HomeMy WebLinkAbout1992-3433 Tahoma Cemetary ORDINANCE NO. 3433 AN ORDINANCE related to public service and utilities; amending rules and regulations for Tahoma Cemetery; and amending Section 7.04.090 of the City of Yakima Municipal Code. BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. Section 7.04.090 of the City of Yakima Muni- cipal Code is hereby amended to read as follows: "7.04.090 Rules and Regulations. Following are the rules and regulations, including schedules of fees and charges, applicable to the operation of Tahoma Cemetery: A. Grave sizes are as follows: 'State' shall mean an outside measurement of approx- imately 31 x 86 inches. 'Regular' shall mean an outside measurement of approximately 29 x 86 inches. '5 -0' shall mean an outside measurement of approxi- mately 24 x 73 inches. '4 -0' shall mean an outside measurement of approxi- mately 20 x 60 inches. '3 -0' shall mean an outside measurement of approxi- mately 20 x 47 inches. '2 -0' means an outside measurement of approximately 18 x 37 inches. 'Extra state' means an outside measurement of ap- proximately 35 x 86 inches. 'Jumbo' means an outside measurement of approximate- ly 37 x 92 inches. 'Concrete vaults' means an outside measurement of approximately 36 x 92 inches. B. Commencing March 1, 1992, the following schedule of fees and charges shall be in effect and applicable at Tahoma Cemetery. With the exception of the Washington State Department of Social and Health Services, the United States Veterans Administration, and funeral homes located within the State of Washington, all fees and charges shall be paid in advance, for burials. The size of grave liners or vaults in all cases is determined by the funeral director in charge. Double - deep interments shall be permitted with the consent of the Parks & Recreation Manager. All graves shall be numbered with a permanent number and an accurate record kept of the name of the decedent and the number of the grave. D. Persons with dogs or firearms shall not be permitted to enter the grounds, except that this shall not apply to use of firearms in military service. The speed limit for vehicular traffic within the cemetery is established at fifteen (15) miles per hour. 110 - 3 - (ord /tahoma.sc) E. Application for interment or disinterment must be made to the Parks & Recreation Manager at least twenty - four (24) hours in advance of such interment or disinter- ment. F. A burial permit must, in all cases, be filed with the Parks & Recreation Manager before interment. G. Interments, disinterments, or removals will not be allowed on Sunday, on a legal holiday, or on Saturday afternoon, except in cases of an emergency, as determined by'the Parks & Recreation Manager. H. The charge for exhuming bodies will be the same as the opening and closing charge as specified in the fore- going schedule. I. All interments must be made in cement liners, cement vaults, or steel vaults. The cement liners shall be made according to specifications designated by the Parks & Recreation Manager. J. No tombs shall be erected on top of the ground. Foundations for all monuments shall be built by the City only, at the expense of the owner. All foundations must be six (6) inches larger all around than the base of the monument to a depth of six (6) inches, and said founda- tion must be flush with the ground level. All monuments in Section D and E shall have a maximum height of thirty (30) inches. Footstones will not be allowed in the cemetery, provided that this section shall not apply to footstones presently existing in the cemetery. All monuments must be set in line; monuments in the west row of each block must face west, monuments in the east row of each block must face east according to the cemetery survey; except on the tracts of irregular shape in which case the Parks & Recreation Manager will determine the setting. All bases for monuments must be made of granite or marble. No sandstone or artificial base will be permitted. No headstones will be allowed in new sections or in the Masonic baby plot. All markers placed in Section L, in the Masonic baby plot, and in that part of Section E lying south of a line drawn from the southwest corner of Block 35 to the southeast corner of Block 29, and west of a line drawn from the southeast corner of Block 29 to the southeast corner of Block 68, thence west to the southwest corner of Block 67, thence south to the southwest corner of Block 144, shall be level with the ground. Markers for single graves are not to exceed twenty -four (24) inches in length nor twelve (12) inches in width. Double markers will not exceed thirty -six - 4 - (ord /tahoma.sc) (36) inches in length and twenty -four (24) inches in width. No ledger type markers will be allowed in any location, provided that this section shall not apply to ledgers presently existing in the cemetery. All monument setting fees must be paid in full prior to the installa- tion of any monuments. K. The indiscriminate planting of trees and shrubs in the cemetery is prohibited, and it shall be the duty of the Parks & Recreation Manager to remove all landscape features determined by him to be objectionable. If trees or shrubs in any lot become detrimental to adjacent lots or avenues in the judgment of the Parks & Recreation Manager, he shall remove them. L. Coping, fences, posts, and chains, and all wooden structures about lots, blocks, or graves, are prohibited; and, if any inscription, monument, effigy or other struc- ture, which the Parks & Recreation Manager deems offen- sive or improper, is placed in or upon any lot or grave, the same shall be removed upon order of the said superin- tendent. M. Funeral designs and floral pieces will be removed as soon as the same become unsightly or interfere r.ith mowinc. in the judgment of the Parks & Recreation Manager, to a place designated by him N. Due to the inconvenience to mowing and grounds main- tenance, artificial floral pieces will be treated the same as natural flowers during the period from April 1st to October 31st. O. Receptacles or cut flowers must be sunk level with the ground, thus insuring the safety of such articles - and facilitating the cutting of the grass from the grave. Tin cans sunk in the ground are prohibited. Receptacles must be approved by the Parks & Recreation Manager. P. All employees or other workmen engaged in performing work within the confines of the cemetery shall be under the supervision and direction of the Parks & Recreation Manager. Visitors must not interfere with the perform- ance of duties of any employee or groundskeeper. Q. Lost and found articles are to be turned in to the Parks & Recreation Manager's office. R. All paper and other rubbish must be deposited, by the person responsible therefor, in a receptacle provided for that purpose. 1 - 5 - (ord /tahoma.sc) S. As provided for by this chapter, any owner desiring to deed a part of his tract to another person must have a record of his deed noted on the cemetery records in the office of the City Clerk and of the Parks & Recreation Manager, and have stamped on the deed the approval of the transfer by the City. T. The Parks & Recreation Manager is authorized and directed to expel from the cemetery any person disturbing its sanctity by boisterous or other improper conduct, or who shall violate any of the foregoing rules. U. (1) Lots may be purchased on installment contracts in the form provided by the City. Services for which payment can be made by installment are those relating to provision of a designated burial space, endow- ment /perpetual care, interment, liner /vault, and the base setting fee. Installment contract provisions shall include: payment in full before burial, interest at one percent (1 %) per month on late payment, payment of attor- ney's fees in event of suit by the City, and reversion of the lot to the City (a) upon default in payment longer than six (6) months past the due date, (b) if the pur- chaser or owner dies intestate and heirless, and (c) when written communication from Tahoma Cemetery office to the purchaser or owner remains unanswered for more than seven (7) years from mailing. Further, the contract shall be subject to Tahoma Cemetery rules and regulations, in- cluding those adopted after contract execution, and the 411 purchaser's obligation shall be personal in nature, to be borne by purchaser's heirs, successors, and assigns. (2) Contracts will be signed and notarized and kept on file in the cemetery office. All contracts will require a ten percent (10 %) down payment with appropriate payment schedule designated. Contracts for endowment care lots shall require payment in full within twelve (12) months. A deed to the endowment care lot(s) will be mailed from the City of Yakima Clerk's office to the lot owner within thirty (30) days of final payment. A com- bined contract for an endowment care lot and pre -need services shall require payment in full within twenty -four (24) months. A one percent (1 %) per month interest will be charged on the amount of any payment that is more than ten (10) days past due. (3) All contracts must be approved and signed by the Public Works Director or the Parks & Recreation Director before acceptance. All contracts will constitute a personal obligation on the part of the purchaser(s) and also shall be binding on the purchaser(s)' heirs, successors, and assigns. - 6 - (ord /tahoma.sc) • r µi,l (4) No refunds on r endowment care lots or pre -need 41/ services will be given." Section 2. This ordinance shall be. in full force and effect 30 days after its passage, approval, and publication as provided by law and by the City Charter. Purchaser agrees to purchase from Seller for services, property and/or burial rights itemized as follows: 1.1.OT 2.QUARTER 3.BLOCK 4.SECTION located in Tahosna Cemetery, Yakima County, Yakima, Washington. The Purchaser of a lot shall not have any rights in or to such lot until the total cash price of goods and services, as shown above, has beenpaidm full. Purchaser at any time may pay the entire outstanding principal balance in satisfaction • 2. of the obligation of this section. In the event of delinquency in payment, interest will be charged at the rate of one percent (1%) per month on the unpaid payment anount. Should any payment become ninety (90) days past due, the entire remaining unpaid balance shall immediately become due and payable. Acceptance by the Sella of any delinquent payment shall not constitute a waiver or estop the Sella from enforcing the provisions of this paragraph. 3. The obligation of this agreement is a personal obligation on the pan of the Purchaser and the Purchaser's heirs, successors, and assigns. 4. In the event court action (which also refers to arbitration) is instituted by the Sella to enforce the collection of all or any part of the principal or interest called for herein, the Purchaser shall pay a reasonable attorney's fee to the Sella. Venue shall lie in Yakima County Washington. S. This agreement is subject to the Rules and Regulations of Tahoma Cemetery in existence now and as hereinafter adopted or amended. These Rules and Regulations may be examined in the Public Works Administration Office during normal business hours. 6. The Purchaser shall receive a copy of this agreement at the time it is fully executed This agreement is not effective if the 'Cash Price of Goods and Services line (above) is blank or if unsigned by a City representative. 7 The Purchaser may cancel this agreement at any time prior to midnight of the third ( 3rd) business day after the date of this transaction. A written notice of cancellation must be provided by Purchaser to Sella at its offices located at 2301 Fruity ale Boulevard, Yakima, Washington. No contract can be cancelled by Purchaser or owner, for any reason including non -use, when four (4) calendar days have elapsed after the Purchaser has signed this contract. 8. The Purchaser must notify the cemetery office of any change of address or of any transfer of ownership/assignment of rights obtained in this sales agreement. No one shall be interred in • lot who does not have an interest provided by this agreement, except by prior written consent of all interested patties and of the City of Yakima The persons who are the parties currently contemplated to be interred in this lot are: 9. Under the following circumstances, all rights in the involved lot, including burial rights, are returned in full and permanently to the City of Yakima, which then has no obligation to refmd any money or provide farther services to the Purchaser or any heir, transferee, assignee, or beneficiary 1 Default in payment which continues for more than six (6) months past the due date; 2. No response to written communications from the Tehoma Cemetery office when the date of mailing of the last communication, addressed to the lot owner's address on file, has remained unanswered for more than seven (7) years from the date of mailing of same; 3. The Purchaser or owner has died intestate and heirless. 10. If approved, a one (1) year payment plan contract would be available with this service. This is an unbudgeted policy issue 2 a. Yearly interest, generated from the Trust Fund, is transferred to the Cemetery Operating Fund and used, to help offset annual operations costs for Cemetery maintenance and services.
