AN ORDINANCE of the City of Yakima, Washington ordering cer-
tain local improvements and creating a local
improvement district; providing for the payment
of the cost of such improvements by special
assessments; creating a local improvement dis-
trict fund; and providing for the issuance and
sale of local improvement district bonds and
interim financing warrants or notes.
WHEREAS, on May 26, 1992, the City Council of the City of
Yakima, Washington (the "City ") adopted Resolution No. D -6124
declaring its intention to order certain local improvements
within the City and to create a local improvement district;
and
WHEREAS, the proposed improvements are within the compre-
hensive plan of the City of Yakima, as amended; and
WHEREAS, a hearing was held on June 23, 1992, after
notice as provided by law, and after discussion of the pro -
. posed improvements and due consideration thereof and of all
objections thereto, the Council has determined to order the
local improvements described below and to create a local
improvement district; and
WHEREAS, estimates of the costs and expenses of the
proposed improvements, a description of the boundaries of the
district, a statement of what portion of fhe costs and ex-
penses of the improvements would be borne, by the property
within the proposed district, and a diagram showing the lots,
tracts, and parcels to be benefited and other information
pertaining to the proposed district, have been filed with the
City Clerk and certified to the City Council; now, therefore,
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. The City shall acquire, construct, and
install the following improvements within the following de-
scribed areas of the City:
That it is its intention to improve the
property within the following described
district with the reconstruction of North
1st Avenue per City of Yakima design

criteria for'heavy vehicles; all of said
improvements to be constructed in full
accordance with the plans and specifica-
tions to be prepared by the Office of the
City Engineer and filed with the City
Clerk.
Route of Improvement: North 1st Avenue
from Yakima Avenue to "I" Street
The nature and territorial extent of said
proposed improvement is as stated above.
The district to be served by and specially
benefited by and assessed for the above -
described improvement is situate in Yakima
County, Washington, and is all of the
property described below:
Beginning at a point on the Southerly Line
of Block 210 "Town of North Yakima, Now
Yakima," according to the Plat thereof
recorded in Volume A of Plats, Page 10 and
re- recorded in Volume E of Plats, Page 1,
Records of Yakima County, Washington,
situate 121.5 feet Southwesterly of the
most Easterly corner thereof;

Thence Northwesterly parallel with the
Easterly line of Blocks 210, 209 and 208,
and said line extended, to a point on the
Northwesterly Line of said Block 208
situate 121.5 feet Southwesterly of the
most Northerly corner thereof;
Thence Northwesterly to the most Southerly
corner of Lot 1, Block 207, said Town of
North Yakima;
Thence Northwesterly to the most Westerly
corner of Lot 1 of said Block 207;
Thence Northwesterly to a point on the
Northerly Line of "D" Street situate 127
feet Southwesterly of its intersection
with the Westerly Line of 1st Avenue;
Thence Northwesterly parallel with the
West Line of 1st Avenue to the South Line
of Cherry Avenue;
Thence Northwesterly to a point on the
North Line of said Cherry Avenue situate

145.5 feet Westerly of its intersection
with the Westerly Line of 1st Avenue;
Thence Northwesterly parallel with the
Westerly Line of 1st Avenue 466.15 feet;
Thence Northwesterly to the Southwest
corner of Lot 6, "Millview Addition to
Yakima, Now Yakima," according to the plat
thereof recorded in Volume A of Plats,
Page 113, Records of Yakima County;
Thence Northerly along the West Line of
said Lot 6 and said line extended, to the
South Line of Block 2 of said Millview
Addition;
Thence Westerly along the South Line of
said Block 2 and said line extended, to
the center of vacated alley adjacent
thereto;
Thence Northerly along the center of said
vacated alley to the North Line of said
• Block 2;
Thence Easterly along the North Line of
said Block 2 to the extended West Line of
Block 3 of said Millview Addition;
Thence Northerly along the West Line of
said Block 3 to the North Line thereof and
the South Line of Lot 16 "Leamings Addi-
tion to North Yakima" according to the
Plat thereof recorded in Volume A of
Plats, Page 71, Records of Yakima County;
Thence Westerly along the South Line of
said Lot 16 to the West Line of the East-
erly 150 feet thereof;
Thence Northwesterly parallel with the
East Line of said Lot 16 and said lot
extended, to the South Line of said Lot
15, Leamings Addition;
Thence Southwesterly along the Southerly
Line of said Lot 15 to the most Southerly
corner thereof;
Thence Northerly along the West Line of
said Lot 15 to the Northwest corner there-
of;

Thence Northerly to the Southwest corner
of Lot 10, said Leamings Addition;
Thence Northerly to the corner common to
Lots 10 and 8 of said Leamings Addition;
Thence Westerly along the South Line of
said Lot 8 to the Southwest Corner there-
of;
Thence Northerly along the West Line of
said Lot 8 and said lot extended, to the
North Line of the Southeast Quarter of
Section 13, Township 13 North, Range 18
E.W.M.;
Thence Easterly along said North Line to
the Westerly Right -of -Way of the Washing-
ton Central Railroad;
Thence Southeasterly along said Right -of-
Way line to the centerline of West Yakima
Avenue;
Thence Southwesterly along the centerline
of West Yakima Avenue to a point bearing
Southeasterly parallel with the West Line
of 1st Avenue, from the Point of Begin-
ning;
Thence Northwesterly to the Point of
Beginning.
The above described parcel being situate
within the Northeast Quarter of Section
24, and the Southeast Quarter of Section
13, all in the Township 13 North, Range 18
E.W.M., Yakima County, Washington.
The foregoing improvements are hereafter referred to as
the "Improvements."
Section 2. The plans and specifications for the Improve-
ments, as prepared by the City of Yakima, and now on file in
the City Clerk's office, are hereby adopted and approved. The
Improvements, when completed, shall be in accordance with said
plans, the provisions of this ordinance and any other ordi-
nance as hereafter may be adopted in connection herewith;
provided, however, that changes in detail of such plans that

� 41110 do not significantly alter the scope or costs of the Improve-
ments will not require further approval.
Section 3. There is hereby established a local improve-
ment district of the City to be known as "Local Improvement
District No. 1049" (herein referred to as "LID No. 1049 ").
The boundaries of LID No. 1049 shall be as described in
Exhibit A attached hereto and incorporated herein by this
reference.
It is hereby found that the above - described boundaries
embrace as nearly as practicable all the property specially
benefited by the Improvements.
Section 4. The total cost and expense of the Improve-
ments thereto is estimated to be $1,650,000.00 of which 30%
shall be borne by and assessed against the property within LID
No. 1049 specifically benefited by the Improvements. Assess-
ments shall be made against the property within LID No. 1049
in accordance with the special benefits accruing to such
property.
Section 5. Upon completion of the Improvements, an
assessment roll shall be prepared and, after notice and hear-
ing in the manner provided by law, an assessment roll shall be
confirmed. Assessments not paid within the 30 -day prepayment
period provided by law shall be payable in installments and
the City shall issue improvement district bonds payable from
such unpaid installments. The number of years said install-
ments shall run, the dates of payment of the same and the rate
of interest that the unpaid installments shall bear shall be
as hereafter fixed by ordinance.
Section 6. There is hereby created a fund of the City to
be known as the "Local Improvement District No. 1049 Fund" for
the purpose of paying the cost of the Improvements provided
for in this ordinance and into which there shall be paid all
of the assessments collected in LID No. 1049 as and when
directed by the ordinance confirming the assessment roll. All
moneys received and warrants drawn on the LID No. 1049 Fund

shall be deposited into said Fund, and applied solely in
payment of the costs and expenses of the Improvements.
Section 7. This ordinance shall be in full force and
effect 30 days after its passage, approval, and publication as
provided by law and by the City Charter.
