HomeMy WebLinkAbout1982-2621 REZONE PROPERTY AT 1406 SUMMITVIEW AVENUE ORDINANCE NO. .....26-a/ 411 AN ORDINANCE rezoning property at 1406 Summitview Avenue in the City of Yakima, Washington from Planned Development Zone and R-3, Multiple Family Zone II to B-2, Local Business Zone. WHEREAS, pursuant to due and legal notice, the Yakima City Council held hearings on April 6, 1982 and June 1, 1982, on the appeal of Robert Kellett, d/b/a McCormick Floral from the recommendation of the Yakima Planning Commission that the rezone application be denied, by which applicant applied for the rezone from Planned Development Zone and R-3, Multiple Family Zone to B-2, Local Business Zone of certain real property 411 described hereinbelow,. and WHEREAS, as a result of its hearings, the City Council determined that the rezone request of Robert Kellett d/b/a McCormick Floral should be granted, and hereby makes its following findings and conclusions: FINDINGS: 1. The property for which the rezone is sought consists of a parcel at 1406 Summitview Avenue which is presently zoned partly Planned Development Zone and partly R-3, Multiple Family Zone. A greenhouse and florist business is conducted ill • on the property, and the present owner and predecessors have conducted such a business on that property for many years past. The premises have fallen into a state of disrepair since the current zoning was imposed in 1979, and the owners desire to improve the premises and enlarge the business conducted on that property but are precluded from doing so under the present zoning which limits the availability of financing as well as the actual use of the property. 8 2. A B-2, Local Business Zone classification of the property would accommodate the present and contemplated business uses of the property, and would accommodate the cleanup and III _____. improve the appearance of the property. 3. The Planning Commission recommended that the rezone 411 be denied, and recommended instead that the present Planned Development Zone be modified. CONCLUSIONS: 11/ 1. The rezone application should be granted, now, therefore, BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. The following described real property situate at 1406 Summitview Avenue in the City of Yakima, Washington, and more particularly described as follows, to wit: • Beginning at a point 680 feet east and 30 feet south of the northwest corner of the Northwest quarter of the Southwest quarter of Section 24, Township 13 North, Range 18 E.W.M., said point being on the south line of Summitview Avenue; thence east along the south line of said Summitview Avenue, a distance of 351.2 feet more or less to the west line of Hall Avenue; thence south along the west line of said Hall Avenue a distance of 113.5 feet more or less to the north line of West "A" Street; thence west along the north line of West "A" Street a distance of 351.2 feet more or less to a point south of the point of beginning; thence north 115.2 feet more or less to the point of beginning; except that portion thereof deeded to the City of Yakima for • street and recorded under County Auditor's File No. 2002823, records of Yakima County, Washington; situated in the City and County of Yakima, Washington. is hereby rezoned from Planned Development Zone and R-3, Multiple Family Zone to B-2, Local Business Zone. 411 Section 2. The above change in zoning shall be included and depicted on the next regularly amended use district map prepared by and for the City. Section 3. The City Clerk is hereby authorized and directed to file with the Yakima County Auditor a certified copy of this ordinance. Section 4. This ordinance shall be in full force and effect thirty days after its passage, approval and publication as provided by law and by the City Charter.
