HomeMy WebLinkAbout1995-011 Preliminary right-of-way vacation application • ORDINANCE NO. 95- 11 AN ORDINANCE vacating an undeveloped portion of the right - of -way of North 8th Avenue between "J" Street and Madison Avenue WHEREAS, William R Ash has, under City of Yakima Department of Community and Economic Development file UAZO R/W Vac #7 -94, duly petitioned for vacation of a portion of the North 8th Avenue right -of -way between "J" Street and Madison Avenue; and WHEREAS, the Council of the City of Yakima finds that the proposed right -of -way vacation will benefit the public by facilitating expansion of the petitioner's business which will lead to increased employment opportunities and increased tax base and increased tax revenues; and WHEREAS, the Council of the City of Yakima finds that the proposed right -of -way vacation of does not deprive any property of sole access; and WHEREAS, the Council of the City of Yakima finds that the subject portion of right -of -way is not developed, is not included in the City's Six Year Transportation Improvement Plan, is not essential to other City plans, and 411 WHEREAS, the Council of the City of Yakima finds that the proposed right -of -way vacation is consistent with other plans and policies of the City, particularly with the City's economic development goals; and WHEREAS, the Council of the City of Yakima finds, based on zoning, current use and long range plans, that the proposed right -of -way vacation is compatible with existing and anticipated development in the area, and WHEREAS, the Council of the City of Yakima finds that the proposed right -of -way vacation, subject to a certain condition, provides for appropriate relocation of existing utilities and appropriate easements for future public utilities, and WHEREAS, the Council of the City of Yakima finds that the proposed right -of -way vacation is consistent with the requirements of chapter 35 79 RCW, and WHEREAS, the City of Yakima Hearing Examiner, after conducting a duly convened public hearing and considering the contents of the file and statements of interested persons at the public hearing, has recommended that the proposed right -of -way vacation be granted, subject to the condition that the petitioner shall be S physically and financially responsible to reroute the irrigation line presently located in the affected right -of- way;and lap /land use /street vacation /ash /ordinance 2/9/95 1 59 PM ASH /N 8TH AVE RIGHT -OF -WAY VACATION UAZO R/W VAC #7 -94 -- Page 1 WHEREAS, no public purpose would be served by retaining the subject right of way and it is in the best interests of the City and its people to grant the petition, subject to the condition recommended by the Hearing Examiner, now therefore BE IT ORDAINED BY THE COUNCIL OF THE CITY OF YAKIMA, WASHINGTON Section 1. The Yakima City Council hereby adopts and incorporates herein by reference the Findings and Conclusions of the Hearing Examiner's Recommendation, Examiner's No 194 -8 -56, City No UAZO R/W #7 -94, issued December 13, 1994, including the incorporated staff report incorporated a true copy of which is attached hereto as Attachment A Section 2, The City of Yakima right -of -way over the real property legally described as follows A strip of land 20 feet wide, being that portion of North Eighth Avenue described as follows Beginning at the Southwest corner of Lot 33, Cox Addition, according to the official plat thereof, recorded in Volume "H" of plats, page 22, records of Yakima County, Washington, thence West along the South line of said Lot 33 extended west 20 feet to the West line of said Cox Addition; thence North along said West line 250 feet, more or less, to the Southerly • right -of -way line of the Northern Pacific Railroad (now Washington Central Railroad); thence East along said right - of -way line to the Northwest corner of said Lot 33; thence South along the West line of said Lot 33 249 7 feet, more or less, to the Point of Beginning shall be vacated upon satisfaction of the condition precedent set forth in Section 3 below Section 3. I94 -8 -56 Portion of North 8th ) Avenue between HMI Street ) and Madison Avenue, near ) -Elks Park ) The Examiner conducted a public hearing on December 8, 1994. The staff report presented by Vaughn McBride recommended approval. There was no opposition. The Examiner inspected the property prior to the hearing. Jut before the hearing George Pechtel, appearing on behalf of Mr. Ash 4,tarted writhing and shaking in the middle of council chambers. He stripped off numerous items of clothing, apparently in preparation for the hearing. Numerous items were r:.ved, ir=:iuding coveralls. Fortunately for the rest of us, Mr. Pechtel supped when he got down to street clothes. It is therefore unnecessary to determine whether Mr. Pechtel's behavior shocked the public conscience or was simply an expression of his First Amendment rights. However, the potential for visual blight was imminent. SUMMARY OF RECOMMENDATION. The Examiner recommends vacating the right -of -way, with the applicant ultimately responsitle for rerouting the existing irrigation line. From the view of the site, the matters contained in the official record, including the staff report, a review of both the Yakima Urban Area Comprehensive Plan and the Yakima Urban Area Zoning Ordinance, and from evidence received at the hearing, the Examiner makes the following: • • FINDINGS 1. The legal description is set forth in the application and incorporated herein by reference. The right -of -way consists of 20 feet of undeveloped North 8th Avenue from "J" Street North to the Washington Central Railroad property abutting Madison Avenue. 3. Application. Petition for right -of -way vacation. 4. Staff Report Adopted. The statements of fact contained in the staff report are adopted and incorporated herein by reference, except as modified with respect to the need to retain a 16 foot wide utility easement. S. Utility Easement. The evidence is that utility mains may need to be extended from "J" Street north to Madison Avenue. Normally they would be located in N. 8th Avenue; vacation of a portion of 8th would normally require retention of a utility easement. In this instance, the adjacent city -owned park can provide room for the utilities. The purpose of this vacation is to allow construction of a building over part of the former right -of- way. Normally buildings cannot be built over public utility easements. Under the circumstances, it seems reasonable to allow the vacation without retention of a utility easement, because of the park's proximity. Of course service to the Ash property may require creation of easements on that property, but that can be dealt with during site plan review. 6. criter for Rig ht- of -WaY V acation . The evidence at the hearing as summarized in the staff report meets the city's five criteria for vacation. No compensation is required, because the right -of -way is undeveloped. Consequently, no traffic study was required. 7. Public Notice. Public notice of the hearing was provided in accordance with the state law and local ordinance, and is accurately summarized in the staff report. All notice provisions have been complied with. 3. Vacation of this right -of -way is consistent with RCW Ch.35.79 and Yakima City Ordinance No. D -5630. No public purpose is served by retaining the right -of -way. Ash REQUEST: Vacation of portions of North 8th Avenue between "J" Street and railroad right of way LOCATION: North 8th Avenue between 7' Street and Washington Central Railroad right of way CONTACT: Vaughn McBride, Assistant Planner (576 -6649) BACKGROUND Mr. William Ash has submitted a proposal to form a joint private /public sector partnership to construct a new light - industrial facility with associated off -site public infrastructure improvements within the City's State - designated Community Empowerment Zone. In addition to the new 20,000 square foot building with employee and client parking, additional company vehicle parking would be installed, new dry storage area created, loading docks for truck/train and outside staging areas installed. This new facility would allow Central's Inc. to increase its present business capabilities in its several fields of endeavors and provide Central's Inc. the room to organize and become more competitive and profitable through its reorganization. Mr. Ash has requested a 20 -foot right of way vacation for North 8th Avenue from "J" Street north to the Washington Central Railroad property abutting Madison Avenue for the proposed building project located at 619 North "J" Street The proposed use is a permitted use in the M -1, Light Industrial zoning district. North 8th Avenue was dedicated to the public with the recording of the Subdivision of Cox Addition June 29, 1938. Cox Addition and the surrounding area was annexed into the City of Yakima in February 1991 under Annexation Ordinance #3336. The immediate surrounding area is in transition from unused or poor housing stock to industrial development. To the north lies Madison Avenue with older residential housing stock on the north side of the roadway and the Washington Central Railroad tracks and the northern boundary of the proposed building project site situated on the south side of the roadway. East of the project site is characterized by light industrial/commercial development. South of the proposed project site is characterized by older residential housing stock, most of which is not suitable for rehabilitation. Ash No. 8th Avenue between °J° Street and Railroad ROW 1 I ' Public infrastructure improvements needed are the improvement of "J" Street and Madison Avenue from 6th Avenue to 8th Avenue; and the improvement of 8th Avenue from "J" Street to Hathaway Avenue: The improvements provide for building the street sections in question to local access street standards, to include water, sewer, drainage and street lighting. These improvements are in consideration of vacating public unneeded portions of the 8th Avenue right of way fronting the west side of the industrial development site. Public Use Of The Right Of Way Public use of the subject undeveloped right of way is limited to a single irrigation line to be re -routed with Public Winks Trust Fund monies requested in association with this project. Criteria For Vacation Of Right Of Ways In 1990, the City Council adopted a set of policies and procedures to govern requests for right of way vacations. The City Policy provides guidelines for right of way vacations which specifies five criteria for granting vacation petitions, which are reviewed as follows: 1. The petition must explain the public benefit of the project and the reasoning of the proposed vacation and the limits of the vacation. A legal description and trap have been submitted to identify the limits of the proposed vacation. The petition was signed by all property owners except the Railroad. WATC Investments owns the property abutting the east side of the right of way, approximately 350 feet. Washington Central Railroad owns 25 feet of the right of way through the easement at Madison Avenue. The City of Yakima owns the property west of the right of way (Elks Park) and has also signed the petitio-. The applicant is requesting the vacation of land which is currently unused and unnecessary land for road right of way. The vacation of this 'extra' land would allow the applicant to facilitate the construction of an additional 20,000 sq. ft. office and production facility for Central's Inc. and control access to the proposed development site. The public benefit for right of way vacation includes: local area economic development to assist expanded business for international trade opportunities; . increased employment opportunity; and provides increased tax base revenue to local government jurisdictions. Public testimony addressing the public benefit of this proposal will need to be considered at the public hearing. 2. The vacation right l of way does not deny any sole access to any property. Petitions should be consistent with the Six Year Transportation Improvement Plan, Urban Area Comprehensive Plan and other official City plans and policies. No plans exist in the Transportation Improvement Plan or other City plans to improve this portion of North 8th Avenue. This petition is not inconsistent with the Transportation Improvement Plan or other plans and policies of the City of Yakima and it's economic development goals. 4. Vacation requests should be appropriate with existing and anticipated development in the area, based on zoning, current use and long range plans. The proposed use of the property will be M -1, Light Industrial and is consistent with abutting property zoning. S. Existing Utilities (public and franchised) should be relocated at the developers expense or an adequate easement provided. Where appropriate, if existing utilities are deemed not necessary this requirement may be waivered. The requested vacation is limited to the undeveloped North 8th Avenue right of way between "J" Street and the Washington Central Railroad right of way. City Development Services Team (DST) comments reflect concerns regarding provision of future water and sewer line extensions. City Engineering has requested the applicant provide a 16 -foot wide utility easement for future public utilities to cover anticipated sewer and water main extensions to Madison Avenue from "J" Street City Water & Irrigation makes note of the existing requirement for the construction of a new 8" main in this portion of North 8th Avenue; there must be sufficient easement retained for this purpose. Existing public utilities are limited to a single irrigation line to be re- routed with Public Works Trust Fund loan monies in association with this project. The subject irrigation line would be relocated west of the property line of the proposed vacation request using schedule 40 PVC piping. Material and installation will be in accordance with the City of Yakima and the owner of the irrigation line standards (See attached letter from applicant). A current survey of adjoining property was completed in June, 1994. The corner property pins are in place and it would be relatively easy to provide acceptable property line identification for the City.
