ORDINANCE NO.-
AN ORDINANCE annexing property to the City of Yakima and zoning said
property. (East Viola/Frontage Road Annexation)
WHEREAS, proceedings have been held in accordance with all
applicable laws for the annexation to the City of Yakima of the property
hereinafter described, and
WHEREAS, a notice of intention was filed with the Yakima County
Boundary Review Board as required by law for this annexation, and
WHEREAS, on July 11, 1991, the Board of Yakima County
Commissioners filed with the Boundary Review Board a request that the
Boundary Review Board invoke jurisdiction and review the East Viola/Frontage
Road annexation proposed by the City of Yakima as documented in its Notice of
Intention filed June 4, 1991, and
WHEREAS, on October 25, 1991, the Board of Yakima County
Commissioners withdrew its request for review of said East Viola/Frontage
Road annexation, and
WHEREAS, on October 31, 1991, the Boundary Review Board adopted a
written resolution and decision wherein the East Viola/Frontage Road
annexation was deemed approved in accordance with RCW 36 93.100, and
WHEREAS, pursuant to due and legal notice, the City Council held a
public hearing on said annexation on the 19th day of November, 1991; and, as
a result thereof, finds that such property should be annexed to the City of
Yakima and further finds that the property should retain its current zoning
pursuant to the Yakima Urban Area Zoning Map and that such zoning and
classification is in accord with the Yakima Urban Area Comprehensive Plan, the
General Plan of the City of Yakima, that owners of not less than seventy-five
percent of the assessed valuation of property within the area described below
have petitioned the City Council for annexation. that the needs of the City and
community do require the hereinafter set forth zoning classification, and the
highest and best use for said property is as hereinafter determined, now,
therefore,

BE IT ORDAINED BY THE CITY OF YAKIMA:
S ection 1. The property identified on the map attached hereto as Exhibit
W and legally described in Exhibit 'BTM, attached hereto and incorporated by
reference herein, is hereby annexed to the City of Yakima, Washington.
Section 2. The owners of the hereinbefore described real property
annexed to the City of Yakima shall be required to assume existing
indebtedness of the City of Yakima.
Section 3. The hereinbefore described real property annexed to the City
of Yakima is hereby zoned as It is currently zoned and depicted on the official
zoning map for the unincorporated portion of the Yakima Urban Area which
map. is maintained in the Yakima County Planning Department and which map
is incorporated herein by reference
Section 4. The next regularly amended Zoning District Map prepared by
and for the City of Yakima shall show said property as hereinbefore zoned and
classified.
Section 5, The City Clerk is hereby authorized and directed to file a
certified copy of this ordinance with the County Auditor of Yakima County and
IP with the Board of County Commissioners of Yakima County, Washington.
Section 6. There is hereby granted to Yakima Valley Disposal, Inc., in
accordance with ACW 35 13.280 an exclusive franchise to collect and dispose
of certain garbage and refuse in the hereinbefore described real property
annexed to the City of Yakima, in accordance with the specific terms of
Ordinance No 3220 of the City of Yakima and in accordance with the terms of
the Franchise Agreement attached to Ordinance No. 3220 of the City of Yakima.
Section 7. This ordinance shall be in full force and effect the first day of
the .calendar month next following thirty days after its passage, approval and
publication as provided by law and by the City Charter.

ANNEXATION
All that portion of the Northeast Quarter of the Southeast Quarter of
Section 29. Township 13 North. Range 19 East, W.M. described as
follows:
Beginning at the intersection of the east right -of -way line of
Primary State Highway #3 (S.R. -82) with the north line of the
Southeast Quarter of the Southeast Quarter of said Section 29,
said point being on the corporate limits of the City of Yakima;
thence northerly. along the east right -of -way line of said
Highway to the southerly right -of -way line of S.R -24 and the
corporate limits of the City of Yakima; thence easterly, southerly
and westerly, along said corporate limits to the point of
beginning.
