ORDINANCE NO. 95 - 10
AN ORDINANCE annexing property to the City of Yakima and zoning said
property (Nob Hill Boulevard / East Mead Avenue
Annexation)
WHEREAS, proceedings have been held in accordance with all
applicable laws for the annexation to the City of Yakima of the area which lies
for the most part south of East Nob Hill Boulevard, east of South 10th Street,
north of East Mead Avenue, and west of Interstate 82, which is referred to in
this ordinance as the "Subject Property", which is specifically depicted on the
map attached to this ordinance as Exhibit "A" and is legally described by the
legal description attached to this ordinance as Exhibit "B", and which, and
WHEREAS, notice of intention to annex the Subject Property was duly
filed with the Yakima County Boundary Review Board and the annexation
has been deemed approved in accordance with RCW 36 93 100, and
WHEREAS, the City Council finds that the requirements of RCW
35 13 130 have been satisfied through a combination of annexation petitions
and outside utility agreement annexation covenants signed by the owners of
not less than seventy-five percent in value of the Subject Property, according
to the assessed valuation for general taxation, and
WHEREAS, pursuant to due and legal notice, on February 28, 1995, the
City Council held a public hearing regarding annexation of the Subject
Property, and after considering the comments of staff and of interested
members of the public, City Council finds that it is in the best interests of the
City of Yakima and its people that the Subject Property be annexed to the City
of Yakima, that the Subject Property should retain its current zoning
pursuant to the Yakima Urban Area Zoning Map, that such zoning and
classification accords with the Yakima Urban Area Comprehensive Plan and
the General Plan of the City of Yakima, that the needs of the City and
community require that zoning classification, and that the highest and best
uses of the Subject Property are provided by that zoning classification, now,
therefore,
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. The Subject Property is depicted on the map attached to this
ordinance as Exhibit "A" and is legally described by the legal description
attached to this ordinance as Exhibit "B" Exhibits A and B are incorporated
herein by reference The Subject Property is hereby annexed to the City of
Yakima, Washington.

Section 2. The owners of the Subject Property shall be required to
assume existing indebtedness of the City of Yakima.
Section 3. The Subject Property is hereby zoned as it is currently zoned
and depicted on the official zoning map for the unincorporated portion of the
Yakima Urban Area, which map is maintained in the Yakima County
Planning Department, and which map is incorporated herein by reference
Section 4. The next regularly amended Zoning District Map prepared
by and for the City of Yakima shall show the same zoning classification for
subject property as now appears on the official zoning map for the
unincorporated portion of the Yakima Urban Area, which map is maintained
in the Yakima County Planning Department.
Section 5. The City Clerk is hereby authorized and directed to file a
certified copy of this ordinance with the County Auditor of Yakima County
and with the Board of County Commissioners of Yakima County,
Washington
Section 6. There is hereby granted to Yakima Waste Systems, Inc., in
accordance with RCW 35 13.280 a franchise to collect and dispose of certain
garbage and refuse in the Subject Property, in accordance with the specific
terms of Ordinance No 3220 and Ordinance No 3445 of the City of Yakima
and in accordance with the terms of the Franchise Agreement attached to
Ordinance No 3220 (amended by Ordinance No 3445) of the City of Yakima
The franchise granted by this ordinance shall be in effect for a period of five
years from the effective date of this ordinance
Section 7. This ordinance shall be in full force and effect the first day of
the calendar month next following thirty days after its passage, approval and
publication as provided by law and by the City Charter

All that part of Section 29 and the East half of the East half of Section 30 and the
Northeast quarter of Section 32, Township 13 North, Range 19 East, W.M. described
as follows:
Beginning at the point of intersection of the centerlines of Lindy Lane and the
West right-of-way line of South 10th Street (Fair Avenue), said point being on
the corporate limits of the City of Yakima as described in Annexation
Ordinance Number 316, dated February 5, 1%2; thence Northerly, leaving said
corporate limits, along said right-of-way line to the Southeast corner of Lot 14,
Tennant and Miles Acre Tracts, as recorded in Volume "B" of Plats, Page 7,
records of Yakima County, Washington, thence West along the South line of
said Lot 14 to a point 51 feet East of the West Line of Lot 14, thence North to a
point 50 feet South of the North line of Lot 14, thence West to a point 50 feet
South of the Northwest corner of Lot 13, thence North to the Northwest
corner of Lot 2, thence East along the North lines of Lot 2 and Lot 1 to the
West right-of-way line of South 10th Street, thence North to the North line of
the Southeast quarter of Section 30, Township 13 North, Range 19, E.W.M.,
thence East to the centerline of South 10th Street, thence North to the point of
intersection with the Southerly right-of-way line of Pacific Avenue, said point
being on the corporate limits of the City of Yakima as described in

19 Goodwin's Five Acre Tracts, according to the plat thereof recorded in
Volume "A" of Plats, Page 18, records of Yakima County, Washington, thence
North 1° 12' 20" East 280 91 feet, thence East to the West line of the East 2/5 of
said Lot 19, thence North to the North line of said Lot 19, thence East to the
West line of Block 2 of Boggess Home Sites, according to the plat thereof
recorded in Volume "H" of Plats, Page 41, records of Yakima County,
Washington, thence North along the West line of Boggess Home Sites to the

32, Township 13 North, Range 19, E.W.M., thence West following said
centerline to the West right-of-way line of I-82, thence North to the point of
intersection with the South line of Section 29 Township 13 North, Range 19,

with the centerline of South 10th Street, said point being on the corporate
limits of the City of Yakima as described in Annexation Ordinance Number
316, thence North along the Easterly limits of the City of Yakima to the point
of beginning.
EXCEPT the following described parcel of land: The West 3/5ths of Tract 19,
GOODWIN'S FIVE ACRE TRACTS, recorded in Volume A of Plats, page 18,
records of Yakima County, Washington, EXCEPT the North 20 feet of that
portion West of the East 175 feet thereof; AND EXCEPT commencing at the
Southwest corner of said Tract 19; thence North 0° 00' 45" West, reference
meridian, along the West line thereof 300.85 feet to the Northwest corner of
said Tract 19, thence South 89° 57 23" East along the North line of said Tract
19, 6.40 feet; thence South 1° 12' 20" West 300.91 feet to the point of beginning
