AN ORDINANCE relating to public services and utilities, increasing sewer ready -
to -serve charges, volume charges, and strong waste surcharge
rates for owner (inside city) and non -owner (outside city) retail
customers, increasing septage charges, amending industrial
waste sewer charges, amending water -sewer tax; amending
, Sections 7 12.010, 7 12 020, 7.12.030, 7.60.010, 7.60.020, 7.63:010,
7.63.020, 7 63.030, 7.63.040, 7.63.050, and 7 64.010; and adding as a
new section Section 7 60 025, all of the City of Yakima Municipal
Code.
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section' 1 Section 7.12.010 of the City of Yakima Municipal Code is hereby
amended to read as follows:
"7 12 010 Annual service charge established.
From and after June 1, 1958, there is hereby charged to all
users of the industrial wastes sewer line and treatment facilities an
annual service charge in an amount sufficient to amortize the actual
costs to the city of Yakima for the construction of the separate
industrial wastes sewers including meters and measuring devices, and
other capital expenditures related to this system, plus the necessary
annual operation and maintenance costs of the separate industrial
• wastes system.
B.� Commencing on tanuary 23. 1995. the 50% cost sharing of
the annual service charge between industrial waste users and owner
(city) retail customers shall be adjusted as follows. In 1995. the .
industrial waste users shall pay 60% of the annual service chaz_ge. In
1996, the industrial waste users shall pay 70% of the annual service
charge. !In 1997. the industrial waste users shall pay 80% of the annual
service dharge. In 1998. the industrial waste users shall pay 90% of the
annual service charge. Commencing on January 1. 1999. there shall be
no cost isharing of the annual service charge between industrial waste
users and owner (city) retail customers."
Section 2 Section 7 12 020 of the City of Yakima Municipal Code is hereby
amended to read as follows.
"7 12 020 Annual service charge — Method of computation.
engineer after construction of the facilities. This amount shall be
multiplied by the factor 0.06505 (Capital Recovery Factor thirty (30)
The annual service charge shall be determined using a Utility Rate Basis
as defined in the American Water Works Associations (AWWA) Manual
M1. Fourth edition copyright 1991. The three elements of the Utility
Rate Basis are Operating Expense. Depreciation Expense. and Return on.
Investment.

Section 3 Section 7.12 030 of the City of Yakima Municipal Code is hereby
amended to read as follows.
"7.12.030 Installation of measuring device -- Apportionment
and payment of charges.
The city shall install a measuring device for each user, to
measure and record the liquid wastes contributed to the industrial
sewer The City der Wastewater Department shall have access to said
measuring devices and shall take readings at periodic intervals. The
total yearly charge shall be apportioned among the users directly in
proportion to the total volume of wastes contributed during the previous
calendar year - • . - - . • = . - - - - - . - . . - - -' •

shall be charged for any flow which. for any reason. is diverted from
the industrial waste facility to the municipal facility for treatment. For
use in this chapter. such flow shall be called 'diverted flow.' The fee for
this diverted flow shall include treatment. testing. and anv receiving
costs. The treatment costs shall be calculated by the following formula.
Diverted Flow Treatment Cost = (Unit cost per pound of BOD or SS)
times (Weight of one gallon of water) times (Flow discharged in one
hundred cubic feet divided by one thousand three hundred thirty -
seven) times (Diverted flows concentration of BOD or SS in parts per
million) plus (Unit cost per one hundred cubic feet of flow) times (Flow
discharged in one hundred cubic feet). The unit cost per one hundred
cubic feet of flow equals $0.186. The remaining unit cost values are as
set forth in Section 7.60.020.
Diverted Flow Testing Cost. The costs of any testing are set forth
in Section 7.65.110. The wastewater superintendent shall have final
authority over what tests shall be required for any discharge.
Any fee due for diverted flow shall be in addition to annual charges
established under this Chapter. The sewerage charge provided in this
chapter ishall be payable at the office of the city treasurer at the same
time as the water bill for the premises is payable, and the yearly charge
shall be paid in twelve equal monthly installments or as billed by the,
city "
Section 4 Section 7 60.010 of the City of Yakima Municipal Code is hereby
amended to read as follows.
"7.60.010 City to fix and collect sewerage rates and charges.
The public health, safety and welfare require that the city
of Yakima fix and collect sewerage rates and charges upon, and
measured by water served to, premises in the city of Yakima And in
areas outside the corporate limits of the city, for the carrying and

discharge of all sewage and drainage into the municipal sewer system of
the city of Yakima as presently maintained and operated, together with

414 additions and betterments thereto and extensions thereof, which rates
and charges are fixed by this chapter; provided, that the specifying of
service rates and charges by this chapter shall be affect the financing
of construction of sewers and trunk sewers pursuant to the local
improvement district process, the imposition of a sanitary sewer capital
cost recovery charge, or other alternate means of financing such
construction, provided further, the adoption of rates for service to
property outside the corporate limits of the city does not constitute an
undertaking by the city to serve any or all such property without
compliance with other laws, regulations and policies of the city
pertaining to the furnishing of city sewer service outside city corporate
limits.
�. Biennial Review. In accordance with federally mandated
Environmental Protection Agency requirements and to satis(v bond
covenants. the ci shall review not less often than every two years the
wastewater contribution of users and user classes. the total cost of
operation and maintenance of the treatment works and the user charge
system. The charges for users or classes of users shall be revised as
required."
Section 5 Section 7 60 020 of the City of Yakima Municipal Code is hereby
amended to read as follows.
"7 60.020 Owner (inside city) retail sewer service charge.

A. Rates (1995) Minimum Charge-
(1) Sewer Service Charge Commencing January 1,. 1990
January 23. 1995, there shall be charged to and collected from all
premises within the city served by the city sewer system a sewer
service charge composed of a ready -to -serve charge and a volume
charge based on domestic water consumption, provided in no event
shall the total sewer service charged be less than five dollars and
seventy three cents ($5.73) six dollars and seventy -seven cents ($6.77)

January 23. 1995, for commercial and industrial customers located inside .
the city discharging wastewater which contains more than three
hundred parts per million of biochemical oxygen demand (BOD) and /or
suspended solids (SS), there shall be a surcharge, in addition to the
ready -to -serve charge and the volume charge, which shall be
calculated utilizing the national average values of BOD and SS
concentrations typical to each classification under the Standard
Industrial Code or by actual concentrations verified by the city If the
commercial industrial customer chooses, at its expense, to install a
sampling station, the strong waste charge shall be calculated based
upon actual concentrations. The following formula shall be utilized to
calculate the strong waste charge:

"7.60.025 Non -owner (outside city) retail sewer service
charge.
A. Rates (1995)
(1) Sewer Service Charge. Commencing January 23, 1995,
there shall be charged to and collected from all premises outside the city
served by the city sewer system a sewer service charge composed of a
ready -to -serve charge and a volume charge based on domestic water
consumption, provided in no event shall the total sewer service charged
be less than twelve dollars and thirty cents ($12.30) per month.
(a) Sewer Service Charge -- Schedules. The sewer service
charge shall be calculated and charged according to the following
schedules:
(i) Ready -to -serve Charge For all customers other than

there shall be charged to and collected from all premises outside the city
served by the city sewer system a sewer service charge composed of a
ready -to -serve charge and a volume charge based on domestic water
consumption, provided in no event shall the total sewer service charged
be less than thirteen dollars and sixty-two cents ($13 62) per month for
• premises outside the city limit boundary

discharging wastewater which contains more than three hundred parts
per million of biochemical oxygen demand (BOD) and /or suspended
solids (SS), there shall be a surcharge, in addition to the ready -to -serve
charge and the volume charge, which shall be calculated utilizing the
national average values of BOD and SS concentrations typical to each
classification under the Standard Industrial Code or by actual

($ 195) per gallon shall be paid for septic tank waste (septage) dumped
at the wastewater treatment plant effective January 23, 1996."
Section 7 Section 7 63 010 of the City of Yakima Municipal Code is hereby
amended to read as follows.
"7 63.010 Septage / exceptioAal waste defined.
As used in this chapter, the phrase 'septage waste' means a
semiliquid substance consisting of settled sewage solids combined with
varying amounts of water and dissolved materials generated from a
private or public septic tank or other private or public wastewater
treatment system.
13. As used in this chapter. the phrase 'exceptional waste'
means any liquid or semiliquid substance. other than 'septage waste.'
consisting of a combination of varying amounts of water. dissolved
materials. and solids generated from private or public sources which is
transported to the facility other than through the system's collection
system."
Section 8 Section 7 63 020 of the City of Yakima Municipal Code is hereby
amended to read as follows. •

" 7.63.020 Septage /exception waste disposal -- Condition.
A. Septage /exceptional waste will be accepted for disposal at
the wastewater treatment plan subject to the provisions, terms and
conditions specified in this chapter, and subject to all applicable rules
and regulations of Chapter 7.62 7.65 of the city of Yakima Municipal
Code, subject to all applicable rules and regulations of the Yakima
County health district related to septage waste disposal, and subject to
rules and regulations adopted by the city d of cngincering and
des- manager or designee as authorized by this chapter
B No septage /exceptional, waste shall be accepted for disposal
at the wastewater treatment plant unless the hauler holds a valid and
applicable Yakima County health district registration certificate and
unless the vehicle which hauls the septic waste to the wastewater
treatment plant for disposal has been approved by the Yakima County
health district in connection with the issuance of the registration
certificate.
C. Septage /exceptional waste will not be accepted for disposal
at the wastewater treatment plant if any of the following conditions
exist:
1. The septage /exceptional, waste is of a quality or contains
any substance, the discharge of which into the city public sewer system
is prohibited or limited by Scction 7.62.050 Chapter 7.65 of the city of
Yakima Municipal Code;
2. The hauler of the septage /exceptional waste does not hold a
• valid applicable Yakima County health district registration certificate,
or otherwise fails to satisfy or comply with the requirements of any
applicable provision of this chapter, any applicable rule or regulation
of the Yakima County health district, or rule or regulation adopted by
the city director of engineering and utilities manager or designee
pertaining to septage disposal,
3. Payment for the hauler of a billing by the city to that
hauler for septage /exceptional disposal fees is unpaid and more than
thirty days have elapsed from the date of the billing."
Section 9 Section 7 63 030 of the City of Yakima Municipal Code is hereby
amended to read as follows.
"7.63 030 Disposal fee -- Payment.
A.
. - . - . - - - For septage waste. a fee as set forth in
Section 7.60.025 shall be paid to the city by the septage .hauler for
septage waste disposed of at the wastewater treatment facility
)3. For exceptional waste. a fee. calculated utilizing the
following formula for treatment costs. plus any receiving and testing
costs. shall be paid to the city by the hauler for exceptional waste .
discharged at the wastewater treatment facility:
• Exceptional Waste Treatment Cost = (Unit cost per pound of BOD or
SS) times (Weight of one gallon of water) times (Flow discharged in one
hundred cubic feet divided by one thousand three hundred thirty -

seven) times (Exceptional waste's concentration of BOD or SS in parts
per million) plus (Unit cost per one hundred cubic feet of flow) times
(Flow discharged in one hundred cubic feet). The unit cost per one
hundred cubic feet of flow equals $0.279. The remaining unit cost
values are as set forth in Section 7.60.025.

Section 10 Section 7 63 040 of the City of Yakima Municipal Code is hereby
amended to read as follows.
"7.63 040 Liability insurance required. •
No septage /exceptional waste shall be accepted for disposal at the
wastewater treatment plant unless the hauler has filed with the office
of the wastewater treatment plant superintendent a certificate or other
proof of the existence of liability insurance with coverage of not less
than two hundred fifty thousand dollars ($250.000.00) for property
damage to city -owned property resulting from operations of the
septage /exceptional waste hauler "
Section 11 Section 7 63 050 of the City of Yakima Municipal Code is hereby
amended to read as follows:
"7.63.050 Rules and regulations.
The director of engineering and utilities city manager or
designee is authorized to adopt such rules and regulations as -t-he
director the city manager or designee, deems necessary to carry out the
provisions of this chapter and to regulate the disposal of
septage /exceptional waste at the wastewater treatment plant, which
rules and regulations shall not conflict with the provisions of this
chapter "
Section 12 Section 7 64 010 of the City of Yakima Municipal Code is hereby
amended to read as follows:

• "7.64 010 Water -sewer tax.
A. Purpose. It is the purpose of this section to impose a tax on
sewer service revenues received from wholesale and retail customers
that is fair, just and. reasonable.
B. Findings.
1. It is equitable that all rates and charges for use of the
city's sewerage system be subject to city taxes.
2. It is necessary to increase tax revenues due to an increased
demand for city services.
3. Areas receiving wholesale sewer service generally receive
some benefit from the expenditure of city tax revenues, but receive a
lesser benefit than areas receiving retail sewer service.
4 Adoption of the ordinance codified in this section will
promote equity and increase tax revenues by subjecting all sewer rates
and charges to a city tax and by taxing revenues from wholesale sewer
service at a lower rate than revenues from retail sewer service.
C., Water -Sewer Tax.
There is levied against the water -sewer revenues of the
city a tax against the total gross revenue of the water -sewer fund
derived from receipts for domestic water, domestic sewer, and industrial
sewer, industrial waste sewer, septage disposal, and wholesale service
charges. The rates of the tax for the calendar years 1991 and 1992, shall
be as follows:
Wholesale service charges 10%
• All other service charges 12%
The rates of the tax for the calendar year 1993 shall be as follows:
Wholesale service charges 10%
All other service charges 14%
The rates of the tax for the calendar year 1994 and the following
years shall be as follows.
Wholesale service charges 10%
All other service charges 14%
2: Commencing January 1995. the water -sewer tax shall not
be applied against that portion of the total gross revenue of the water -
sewer fund which is collected as 'debt coverage' for the sewer debt.
For use in this chapter. 'debt coverage' shall mean that revenue
collected specifically to meet the requirements of primary bonded debt
coverage and State Revolving Loan coverage."
Section 13 This ordinance shall be in full force and effect 30 days after its
passage, approval, and publication as provided by law and by the City Charter
