AN ORDINANCE annexing property to the City of Yakima and zoning said
property (Lincoln and 16th Avenue Annexation)
WHEREAS, proceedings have been held in accordance with all C+J
rot applicable laws for the annexation to the City of Yakima of the property tO
hereinafter described, and

C\i WHEREAS, a notice of intention was filed with the Yakima County
Boundary Review Board as requ11red by law for this annexation and after the CJ1
elapse of forty -five days without the Board's jurisdiction having been invoked,
the annexation has been deemed approved in accordance with RCW
36 93 100, and
WHEREAS, pursuant to due and legal notice, the City Council held a
public hearing on said annexation on the 9th day of _November , 1993, and,
as a result thereof, finds that such property should be annexed to the City of
Yakima and further finds that the property should retain ,its current zoning
pursuant to the Yakima Urban A1'ea Zoning Map and that such zoning and
classification is in accord with the Yakima Urban Area Comprehensive Plan, the
General Plan of the City of Yakima, that owners of not Tess than seventy -five
percent of the assessed valuation of property within the area described below
have petitioned the City Council for annexation, that the needs of yhat City and
community do require the hereinafter set forth zoning classification, and the
highest and best use for said property is as hereinafter determined, now,
therefore,

Section 1. The property identified on the map attached hereto as Exhibit
"A" and legally described in Exhibit "B ", attached hereto and incorporated by
reference herein, is hereby annexed to the City of Yakima, Washington
Section 2. The owners of the hereinbefore described real property
annexed to the City of Yakima shall be required to assume existing
indebtedness of the City of Yakima.
Section 3. The hereinbefore described real property annexed to the City
of Yakima is hereby zoned as it is currently zoned and depicted on the official
zoning map for the unincorporated portion of the Yakima Urban Area which

map is maintained in the Yakima County Planning Department and which map

is incorporated herein by reference
Section 4. The next regularly amended Zoning District Map prepared by
and for the City of Yakima shall show said property as hereinbefore zoned and
classified
<.> Section 5. The City Clerk is hereby authorized and directed to file a " a
certified copy of this ordinance with the County Auditor of Yakima County and
with the Board of County Commissioners of Yakima County, Washington
Section 6. There is hereby granted to Yakima Waste Systems, Inc., in
accordance with RCVV 35 13 280 an exclusiv franchise to coUUec C111‘; idiaivae
of certain garbage and refuse in the hereinbefore described real property
annexed to the City of Yakima, in accordance with the specific terms of
Ordinance Nos 3220 and 3445 of the City of Yakima and in accordance with
the terms of the Franchise Agreement attached to Ordinance No 3220
(amended by Ordinance No 3445) of the City of Yakima.
Section 7. This ordinance shall be in full force and effect the first day of
the calendar month next following thirty days after its passage, approval and
publication as provided by law and by the City Charter

LEGAL DESCRIPTION FOR
LINCOLN & 16TH AVENUE ANNEXATION
Commencing at the point on the city limits of Yakima; said point being the
intersection of West right of way line of Wright Avenue and the North right of way
line of West Lincoln Avenue; thence Easterly along the said North right of way line
to a point in a line situate 471 feet West of the Southeast corner of Tract 39 "Lewis
Terry Garden Tracts, "according to the plat thereof recorded in Volume "F' cf Plat ,
Page 15, records of Yakima County, Washington; thence North to the Southerly
r?aht of way line of the Pacific Power and Light Canal; thence Northeasterly along
said Southerly right of way line to a point in a line situate 401 feet west of the
Southeast corner of said Tract 39; thence South to the North right of way line of
Lincoln Avenue; thence East along the North right of way line of said West Lincoln
Avenue to a point lying 700 feet West of the Southeast corner of the Northeast
Quarter of the Northeast Quarter of Section 23, Township 13 North, Range 18,
E.W.M. ; thence Northerly parallel with the East line of Tract 39 of "Lewis Terry
Garden Tracts," 180 feet; thence Easterly parallel with the South line of said lot 140
