• ORDINANCE NO. 93- 66
AN ORDINANCE relating to building regulations, correcting references to the
Uniform Building Code and the Uniform Plumbing Code; and
amending Sections 1 and 5 of Yakima City Ordinance No. 3396 and
amending Section 1 of Yakima City Ordinance No. 3401.
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1 Section 1 of Yakima City Ordinance No. 3396 is hereby amended to
read as follows:
"11.04 010 Adoption of Uniform Building Code.
The Uniform Building Code, 1991 Edition, copyright 1991 by the
International Conference of Building Officials, consisting of the
Uniform Building Code, all appendices thereto except Appendices
Chapters One, T%. e, Fifty -one, Fifty- three, Seventy, and a separate
supplement volume thereto entitled Uniform Building Code Standards, of
which no less than one or more copies each have been filed and now
are on file in the office of the Code Administration Manager of the City
of Yakima, is hereby adopted and incorporated as fully set out in full
herein, as the building code of the City of Yakima, except as hereinafter
amended, and the provisions and regulations of the City of Yakima and
the several sections or numbers therein shall constitute, and may be
• referred to as, the numbers of this chapter "
Section 2 Section 5 of Yakima City Ordinance No. 3396 is hereby amended to
read as follows.
"11 04.027 Amendment to Section 308
Section 308 of the Uniform Building Code, as applied to the City of
Yakima, is hereby amended to read as follows.
'Sec 308 Certificate of Occupancy
(a) Use or Occupancy No building or structure shall be used
or occupied, and no change in the existing occupancy classification of a
building or structure or portion thereof shall be made until the
building official has issued a Certificate of Occupancy therefor as
provided herein.
EXCEPTION Group R, Division 3, and NI Occupancies.
Issuance of a Certificate of Occupancy shall not be construed as
an approval of a violation of the provisions of this code or of other
ordinances of the jurisdiction. Certificates presuming to give authority
to violate or cancel the provisions of this code or of other ordinances of
• the jurisdiction shall not be valid.

• (b) Change in Use Changes in the character or use of a
building shall not be made except as specified in Section 502 of this code.
(c) Certificate Issued. After the building official inspects the
building or structure and finds no violations of the provisions of this
code or other laws which are enforced by the code enforcement agency,
the building official shall issue a Certificate of Occupancy which shall
contain the following:
1 The building permit number
2 The address of the building.
3 The name and address of the owner
4. A description of that portion of the building for which the
certificate is issued.
5. A statement that the described portion of the building
complies with the requirements of this code for the group and
division of occupancy and the use for which the proposed
occupancy is classified.
6 The name of the building official
• (d) Temporary Certificate. If the building official finds that
no substantial hazard will result from occupancy of any building or
portion thereof before the same is completed, he may issue a temporary
Certificate of Occupancy for the use of a portion or portions of a
building or structure prior to the completion of the entire building or
structure.
(e) Posting The Certificate of Occupancy shall be posted in a
conspicuous place on the premises and shall not be removed except by
the building official.
(f) Revocation The building official may, in writing, suspend
or revoke a Certificate of Occupancy issued under the provisions of this
code, whenever the certificate is issued in error, or on the basis of
incorrect information supplied, or when it is determined that the
building or structure or portion thereof is in violation of any ordinance
or regulation or any of the provisions of this code.
(g) Public Nuisance It is a public nuisance to use or occupy a
building or structure, or any part thereof, of the groups enumerated in
subsection (a) herein without there having been issued a valid
Certificate of Occupancy for such building, structure or part thereof
Such public nuisance shall be subject to prevention or abatement by
injunction or other appropriate legal remedy in the Superior Court of
Washington in Yakima County "'

Section 3 Section 1 of Yakima City Ordinance No. 3401 is hereby amended to
• read as follows:
"11 44 010 Adoption of Uniform Plumbing Code.
The Uniform Plumbing Code, 1991 Edition, of the International
Association of Plumbing and Mechanical Officials, excluding Chapter 12,
together with and including IAPMA installation standards and
appendices thereto, consisting of Appendix A, 'Rules for Sizing the
Water Systems,' Appendix B, 'Combination Waste and Vent Systems,'
Appendix C, 'Minimum Plumbing Facilities,' Appendix D, 'Rainwater
Systems,' Appendix E, 'Mobile Home Parks Plumbing Standards,'
Appendix G, 'Swimming Pools,' Appendix H, 'Sizing Commercial Kitchen
Grease Interceptors,' and Appendix I, 'Private Sewage Disposal Systems,'
of which one or more copies of each have been filed and now are on file
in the office of the Code Administration Manager of the City of Yakima,
is hereby adopted and incorporated as fully as if set out in full herein,
as the plumbing code of the City of Yakima, except as hereinafter
amended, and the provisions and regulations thereof are hereby
adopted as the provisions and regulations of the City of Yakima, and the
several sections or numbers therein shall constitute, and may be
referred to as, the numbers of this chapter "
Section 4 This ordinance shall be in full force and effect 30 days after its
• passage, approval, and publication as provided by law and by the City Charter
