AN ORDINANCE rezoning property at 1406 Summitview Avenue in
the City of Yakima, Washington from Planned
Development Zone and R-3, Multiple Family Zone
II to B-2, Local Business Zone.
WHEREAS, pursuant to due and legal notice, the Yakima
City Council held hearings on April 6, 1982 and June 1, 1982,
on the appeal of Robert Kellett, d/b/a McCormick Floral from
the recommendation of the Yakima Planning Commission that the
rezone application be denied, by which applicant applied for
the rezone from Planned Development Zone and R-3, Multiple
Family Zone to B-2, Local Business Zone of certain real property
411 described hereinbelow,. and
WHEREAS, as a result of its hearings, the City Council
determined that the rezone request of Robert Kellett d/b/a
McCormick Floral should be granted, and hereby makes its
following findings and conclusions:
FINDINGS:
1. The property for which the rezone is sought consists
of a parcel at 1406 Summitview Avenue which is presently zoned
partly Planned Development Zone and partly R-3, Multiple
Family Zone. A greenhouse and florist business is conducted
ill • on the property, and the present owner and predecessors have
conducted such a business on that property for many years past.
The premises have fallen into a state of disrepair since the
current zoning was imposed in 1979, and the owners desire to
improve the premises and enlarge the business conducted on
that property but are precluded from doing so under the present
zoning which limits the availability of financing as well as
the actual use of the property.
8 2. A B-2, Local Business Zone classification of the
property would accommodate the present and contemplated business
uses of the property, and would accommodate the cleanup and
