter, repair, move, improve, remove, convert or demolish, equip, use or maintain any sign or sign structure in this jurisdiction, or cause or permit the same to be done, contrary to or in violation of any of the provisions of this code Any condition resulting from such unlawful conduct shall be a public nuisance subject to abatement by the City of Yakima through civil action '" $PCtion 3 Section 11 08 025 of the City of Yakima Municipal Code is amended to read as follows "11 08 025 pmencimant to Section 203 Section 203 of the Uniform Sign Code, adopted by this chapter, is hereby amended to read as follows RESORD /N2 2 8/8/91 MF 'SPc.. 203 BUILDING CODE is the Uniform Building Code promulgated by the International Conference of Building Officials, as enacted by the City of Yakima BUILDING OFFICIAL is the Code Administration Manager or his representative '" Section 4 Section 11.08 027 of the City of Yakima Municipal Code is amended to read as follows "11 08 027 amendment to Section 214 Section 214 of the Uniform Sign Code, adopted by this chapter, is hereby amended to read as follows 'Sec. 214 SIGN is any medium, including its structure and component parts, which is used or intended to be used to attract attention to the subject matter for advertising purposes other than paint on the surface of a building SIGN STRUCTURE is any structure which supports or is capable of supporting any sign as defined in this code A sign structure may be a single pole and may or may not be an integral part of the building SHALL is defined to have the following meaning (a) With respect to the functions and powers of the Director of Community and Economic Development, Code Administration Manager, any gill agents and employees of the City of Yakima and any board authorized hereunder, a direction and authorization to act in the exercise of sound discretion and in good faith; (b) With respect to the obligations upon owners and occupants of premises and their agents, a mandatory requirement to act in compliance with this code at the risk of civil and criminal liability upon failure so to act STRUCTURE is that which is built or constructed, an edifice or building of any kind, or any piece of work artificially built up or composed of parts joined together in some definite manner '" Section 5 Section 11 08 029 of the City of Yakima Municipal Code is amended to read as follows "11 08 029 Ampnempnt to Se't {on 301 Section 301 of the Uniform Sign Code, adopted by this chapter, is hereby amended to read as follows 'Sec. 301 Permits Required A sign shall not hereafter be erected, re- erected, constructed, altered or maintained, except as provided by this code and after a permit for the same has been issued by the building official.
