HomeMy WebLinkAbout1994-071 Tattoo/Age Restrictions ORDINANCE NO. 94- 71 AN ORDINANCE relating to the licensing and regulating of tattoo businesses, defining tattooing; imposing certain age restrictions upon who may be tattooed, amending Section 5 76 010; adding as a new section Section 5 76.025, and repealing Sections 5 76.020, 5 76.030, 5 76.040, 5 76.050, 5 76.060, 5 76.070, 5 76.080, 5.76.090, and 5.76.100 all of the City of Yakima Municipal Code. BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1 Section 5 76.010 of the City of Yakima Municipal Code is hereby amended to read as follows: "5.76.010 Definitions. For the purpose of this chapter, certain words and phrases shall be construed as hereinafter defined. Words in the singular-inc -lude-the present tense shall include the future. As used in this chapter. unless the context or subject plainly requires otherwise. the following words. terms. and phrases shall have the following meanings ascribed to them. 4111 • employee or inspector of the h alth office. (b) (1) TATTOOING: 'Tattoo' means any method of placing designs, letters, scrolls, figures, symbols, or any other marks upon into or under the skin with ink or colors, by the aid of needles or instruments. (c) PERSON: Any person, firm or corporation, owner or operator (2) 'Person or entity' includes any individual. firm. partnership, trust. joint venture. association. or corporation owning and /or operating a tattooing business as herein defined. (3) 'Tattoo business' means any person or entity who provides, attempts to provide. sells. and /or attempts to sell tattooing." Section 2 Section 5 76.025 is hereby added as a new section to the City of Yakima Municipal Code as follows: "5.76.025 Age restrictions. It is unlawful for any tattoo business to tattoo any person under the age of sixteen (16) years, or any person under the age of eighteen (18) years without the prior written consent of her /his parent or legal guardian, and such written consent must be kept on file on the premises of the tattoo business where the tattoo operation was performed for at least two (2) years thereafter If the tattoo operator has any doubt about such age, the operator must obtain proof thereof before any tattoo operation is performed."
