ORDINANCE NO 94 -78 AN ORDINANCE relating to rates, charges and fees for pretreatment program activities for industrial (non- domestic) wastewater discharged to the wastewater treatment systems of the city of Yakima, amending section 7.65110 of the Yakima Municipal Code, and providing for related matters. WHEREAS, the City of Yakima ( "City ") is authorized by RCW 35.67 190 and by Article IX, Section 1 of the City Charter to establish rates, charges and fees for use of the City's wastewater system, and WHEREAS, the City has established a state- and federally- mandated wastewater pretreatment program for industrial (non- domestic) wastewater pursuant to Ordinance No 3461, which is codified at Chapter 7 65 of the Yakima Municipal Code ( "Code "), and WHEREAS, the City deems it equitable to allocate the costs of the City's wastewater pretreatment program to customers discharging non - domestic wastewater, now, therefore, BE IT ORDAINED BY THE CITY OF YAKIMA. Section 1 Section 7 65 110 of the City of Yakima Municipal Code is hereby amended in its entirety as follows. "7.65.110 Rates, charges and fees. A It is the purpose of this section to provide for the payment of rates, charges, and fees from dischargers to the City's POTW, to compensate the City for the cost of administration of the pretreatment program established herein. B Rates, Charges and Fees to be Published The wastewater supenntendent shall maintain a schedule of current rates, charges and fees, shall post such schedule conspicuously, and shall make copies available to interested persons Upon request, the wastewater superintendent shall prepare an estimate of annual rates, charges, and fees for a significant industrial user C. Initial Base Rates. Commencing on the effective date of this ordinance and until amended pursuant to Subsection E below, industrial users shall pay the following base rates for pretreatment service - Page 1 prerr,mc fee cri December 14 1994 c Yearly Charge Significant Industrial Users (according to the fee schedules in Subsection D of this section) Minor Industrial Users $230.00 D Charges and Fees for Related Services. Commencing on the effective date of this ordinance and until amended pursuant to Subsection E below, industrial users shall pay, in addition to base rates, the following charges and fees for specific services relating to pretreatment of wastewater discharge: SAMPLING Duration of Sampling Total Fee One Day $180.54 Three Days $316 62 Seven Days $588.78 LABORATORY FEES Test Fee BOD (biochemical oxygen demand) $ 22.02 Suspended solids (SS) $ 17.62 p H $ 4.40 FOG (Fats, Oils & Grease) $ 30 71 Metals $307 00 Volatile organics & pesticides $315.00 BTEX only $ 76.00 Pesticides $181 00 BNA (semivolatiles) $266.00 Total petroleum hydrocarbons (TPH) $ 76.00 MISCELLANEOUS SERVICE CHARGES Service Charges MTCA /CERCLA discharge authorization $250.00 per event Compliance inspection $ 29.00 per hour Dye testing $ 48.00 per hour Smoke testing $ 48.00 per hour T V i n g $260.00 per hour 0 Page 2 • E. Amendment of Base Rates, Charges and Fees. 1 The base rates set forth in Subsection C of this section may be amended annually by resolution of the City Council Such amendments shall become effective upon publication. Any such amendment shall be based upon changes in the City's cost of providing wastewater pretreatment service as reflected in the City's annual budget. The base rates set forth in Subsection C of this section are to be billed at 50% This percentage may be amended by resolution of the City Council. 2. The charges and fees set forth in Subsection D of this section may be amended from time to time by resolution of the City Council upon recommendation of the wastewater superintendent Such amendments shall be based on changes in the costs of providing sampling, laboratory and miscellaneous wastewater pretreatment services In determining whether there has been a change in the costs of providing service, the City Council may consider the City's expenses associated with obtaining services from private laboratories and other third persons, and the City's own administrative and other costs " Section 2.
