AN ORDINANCE relating to zoning, modifying the minimum fence
setback requirements, deleting District Court
111 jurisdictional requirements in zoning enforcement
actions and amending Sections 12.60.230 and 12.
88.040 of'the City of Yakima Municipal Code.
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. Section 12.60.230 of the City of Yakima Munic-
ipal Code is hereby amended to read as follows:
"12.60.230 Height and Placement of Fences. In a
R-1, R-2, R-M and R-3 zone, and as an accessory use to
a dwelling in any zone, fences, walls or hedges may be
erected and maintained to a height not to exceed six
feet in the side and rear yard areas. In the front
yard area any fence, wall or hedge may be erected and
maintained to a height not to exceed six feet in the
410 area at or behind the minimum building setback line
for the particular zone or to a height not to exceed
three feet six inches within the area between the public
right-of-way and the minimum building setback line.
With regard to corner lots any side yard wall,
fence or hedge shall not exceed six feet within the
area encompassed by the minimum setback line and three
feet six inches within the area between the public
right-of-way and the minimum setback line.
Provided, in the event of a conflict between the
provisions of this section and Section 8.80.040 of the
City of Yakima Municipal Code the latter section shall
govern."
• Section 2. Section 12.88.040 of the City of Yakima Munic-
ipal Code is hereby amended to read as follows:
• "12.88.040 Penalty for Violations. It is unlawful
for any person to violate or fail to comply with any
provision of this chapter. As an additional and con-
current remedy, the city may bring a civil action against
any person for violation or failure to comply with any
provision of this chapter. In the event criminal pro-
ceedings are instituted against the violator, the maxi-
mum penalty upon conviction shall be a fine not to ex-
ceed two hundred fifty dollars, or imprisonment in the
city jail facility for not more than ninety days for each
conviction. In the event of civil proceedings, the
penalty upon judgment for the city shall be five hundred
dollars."
Section 3. This ordinance shall be in full force and effect
111 thirty days after its passage, approval and publication as pro-
vided by law and by the City Charter.
