HomeMy WebLinkAbout1993-071 Housing Code ORDINANCE NO. 93- 71 AN ORDINANCE. relating to buildings, amending the Housing Code to include omitted language, "requirement to act in compliance with the code at the" in Subsection (2) of definitions of "shall," and amending Section 11 20 060 of the City of Yakima Municipal Code. BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1 Section 11 20 060 of the City of Yakima Municipal Code is hereby amended to read as follows: "11.20.060 Amendment to Section 401. Section 401 of the Uniform Housing Code is amended to read as follows: Sec 401 Definitions. For the purpose of this Code, certain terms, phrases, words and their derivatives shall be construed as specified in either this chapter or as specified in the Building Code Where terms are not defined, they shall have their ordinar} accepted meanings within the context with which they are used Webster's Third New International Dictionary of the English Language, Unabridged, ® copyright 1981, shall be considered as providing ordinary accepted meanings Words in the singular include the plural and the plural the singular Words used in the masculine gender include the feminine and the feminine the masculine. BUILDING CODE is the Uniform Building Code as enacted by the City of Yakima. EFFICIENCY DWELLING UNIT is a dh% elling unit contained only one habitable room and meeting the requirements of Section 503(b) Exception. HEALTH OFFICER is the legal]) designated head of the Department of Health of this jurisdiction. HOT WATER is hot water supplied to plumbing fixtures at a temperature of not less than 110'F MECHANICAL CODE is the Uniform Mechanical Code promulgated by the International Conference of Building Officials and the International Association of Plumbing and Mechanical Officials as enacted b) the City of Yakima. NUISANCE. The following shall be defined as nuisances: 1 Any public nuisance known at common law or in equity jurisdiction. 2. An) attracti\ e nuisance %%hick may prove detrimental to the children whether in or on a building, on the premises of a building, or upon an unoccupied lot. This includes an abandoned w ells, shafts, basements or excavations, abandoned refrigerators or motor vehicles, or any structurally • unsound fences or structures, or any lumber, trash, fences, debris or vegetation which may prove a hazard for inquisitive minors. Whatever is dangerous to human life or is detrimental to health, as determined by the health officer 4 Overcrowding a room with occupants. 5 Insufficient ventilation or illumination. 6. Inadequate or unsanitary sewage or plumbing facilities. 7 Uncleanliness, as determined by the health officer 8. Whatever renders air, food or drink unwholesome or detrimental to the health of human beings, as determined by the health officer PLUMBING CODE is the Uniform Plumbing Code promulgated by the International Association of Plumbing and Mechanical Officials. SHALL is defined to have the following meaning: 1. With respect to the functions and powers of the Director of Community and Economic Development, Code Administration Manager, or any agents and employees of the City of Yakima and any board authorized hereunder, a direction and authorization to act in the exercise of sound discretion and in good faith. 2. With respect to the obligations upon owners and occupants of premises and their agents, a mandatory requirement to act in compliance N‘ ith the Code at the risk of civil and criminal liability upon failure so to act." • Section 2 This ordinance shall be in full force and effect 30 days after its passage, approval, and publication as provided by law and by the City Charter PASSED BY THE CITY COUNCIL, signed and approved this 10tlday of August , 1993 ATTEST Q n ` Mayor C- m c— Cit.
