ORDINANCE 100. 2629 AN ORDINANCE granting a major modification of a Planned Development Zone applicable to property at the southwest corner of 56th and .Summitview Avenues in the City of Yakima. WHEREAS, pursuant to due. and legal notice, the City Council of the City of Yakima held a hearing on the 22nd day of June, 1982, upon the recommendation of the Planning Commission that a major modification be granted to the Planned Development Zone applicable to property on the southwest . corner of 56th and Summitview Avenues, the legal description of Whidh is set out herein below, and • WHEREAS, as a result of its hearing, the City Council determined that the recommendation of the Planning Commission should he approved • • and the major modificatiOn should be granted; and the City Council hereby makes its following findings and conclusions:,. . FINDINGS: 1. The property is presently zoned as a Planned Development Zone • to accommodate a Safeway Store. The original plan called for a Safeway Store and a Payless Drug Store, but the Payless Drug Store was deleted from that original plan by earlier City Council action When property became unavailable to accommodate that Payless Store. More recently, property has been acquired so that the Payless Store . may be constructed, as originally intended by the developers of that property, and as originally approved by the City Council in its Planned Development Zoning of that property. 2. The history of the development, and the ruling of the Yakima • County Superior Court in Yakima County Cause No. 78-2-01453-3 support and require the grant of this modification to allow the • construction of the Payless Store. 3. The Planning Canmission recommended the grant of the major modification, ,stibject to the condition set out herein below. 410 CONCLUSIONS: I. The recommendation of the Planning Canmission should be ap- proved and the major modification to the Planned Development Zone 411 applicable to the property should be granted, subject to the condi- tions recommended by the Planning Commission and set out herein • below; now, therefore, BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. The recommendation of the Planning Commission of the City of Yakima that a major modification be granted to the Planned Development Zone applicable to the following described real property, situate at the southwest corner of the intersection of 56th and Summit- view Avenues in the City of Yakima, Washington, and more particularly described as follows: Beginning at the Northeast corner of the Southeast quarter of Section 21, Township 13 North, Range 18, E.W.M.; thence N 88° 51'25" W along the North line of said subdivision 200.00 feet; thence South 38.00 feet to the true point of beginning; thence N 88° 51'25" W 323.56 feet; thence 50° 03'20" W 252.62 feet; thence N 88° 51'35" W 125 feet; thence 50° 03'20" W 17.00 feet; thence N 89°56'40" W 25.00 feet; thence 50° 03'20" W 220.52 feet; thence S 88° 51' 35" W 644.03 feet; thence North 323.60 feet; thence N 88° 51° 25" W 170.00 feet; thence North 167.00 feet to the true point of beginning. is hereby approved, and the Planned Development Zone applicable to the above described property is hereby modified to conform to the modified plan and program therefore as approved by the Planning Commission, a copy of Which Plan and Program is attached hereto and by reference made a part hereof, subject to the following conditions: CONDITIONS: 1. That the store receiving hours be limited to the hours between 7:00 A.M. and 8:00 P.M.. 2. The delivery vehicles are not to use the public right-of-way (South 56th Avenue) for negotiating access to the delivery dock. • All maneuvering shall be accomplished on the Payless site. Section 2. The above change in zoning shall be included and de- picted on the next regularly amended Use District Map prepared by and for the City. Section 3. The City Clerk is hereby authorized and directed to file with the Yakima County Auditor a certified copy of this ordinance. Section 4. This ordinance shall be in full force and effect thirty days after its passage, approval and publication as provided by law and 410 by the City Charter.
