Sec 1 A new chapter is added to Title 12 of the 2 Yakima Municipal Code to read as follows 3 12.01 CONSTRUCTION OF PUBLIC WORKS IMPROVEMENTS 4 NEW SECTION. Sec 2 A new section is added to chapter 12 01 • 5 of the Yakima Municipal Code to read as follows 6 12.01.010 Purpose. The purpose of this chapter is to establish 7 requirements and standards for the design and construction of 8 public works improvements by private applicants in conjunction 9 with subdivision or development of real property, and to establish 10 fees for the City Engineer's review of design documents for and 11 inspection of public works improvements 12 NEW SECTION. Sec 3 A new section is added to chapter 12 01 13 of the Yakima Municipal Code to read as follows 14 12.01.020 Applicability /Compliance (1) Any person or entity 15 which undertakes to construct any public works improvement in the 16 City of Yakima, including, without limitation, applicants who are 17 granted a permit or approval that is conditioned on or otherwise 18 requires construction of public works improvements in the City of •19 Yakima, shall comply with the provisions of this chapter lap /legislation /ymc 12 O1 /ordinance 2/7/95 9 58 AM ORDINANCE: YMC CHAPTER 12.01 CONSTRUCTION OF PUBLIC WORKS IMPROVEMENTS Page 1 20 (2) Repairs and /or minor alterations to existing curbs or 21 gutters, sidewalks, street pavement, driveway approaches, and 22 alleys are regulated by Title 8 Yakima Municipal Code and are 23 excepted from the requirements of this chapter 24 NEW SECTION. Sec 4 A new section is added to chapter 12 01 25 of the Yakima Municipal Code to read as follows 26 12.01.030 Design Documents. (1) Design documents for design 27 and construction of public works improvements shall, without 28 limitation, include plan drawings and profile drawings, 29 engineering calculations, and specifications Design documents 30 shall be submitted by the applicant to the City Engineer before 31 any construction is started The City engineer may require the 32 applicant to submit multiple sets of design documents All 33 drawings shall be of sufficient clarity and detail to indicate the 34 location, nature, and extent of the public works improvements 35 Design documents shall show in detail that construction work and 36 public works improvements will conform to applicable laws and _ • 37 regulations including this Title Plans shall be drawn on 38 substantial velum, mylar or cloth capable of reproduction on 39 standard engineering reproduction equipment and shall conform to 40 engineering standards satisfactory to the City Engineer 41 Applicants may request to submit design documents on computer 42 media compatible with the City Engineer's data processing system, 43 however, an applicant shall have no right to submit design 44 documents on computer media Arrangements pursuant to such 45 requests must be made in advance of submittal and the specific 46 form of the City Engineer's approval shall be determined as part 47 of such arrangements 48 (2) Design documents shall be prepared by a Civil Engineer 49 licensed by the State of Washington. The City Engineer may waive 50 preparation by a licensed Civil Engineer if the nature of the work 51 contemplated is such that preparation by a licensed Civil Engineer 52 is not necessary to obtain compliance with applicable laws and 411 lap /legislation /development standards /ordinance 2/7/95 9 58 AM ORDINANCE: YMC CHAPTER 12.01 CONSTRUCTION OF PUBLIC WORKS IMPROVEMENTS Page 2 j � 53 regulations including this Title Submittal of appropriate design 54 documents shall not be waived 55 NEW SECTION. Sec 5 A new section is added to chapter 12.01 56 of the Yakima Municipal Code to read as follows 57 12.01.040 Review Process. (1) The City Engineer shall review 58 design documents for public works improvements No public works 59 improvements may be constructed before the City Engineer has 60 provided written approval of the pertinent design documents If 61 the City Engineer determines that proposed public works 62 improvements and the related design documents conform to 63 applicable requirements including this chapter, then the City 64 Engineer shall mark the original design documents "Approved" and 65 affix his signature thereto, and these actions shall constitute 66 written approval The approved design documents shall constitute 67 the permit for construction of the public works improvements • 68 (2) Public works improvements described by approved design 69 documents must be constructed in conformity with the approved 70 design documents and may not be changed, modified or altered 71 without written approval of the City Engineer 72 (3) The applicant shall, during construction, maintain a neatly 73 marked, full -sized set of record drawings showing the layout and 74 final location of all public works improvements involved in new 75 construction Prior to final acceptance by the City of Yakima of 76 public works improvements, reproducible record drawings prepared 77 by the Civil Engineer of record, and clearly identified as record 78 drawings shall be delivered to the City Engineer for approval 79 (4) The applicant shall submit for written approval by the City 80 Engineer a detailed summary of the construction cost of approved 81 public works improvements 410 lap /legislation /development standards /ordinance 2/7/95 9 58 AM ORDINANCE: YMC CHAPTER 12.01 CONSTRUCTION OF PUBLIC WORKS IMPROVEMENTS Page 3 82 (5) The applicant shall, upon the City Engineer's written 83 approval of completed of public works improvements, transfer 84 ownership of such public works improvements to the City of Yakima 85 (6) Final acceptance by the City of Yakima of the actual public 86 works improvements shall not occur before the applicant has 87 satisfied all applicable requirements, including without 88 limitation, those of this chapter 89 NEW SECTION. Sec 6 A new section is added to chapter 12 01 90 of the Yakima Municipal Code to read as follows 91 12.01.060 Review and Inspection Fees. (1) The applicant shall 92 pay a non - refundable fee for review of design documents and 93 inspection of public works improvements Review and inspection 94 fees shall be based on the quantity of each item to be 95 constructed For the purpose of calculating review and inspection rr; 96 fees under this chapter, the value of public works improvements 97 must be approved in writing by the City Engineer Materials used • 98 to construct public works improvements must be approved in writing 99 by the City Engineer Review and inspection fee calculations 100 shall be submitted on forms approved by the City Engineer 101 (2) For proposals involving public works improvements valued at 102 less than five hundred thousand dollars ($500,000), review and 103 inspection fees shall equal the greater of Three Hundred Dollars 104 ($300) or five percent of the value of the public works 105 improvements For proposals involving public works improvements 106 valued between five hundred thousand dollars ($500,000) and one 107 million dollars ($1,000,000) review and inspection fees shall be 108 twenty five thousand dollars ($25,000) For proposals involving 109 public works improvements valued at more than one million dollars 110 ($1,000,000), review and inspection fees shall equal two and one - 111 half percent of the cost of the public works improvements 112 (3) Proposals will ordinarily be reviewed and inspected in the IIP 113 order they are submitted to the City Engineer An applicant may lap /legislation /development standards /ordinance 2/7/95 9 58 AM ORDINANCE: YMC CHAPTER 12.01 CONSTRUCTION OF PUBLIC WORKS IMPROVEMENTS Page 4 • y •14 request expedited review or inspection, however, an applicant 115 shall have no right to such expedited review or inspection The 116 City Engineer may determine the terms and conditions of such 117 expedited review or inspection, including, without limitation, 118 compensation for city employee overtime work 119 NEW SECTION. Sec 7 A new section is added to chapter 12 01 120 of the Yakima Municipal Code to read as follows 121 12.01.070 Severability.
