HomeMy WebLinkAbout1992-3486 Revision ORDINANCE NO. 3 4 8 6 AN ORDINANCE. approving revision of the previously approved Chestnut Grove subdivision on 50th Avenue between Chestnut and Summitview, approving Class 3 uses in a R -2 Zone, reaffirming previously granted adjustments of front and side yard setback adjustments, reaffirming prior approval of a retirement home, and revising North 50th Avenue by narrowing the street to limit use of the street by other than passenger vehicles. WHEREAS, a master application for revision of the previously approved Chestnut Grove subdivision on 50th Avenue between Chestnut and Summitview has been filed, the application seeking approval for (1) changing the existing long -plat to eliminate one lot and to convert undeveloped public rights -of -way to private streets, (2) permitting Class 3 uses, (3) permitting adjustment of front and side yard setback adjustments, and (4) revising North 50th Avenue between Chestnut and Summitview to result in slower traffic speeds; and WHEREAS, the necessary number of persons having an ownership • interest in the portions of the subdivision to be altered have signed the application for plat alteration and right -of -way vacation, in accordance with RCW 35 79 and RCW 58.17, and WHEREAS, after due notice and hearing by the City of Yakima Hearing Examiner, and after due notice and hearing before this Council, the City Council has considered the application, all -materials pertinent to it, and physical characteristics of the proposed subdivision site, and finding that approval of the application serves the public use and interest of the City, now, therefore, BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1 Alteration of the plat of Chestnut Grove, recorded in Volume "CC" of Plats, page 27, records of Yakima County, Washington, and vacation of public rights -of -way and utility easements thereon are hereby approved and granted in the following respects: A. Preliminary Replat. Preliminary approval of the replat is hereby granted pursuant to YMC 14.25.160, valid for three (3) years. Approval of the final plat is conditioned on: (1) The final amended plat being in substantial conformity • with the preliminary replat dated February 10, 1992, and the revised site plan dated June 8, 1992 (hereafter "site 1 (ls)ord /chstnutgrove.sc plan"), with respect to lot sizes, layout, road alignment and `design, utility placement and easement, street lights, fire • hydrants, and sidewalks, (2) Preparation in conformance with YMC 14 25 The westerly boundary of the amended plat shall reflect that area, if any, transferred to this property through the vacation of the adjoining railroad right -of -way, (3) Servicing of each lot with public sewer and domestic water, (4) Placement underground of all public and private utilities, (5) Installation of fire hydrants at locations and to the specifications of the City of Yakima Code Administrator, and (6) Completion of all required plat improvements, including but not limited to roads, utilities, streets, sidewalks, community water system and drainage facilities, or a surety or bond pledged to ensure installation within one (1) year of subdivision approval. No recording of the final amended plat nor issuance of building permits shall occur before this condition is fulfilled. B Vacation of Public Right - Of - Way and Utility Easements. Vacation of existing utility easements is granted on the following conditions (1) full and accurate description of all such easements, submitted and acceptable to the City Engineer, and (2) inclusion of new public utility easements in the final amended plat. Vacation shall become effective when the amended plat is duly recorded with the • Yakima County Auditor All undeveloped public right -of -way and utility easements are vacated without compensation. Public right -of -way and utility easements subject to vacation are located within the undeveloped portions of Lot 1 and former Lots 2 and 3 (now combined into reconfigured Lot 2), east of the north /south right -of -way of North 50th Avenue. Any such vacation is subject to approval of the final amended plat and the submittal of a complete and accurate legal description, acceptable to the City Engineer, of the right -of -way G Road Improvements. Approval of the final amended plat is subject to (1) conformance of road improvements to those in the preliminary replat and (2) completion of the following road improvements: (1) City Engineer approval of drainage facilities for the public streets. (2) City Engineer approval of the following alterations to Chestnut Avenue: street surfacing, barrier curb, gutter, and five foot wide sidewalks along the frontage of Chestnut Grove. (3) Initial installation by applicant of appropriate "no parking" signs and "truck traffic restricted" signs on North 50th Avenue and street modifications narrowing North 50th Avenue as shown on the site plan, in 111 2 (Is)ord /chstnutgrove.sc • compliance with City standards and City approval of construction plans. (4) Construction of a commercial driveway approach for entry to Lot 2 from Chestnut Avenue, such approach to be no more than 30 feet in width if striped for two lanes or 35 feet in width if striped for three lanes. (5) Construction of a commercial driveway approach for entry to Lot 2 from North 50th Avenue, as shown on the site plan. (6) Signage of private streets in accordance with private street signing standards of the City of Yakima. D. Dust Control. A method of dust control during the construction phases shall be submitted to and approved by the Yakima County Clean Air Authority A written copy of its approval shall be submitted to the Department of Economic Development prior to construction of any work phase. The developer shall designate a responsible party for contacts during working hours regarding complaints of air quality violations. E. Planned Residential Development. Approval is hereby granted for single - family, duplexes, and multi - family units as a Class 3 use on new Lot 2, subject to the following conditions: (1) Development shall be in substantial conformance to the site plan. (2) Development on Lots 1 and 2, as amended, may provide for • no more than 153 dwelling units, consisting of 24 on Lot 1 and 129 on new Lot 2 (3) A solid six foot fence shall be constructed along the westerly property line of Lot 2, such westerly property line to be adjusted upon vacation of the railroad right -of- way. (4) Approval by the Department of Economic Development of a final site plan that includes a landscape plan, drainage plan, and subdivision and street signage plan. F Adjustment of Setback Standards. The front yard setback for Lot 1 is hereby approved to be 39 feet 4 inches from the centerline of North 50th Avenue; the side yard setback is hereby approved to be 34 feet 8 inches from the centerline along the east side of North 50th Avenue. The rear yard setback for Lot 2 is hereby approved to be 10 feet from the northerly property line. G. Class 3 Use for Retirement Home. The retirement home as described on the site plan is hereby approved for Lot 5, subject to the following: (1) The retirement home shall consist of no more than 100 residential units, with at least 111 parking spaces. The dimensions of the building shall be approximately 96 feet by 360 feet, and no more than 35 feet high. (2) Commercial curb cuts shall be in conformance with City • standards on North 50th Avenue. (3) Site screening standard "C" shall be installed along westerly and southerly property lines. On the west side, 3 (ls) ord /ch s tnu tgrove.sc the property will be fenced with a six foot high fence and have a 40 foot setback together with a landscape screen to • further minimize impact. The parking area for the apartments will be screened by a six foot high cedar fence and a seven foot wide landscaped buffer. (4) The parking lot shall be constructed in accordance with YMC 15.06. (5) Signing shall be in conformance with YMC 15.08. (6) Development shall conform to the definition of a retirement home in YMC 15.02.020. Section 2 The Findings, Conclusions, and Recommendation of the Hearing Examiner in UAZO Sub /Replat #1 -92 and CL(3) #5 -92 (Examiner No. I92- 41 -12) are attached hereto, incorporated herein and made a part hereof, with the exception of that portion of paragraph 13 in the Recommendation, by which the Hearing Examiner suggested that a waiver for building permits be made by the Yakima City Engineer Further, the City Council specifically finds that the standards of YMC Sec. 14.25 110 are satisfied, and the proposed subdivision conforms with YMC Title 15 and all other applicable City land use controls. No public use is served by retaining title to any lands previously dedicated to public use in the original Chestnut Grove Plat, as the reconfiguration of internal property lines has resulted in new land for public • use consistent with new uses hereby approved. Appropriate provision has been made for all features designated in RCW 58.17.110. Section 3 At the time of filing of the final plat, applicant Group M Construction shall produce a revised drawing of the hereinabove approved alteration of the plat, which the Mayor is hereby authorized to sign and which the applicant shall file with the Yakima County Auditor Section 4 This ordinance shall be in full force and effect 30 days after its passage, approval, and publication as provided by law and by the City Charter pit PASSED BY THE CITY COUNCIL, signed and approved this Li Try day of , 1992.
