AN ORDINANCE relating to public services and utilities -- specifically domestic
water service; creating an exemption as to the manner of water
service connection in the "Yakima Railroad Area," creating
exemptions to water ready -to -serve and minimum water
surcharges in said area, and amending Section 7 68 035,
Subsections 7 68 255B and 7.68 250B, and enacting Subsection
7 56.030F all of the City of Yakima Municipal Code.
WHEREAS, the City of Yakima has received from the Department of Ecology
under Grant No 69300117, a substantial monetary grant to provide for the extension
of domestic water mains, both within and outside the City, for the purpose of
alleviating ground water contamination in an area called the Yakima Railroad Area,
and
WHEREAS, said grant Nvill provide the complete cost of extending City water
mains and such an extension is intended by the Department of Ecology to induce
residents of the affected area to voluntarily- connect to the City's water system and
use City water in lieu of contaminated well water; and
WHEREAS, the City Council finds and declares that the Department of Ecology's
payment for the extension of such mains, without City expense, for the purpose of
abating health problems associated with drinking water contamination constitutes a
sufficient reason to W aive the City's connection charge, minimum service, and
ready -to -serve surcharges, now, therefor,
BE IT ORDAINED BY THE CITY OF YAKIMA.
Section 1 Section 7 68 035 of the City of Yakima Municipal Code is hereby
amended to read as follows.
"7 68 035 Service pipes laid by water department.
The installation of service pipes extending from the main to the
meter inside of the curbline, together with the necessary labor and
materials for such construction, shall be made by the water
division Provided, how e\ er. that within the area described on the map
Which appears below, the Yakima Railroad Area. the installation of
service pipes extending from the main to the meter inside ofe
curbline may be made by private contractors according to plans and .
specification approved by the water division superintendent or his,
designee. This exemption shall expire on December 31. 1995."

• Section 2 Subsection 7 56.030F of the City of Yakima Municipal Code is hereby
enacted to read as follows:
"7.56.030 Computation of charge.
F. No connection charge for domestic water service shall be imposed,
on the owner of any lot. tract. or parcel of property which was developed with
a business or residence prior to September 1. 1992. and the water connection is
entitled 'Grant No. 69300117 Yakima Water System Remedial Action Agreement
with City of Yakima'." - a true copy of which is on file in the water division.
Section 3 Subsection 7 68 250B of the City of Yakima Municipal Code is hereby
amended to read as follows:
"7.68.250 Water service charges.
B. The 'one -month period' is defined as any period of time from
one day up to and including one month and fourteen days, and the 'two -
month period' is defined as any period of time from one month and
fifteen days to two months and fourteen days.
Minimum ready -to -serve and consumption charges for water
supplied outside the city shall be computed by multiplying the
applicable rate above by one and one -half Provided. however. that
within the area described on the map found in Section 7.68,035 of the
IIP City of Yakima Municipal Code. the readv -to -serve charge and charge
for water consumed shall not be subiect to anv surcharge set out in this,
subsection."
Section 4 Subsection 7.68 2558 of the City of Yakima Municipal Code is hereby
amended to read as follows.
"7 68 255 Minimum service charges.
B The 'one -month period' is defined as any period of time from
one day up to and including one month and fourteen days, and the 'two -
month period' is defined as an) period of time from one month and
fifteen days to tu o months and fourteen days.
Minimum service charges for domestic water supplied outside the
cit) shall be computed by multiplying the applicable meter size rate by
one and one -half Provided. however. that within the area described on
the map found in Section 7.68.035 of the City of Yakima Municipal Code,
the surcharge found in thi subsection shall not be applicable."
Section 5 This ordinance shall be in full force and effect 30 days after its
passage, approval, and publication as provided by law and by the City Charter

Yakima Railroad Area Boundary Description
Beginning at the intersection of West Washington Avenue and South
8th Avenue, thence easterly along said West Washington Avenue to
its intersection with South 1st Street; thence northerly along said
South 1st Street to its intersection with East Mead Avenue; thence
easterly along said East Mead Avenue to its intersection with
Rudkin Road; thence northerly along said Rudkin Road to its
intersection with East Nob Hill Blvd.; thence westerly along said
East Nob Hill Blvd., to its intersection with South 10th Avenue,
thence northerly along said South 10th Avenue to its intersection
wath Pacific Avenue; thence westerly along said Pacific Avenue to
its intersection with South 4th Street, thence northerly along 4th
Street to its intersection with East Lincoln Avenue, thence
westerly along Lincoln Avenue to its intersection with North 8th
Avenue, thence southerly along said 8th Avenue to its intersection
with kest Washington Avenue, said intersection being the point of
beginning all properties, with habitable structures on them prior
to September of 1992, c.ithin and /or abutting this boundary are
potential recipients of City domestic water from the City of Yakima
under the terms of Ecology Grant #G9300117.

SUMMARY EXPLANATION
The Yakima Railroad Area Water Main Extension Project Grant Agreement required several
changes to existing City Ordinances
• 7 68 035 Changes in this section allow contractors to make the service installation
from the main to the meter This formerly was restricted to Water Division
crews
• 7 56 030F Changes in this section waives the connection charges for properties within
• the railroad area that are eligible to receive assistance from the grant funds.
• 7 68 2508
7 68 255B Changes in these sections eliminates the water rate surcharge of 1.5 times
the rate for customers within the contaminated area, but outside City
boundaries
In order to proceed, modification of these ordinances are required to carry out this project.
