S AN ORDINANCE approving the recommendation of the Planning Commission and rezoning property at the southeast corner of East Chestnut and South Naches Avenue in the City of Yakima from R-3, Multiple-Family Zone to Planned Development Zone. WHEREAS, pursuant to due and legal notice, the City Council of the City of Yakima held a hearing on the 29th day of June, 1982, on the recommendation of the Planning Commission that real property at the southeast corner of East Chestnut and South Naches Avenue in the City of Yakima, the legal description of which is set out herein below, be re- zoned from R-3, Multiple-Family Zone, to Planned Development Zone, and WHEREAS, as a result of its hearing, the City Council determined that the rezone, as requested by VA-ALTA Corporation, should be granted; and the City Council hereby makes its following findings and conclu- sions: FINDINGS: 1. The subject property is presently zoned R-3, Multiple- Family Zone. The property abuts on property zoned as R-3, Mul- tiple-Family Zone on the north, east, and south sides, and the property across Naches Avenue to the west is zoned as B-3, General Business Zone. 2. The property is proposed to be developed and used as a parking lot with 88 parking spaces for employees at the Chinook Tower, situate within a block of the premises. 3. The use of the property as proposed is in accordance with the Land Use Plan of the City, "if conflicts with the citizens can be substantially resolved". 4. The property is proposed to be developed with landscap- ing, a screening fence, and hooded lighting so as to minimize conflicts with the use of other property in the vicinity. 5. Additional parking is needed in the area of the subject property to relieve existing and contemplated future traffic con- gestion and to provide needed parking spaces. 6. The Planning Commission recommended that the rezone ap-_, plication be granted. D3 X1 CONCLUSIONS: 1. The proposed use of the property is consistent with the City's Land Use Plan, and the property will be developed so as to substantially resolve conflicts between the use of this property and surrounding property. 2. The rezone application should be granted; now, therefore; Am. BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. The following described real property situate at the southeast corner of East Chestnut and South Naches Avenue in the City of Yakima, Washington, and more particularly described as follows: Lots 13, 14, 15 and 16, Block 112, Town of North Yakima, now Yakima, recorded in Volume A of Plats, page 10, rerecorded in Volume E of Plats, page 1, Records of Yakima County, Washing— ton, is hereby rezoned from R-3, Multiple—Family Zone to Planned Development Zone, all in accordance with, and to conform to, the final development plan and program therefore, a copy of which is attached hereto and by reference made a part hereof. Section 2. The above change in zoning shall be included and de— picted on the next regularly amended Use District Map prepared by and for the City. Section 3. The City Clerk is hereby authorized and directed to file with the Yakima County Auditor a certified copy of this ordinance. Section 4. This ordinance shall be in full force and effect 30 days after its passage, approval and publication as provided by law and by the City Charter.
