HomeMy WebLinkAbout1993-074 Changing references ORDINANCE NO. 93 74 • AN ORDINANCE relating to licenses and business regulations, changing g g g g references to "City Clerk" to "Code Administration Manager" and amending Sections 5 11 010, 5 11 080, 5 26.040, 5 28 100, and 5 46.020, all of the City of Yakima Municipal Code. BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1 Section 5 11 010 of the City of Yakima Municipal Code is hereby amended to read as follows: "5.11.010 Definitions. As used in this chapter, the following words and phrases shall have the following meanings ascribed to them. 1 'City Clerk" 'Code Administration Manager' means the city clerk code administration manager of the City of Yakima. 2. 'Peepshow' and 'panoram' mean an) mechanical device which upon insertion of a coin or b) other means, e'hibits or displays a picture or view on film. • 3. 'Person' means an) natural person, partnership, corporation or any combination thereof " Section 2 Section 5 11 080 of the City of Yakima Municipal Code is hereby amended to read as follows: "5.11 080 Premises prohibited within three hundred feet of a school. The city clerk code administration manager shall not issue a panoram location license for, nor shall an) panoram or peepshow be used or operated in, any premises within three hundred feet of the grounds or building of any school." Section 3 Section 5 26 040 of the Cit) of Yakima Municipal Code is hereby amended to read as follows. "S 26.040 Application for license. In addition to the general application form to be filed with the city clerk code administration manager as provided in this chapter, the ® applicant for a license for the sale of distressed goods, a removal or closing out sale shall file a statement showing all the facts in regard to the contemplated sale, the reasons for such sale, and an inventory Page 1 (1slord /west /license &bsns rag ;w • showing actual purchase price, names of persons from whom the goods were obtained, date of delivery to the applicant, and all details necessary to fully identify the goods to be sold, and shall specify the period of time during which the sale will continue, not to exceed a period of two months, except as hereinafter provided As to any goods which were obtained more than three years prior to the date of the application, an estimate of their value shall be shown instead of the actual purchase price, and it shall not be necessary to show the name of the person from whom those goods were obtained. Section 4 Section 5 28 100 of the City of Yakima Municipal Code is hereby amended to read as follows: "5.28 100 Application for permit. A. Application for a permit to conduct, operate or sponsor public dances or cabarets shall be made in writing to the city manager and filed with the city clerk code administration manager, and upon approval by the city manager and upon payment of the fee as hereinbefore provided, the city clerk code administration manager shall issue the permit The application shall contain a complete description of the premises to be occupied with the name of streets and street number of entrances and shall contain a statement by the • applicant or applicants that they will abide by all ordinances and regulations passed or imposed by the city for the control and regulation of public dances or cabarets and of the conduct of operators, managers, and patrons. B The application fee for each permit issued under this chapter shall be sixteen dollars and fifty cents, which amount shall be credited to payment of the permit fee Application fees shall not be refundable." Section 5 Section 5 46 020 of the City of Yakima Municipal Code is hereby amended to read as follows: "5.46.020 Application for license. Application for such license shall be made to the city clerk code administration manager, and the fee provided therefor paid at the time of such application Upon the receipt of such application the facts relative thereto shall be transmitted to the chief of police, who shall immediately in\ estigate such premises. The chief of police shall report to the city manager the result of his in\ estigation relative to the character of the proposed licensed premises and the conduct of patrons thereof After due consideration of such information, if the city • manager shall deem that the issuance of license to such premises shall be for the best interests of the community , he shall so advise the city clerk code administration manager, who shall thereupon issue such Page 2 (1s)ord /west /license&bsns reg iw • license. If, however, it shall be determined by the city manager from such investigation of the chief of police that the issuance of such license would be opposed to the best interests of the community, he shall so advise the city clerk code administration manager, who shall thereupon deny such license."
