HomeMy WebLinkAbout1982-2630 MODIFICATION TO PROPERTY ON NORTHWEST CORNER OF CORNELL AVENUE & WEST NOB HILL BOULEVARD. • ORDINANCE NO 26 3 0 • AN ORDINANCE granting a major modification of a Planned Development Zone applicable to. property on the northwest corner of Cornell Avenue and West Nob Hill Boulevard; and declaring • an emergency. WHEREAS, pursuant to due and legal notice, the City Council of the • City of Yakima held a hearing on the 27th day of July, 1982, upon the recommendation of the Planning Commission that a major modification be granted to the Planned Development Zone applicable to property on the northwest corner of Cornell Avenue and West Nob Hill Boulevard in the City of Yakima, the legal description of which is set out herein below, and WHEREAS, as a result of its hearing, the City Council determined III that the recommendation of the Planning Commission should be approved and the major modification should be granted, and that this ordinance and the modification should be immediately effective because of an emergency situation confronting the developer of that property per— taining to the availability of financing; and the City Council hereby makes its following findings and ,conclusions: • FINDINGS: • 1. The applicants have requested a major modification to an existing planned development located at the northwest corner of Cornell Avenue and West Nob Hill Boulevard. Their proposal is to construct a 17,000 square foot building to house a retail'fabric store. There are plans later to locate a second business in the building that would compliment the fabric store. If the project is approved, the applicants intend to start construction within three to sixmonths. 2. The property is zoned Planned Development (Commercial) • • and lies unimproved. The surrounding zoning and land use is as follows: North Planned Development Adult Apartments South R-2 Single Family/Apartment House • • East B-3 Church West R-2 Single Family • •• 3. The property is suited for auto oriented' Commercial develOpment,- according to the criteria set forth in the Optimal • Land Use Plan. • • D3 X3 4. The site has been zoned Planned Development (apartments/ commercial) since June, 1973. The 1973 commercial proposal was for a drive—in dairy mart to be located on the east half (Cornell Avenue side) of the property abutting West Nob Hill Boulevard. The west half contained no proposal and was to be developed later under Aft the guidelines set forth by Planned Development zoning approval. 1111 5. In April of 1978 a request for a major modification for the east half (dairy mart) was submitted. The proposal was for the construction of a fast food restaurant in the previously proposed dairy mart location. The City granted approval of this request. 6. The Planning Commission recommended this modification to the existing Planned Development he granted. 411 CONCLUSIONS 1. At least half of the property has been established as being acceptable for intensive automobile oriented commercial development. The west half contains the same potential for inten— sive commercial development as the east half, already developed. The proposal is to develop the entire site, thereby eliminating any potential compatibility conflicts. The proposal is within the range of acceptable land uses determined to be automobile oriented commercial as defined by the Optimal Land Use Plan. 2. The recommendation of the Planning Commission should be approved, and the major modifications should be granted; now, therefore, BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. The recommendation of the Planning Commission of the City of Yakima that a major modification be granted to the Planned Development Zone applicable to the following described property situate at the northwest corner of Cornell Avenue and West Nob Hill Boulevard in the City of Yakima, Washington, and more particularly described as follows: The south 150 feet of Lots 27, 28, 29 and 30, Blackburn's Half Acre Tracts, as recorded in Volume D of Plats, page 14, records of Yakima County, Washington, D3 X4 is hereby approved, and the Planned Development Zone applicable to the 1 above described property is hereby modified to conform to the modified plan and program therefore, as approved by the Planning Commission, a copy of which plan and program is attached hereto, and by reference is 4 made a part hereof. Section 2. The above change in zoning shall be included and de— picted on the next regularly amended Use District Map prepared by and for the City. Section 3. The City Clerk is hereby authorized and directed to file with the Yakima County Auditor a certified copy of this ordinance. Section 4. This ordinance is one to provide for the immediate . preservation of the public peace, property, health and safety of the people of the City of Yakima, and an emergency is hereby declared to exist, and this ordinance shall be in full force and effect immediately upon its passage, approval and publication as provided by law and by the City Charter.
