AN ORDINANCE providing for the improvement of certain property by constructing an 8-
• inch public water system, establishing a Local Improvement District,
providing for the method of payment thereof, and creating a special
fund.
BE IT ORDAINED BY THE CITY OF YAKIMA.
Section 1. The following described property situate in Yakima County, Washington,
shall be improved by constructing an 8 -inch public water system.

• Section 2 The nature and territorial extent of said proposed improvements is as
follows
SCHEDULE I (North 20th Avenue, Fruitvale Boulevard to Willow Street)
ROUTE OF 8 -INCH LINE. Replace existing water line located on North 20th Avenue,
consisting of approximately 650 lineal feet of 8 -inch water line and appurtenances, from
Fruitvale Boulevard to Willow Street.
SCHEDULE II (Willow Street, 20th Avenue to 24th Avenue)
ROUTE OF 8 -INCH LINE Beginning at existing water line at Willow Street and North
20th Avenue, thence west in Willow Street, consisting of approximately 1,300 lineal feet of 8-
inch water line and appurtenances.
SCHEDULE III (North 28th Avenue, Castlevale Road to Willow Street)
ROUTE OF 8 -INCH LINE: Beginning at existing water line at Castlevale Road, thence
south in a utility easement aligned with South 28th Avenue at Willow, consisting of
approximately 650 lineal feet of 8 -inch water line and appurtenances.

Section 3 There is hereby created a Local Improvement District, to be called "Local
Improvement District No 1052 ", which said district shall include all of the above described
property
Section 4 The assessments shall be made according to special benefits derived from 411
the improvements without regard to the zone and termini method.
Section 5 All costs and expenses in connection with the construction of said
improvements, including the engineering, inspection, advertising, publication of notices, and
all other expenses incident thereto, shall be levied and assessed against all of the property
legally and properly assessable therefor as provided by law and as above described.
Section 6 The work necessary to be done in connection with the making of said
improvements shall be done by contract upon competitive bids according to specifications
and plans as prepared by the Engineering Division of the Department of Engineering and
Utilities, and the City shall have the power to reject any and all bids.
Section 7 There is hereby created a special fund, to be known as "Local Improvement
Fund, District No. 1052 ", into which shall be placed all sums paid on account of the aforesaid
special assessments, including all interest and penalties thereon, and in the event of the sale
of local improvement bonds by the City, all premium and interest on said bonds issued for
said improvement.
Section 8 Bonds shall be issued in payment of the costs and expense of said
improvements, which bonds shall be redeemed by the collection of special assessments to
be levied and assessed upon the property within said district, which assessments, with
interest, shall be payable annually under the mode of payment "payment by bonds" as
defined by the statutes of the State of Washington and the ordinances of the City of Yakima,
provided, this improvement may be financed by the issuance of notes, under the authority of
R.C.W 39 50 and Section 8 12 100 of the City of Yakima Municipal Code. The term and
interest rate of bonds and special assessments contemplated by this section shall conform
to provisions, terms and conditions to be specified by a subsequent ordinance of the City of
Yakima.
Section 9 The actual assessments levied for this improvement may vary from the
assessment estimates so long as they do not exceed a figure equal to the increased true
fair value the improvement adds to the property

Section 10 This ordinance is one relating to local improvements or assessments
therefor, and shall become effective immediately upon its passage, approval and
publication as provided by law and by the City Charter
