HomeMy WebLinkAbout1982-2608 REZONE PROPERTY AT 25 NORTH FRONT STREET. 6 0 ORDINANCE NO. r' 9 0 `' 110 AN ORDINANCE accepting the recommendation of the Planning Commission and rezoning property at 25 North Front Street in the City of Yakima, Washington, from B-3, General Business Zone to a Planned Development Zone, and declaring an emergency. WHEREAS, pursuant to due and legal notice, the City Council of the City of Yakima held a hearing on the 23rd day of March, 1982, on the recommendation of the Planning Commission that real property situate at 25 North Front Street in the City of Yakima, Washington, the legal description of • which is set out hereinbelow, be rezoned from B-3, General Business Zone to Planned Development Zone, and WHEREAS, as a result of its hearing, the City Council determined that the rezone should be granted, and hereby makes its following findings and conclusions: FINDINGS: 1. The property for which the rezone is sought is located at 25 North Front Street in the City of Yakima, Washington, on which property is situate a building with historical significance as an "Opera House" and later as a brewery. •In more recent years, the premises has been used for a moving and storage business. 2. The owners seek a rezone from the current B-3, General Business Zone, to a Planned Development Zone in order to operate a brewery and tavern business with options •for a storage facility, a restaurant, specialty shops and offices, all as proposed by the applicant's Plan And Program for development and use of that property. 3. Property surrounding the subject premises is zoned 411 B-3, General Business Zone. No objections to the requested rezone were made by owners of property in the vicinity, or by anyone else, at either the Planning Commission or 410 City Council hearing on the rezone application. 4. The Plan And Program for the development and use of the premises maintains the historical value and design of the building and provides for adequate parking for the brewery and tavern business, and also provides adequate !II parking in the event the premises are developed for any of the optional uses mentioned above. 5. The Planning Commission recommended to the City Council that the request be granted for a Planned Development Zone. 6. The City Council finds that the developer must comply with unusual and time consuming licensing and permit pro- cedures in order to develop a brewery and tavern business, and further finds that a new sewer line must be installed in order to accommodate the installation of brewery facil- ities, all so as to constitute an emergency which the City Council hereby finds and declares to exist in order that this rezone ordinance may become immediately effective. CONCLUSION: 1. The brewery and tavern, as well as the four development options, are in keeping with desirable development for the site and the area. 2. The recommendation of the Planning Commission to grant the rezone should be affirmed and the rezone should be granted. 3. The rezone should be immediately effective. 410 now, therefore, BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. The recommendation of the Planning Commission of the City of Yakima that the following described real property situate at 25 North Front Street in the City of Yakima, Washing- ton, and more particularly described as follows, to wit: The Southern 20 feet of Lot 26 and all of Lots 27 and 411 28 of Block 10, Original Townsite of City of Yakima, as recorded in Volume "E" of Plats, Page 1, records of Yakima County, Washington. be rezoned from B-3, General Business Zone to Planned Development Zone be, and the same is hereby, approved and said real property 411 is hereby rezoned to a Planned Development Zone, all in accordance -2- with, and to conform to, the final development plan and program therefor approved by the Yakima Planning Commission, a copy of which is attached hereto and by reference made a part hereof. Section 2. The above change in zoning shall be included and depicted on the next regularly amended Use District Map • prepared by and for the City. Section 3. The City Clerk is hereby authorized and directed to file with the Yakima County Auditor a certified copy of this ordinance. Section 4. This ordinance is one to provide for the immediate preservation of the public peace, property, health, 11/ safety and welfare of the people of the City of Yakima and an emergency is hereby declared to exist and this ordinance shall be in full force and effect immediately upon its passage, approval and publication as provided by law and by the City Charter.
