HomeMy WebLinkAbout1994-044 Franchise Agreement/Pacific Power & Light ORDINANCE NO. 94- 44 • AN ORDINANCE extending the current Pacific Power and Light Company franchise agreement through September 30, 1994 WHEREAS, PacifiCorp., an Oregon Corporation (dba. Pacific Power and Light Company) has been operating under a franchise with the City of Yakima since September 16, 1969, and WHEREAS, the current franchise is due to expire September 16, 1994, and WHEREAS, the City of Yakima and the Pacific Power and Light Company are currently in negotiations to create a new franchise under which Pacific Power and Light Company will operate in the City of Yakima, and WHEREAS, the City of Yakima and the Pacific Power and Light Company have negotiated in good faith toward a new franchise agreement, which is expected to result in a renewal agreement being presented to City Council no later than August 23, 1994 to take effect October 1, 1994, and WHEREAS, both under the new franchise agreement there will be no franchise fee and concomitantly the City utility tax applicable to Pacific Power and Light will be raised from four to six percent to compensate for the loss of a franchise fee; and WHEREAS, the City and Pacific Power and Light believe that it was in the public interest and in the interest of Pacific Power and Light that the terms of the current franchise continue until the end of the calendar month for accounting purposes; and WHEREAS, this ordinance provides for the immediate preservation of the public's peace, health, and safety of the people of the City of Yakima, and an emergency is hereby declared to exist, now, therefore, BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1 The terms of the current franchise agreement with Pacific Power and Light Company as approved by Ordinance No. 1147 is hereby continued in effect from September 16, 1994 through September 30, 1994, contingent on the signature of an authorized representative of Pacific Power and Light, below, showing that Pacific Power and Light agrees to continue according to the terms of the above referenced franchise. Section 2 Effective Date.
