HomeMy WebLinkAbout1996-054 Rezone ORDINANCE NO. 96 - 54 • AN ORDINANCE rezonin g three parcels located on the north side of East Mead Avenue specifically addressed 1105, 1107 and 1109 East Mead Avenue, Yakima, Washington, from Two - Family Residential (R -2) to Light Industrial (M -1) and amending the zoning map of the Yakima Urban Area accordingly WHEREAS, on February 22, 1996, the Hearing Examiner conducted a duly convened public hearing on the application (UAZO RZ #7 -95) submitted by Terry P Morton and Lynn W Parton, requesting amendment of the Official Yakima Urban Area Zoning Map within the City of Yakima and rezone from Two - Family Residential (R -2) to Light Industrial (M -1) of three parcels located in the vicinity of East Mead Avenue and East Nob Hill Boulevard in Yakima, Washington, specifically Yakima County Assessor's Parcels # 191329- 33038 - 2,191329- 33039 -0, and 191329 -33040 (all referred to below as "the Subject Property "), and WHEREAS, as a result of that hearing and review of the record the Hearing Examiner recommended to the City Council that the requested rezone be denied, and WHEREAS, at its May 7, 1996 public meeting the Yakima City Council rejected the Hearing Examiner's Recommendation, and WHEREAS, on July 2, 1996, the Yakima City Council conducted a duly convened public hearing on the proposed rezone, and S WHEREAS, as a result of the July 2, 1996 hearing and review of the record, the Y akima City Council determined that the Subject Property is (1)suitable for uses permit- ted in the Light Industrial (M -1) District and (2) is compatible with the neighborhood, (3) there exists a public need for the proposed rezone and (4) since the existing zoning was established circumstances have changed and now make the proposed rezone appropri- ate, and (5) the proposed rezone is consistent with and complies with (a) the require- ments and considerations set forth in Yakima Municipal Code Chapter 15.23, (b) the goals and policies of the Yakima Urban Area Comprehensive Plan, (c) the intent of the Yakima Urban Area Zoning Ordinance, and (d) other applicable land use controls, and, WHEREAS, the best interests of the City of Yakima would be advanced by rezoning the Subject Property; now, therefore, BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1 The three parcels located on the north side of East Mead Avenue and addressed 1105, 1107 and 1109 East Mead Avenue, Yakima, Washington, specifically Yakima County Assessor's Parcels #191329 - 33038 -2, #191329- 33039 -0, #191329 - 33040, which are currently zoned Two - Family Residential (R -2), and which are legally described as. 1107 E. Mead Ave., Yakima County Assessor's Parcel # 191329 - 33038 -2 Beginning 30 feet North and 148 9 feet East of the. Mead Ave., Yakima County Assessor's Parcel # 191329 -33040 Beginning at a point 30 feet North and 226.4 feet East of the Southwest corner of Section 29, Township 13 North, Range 19, E.W.M., thence North 150 feet, thence East 514 feet, thence South 150 feet; thence West 514 feet to the point of beginning. (referred to below as "the Subject Property "), shall henceforth be zoned Light Industrial (M -1), and the Official Yakima Urban Area Zoning Map shall be amended accordingly Section 2. The City Council finds formally that (1) the Subject Property is suitable for uses permitted in the Light Industrial (M -1) District; (2) the proposal is compatible with the neighborhood, (3) there exists a public need for the proposed rezone and (4) since the existing zoning was established circumstances have changed and now make the proposed rezone appropriate, (5) the proposed rezone is consistent with and complies with (a) the requirements and considerations set forth in Yakima Municipal Code Chapter 15.23 (b) the goals and policies of the Yakima Urban Area Comprehensive Plan, and (c) the intent of the Yakima Urban Area Zoning Ordinance, and (d) other applicable land use controls. Section 3. The City Clerk is hereby authorized and directed to file with the Yakima County Auditor a certified copy of this ordinance, and Section 4 This ordinance shall be in full force and effect 30 days after its passage, approval, and publication as provided by law and by the City Charter, and this decision shall be final and conclusive unless within 30 days from the date of final action by the City Council an aggrieved party obtains an appropriate writ of judicial review from the Yakima County Superior Court for the purpose of review of the action taken.
